  1. I will transfer money from my homeland to USA to start my immigration journey. I am wondering whether this money will be taxable or not. How to prove that this money were my savings before getting the green card?
  2. My wife has an interview date April 5 for IR1 visa in Rio de Janeiro. Does anyone know if they will ask for a more current proof of income? The income I submitted for the past 3 years was all over 60,000 and I know that April 15 you will need to submit the current tax returns.   3. Hi, My spouse and children (one stepchild, one biological) arrived in the US last September on IR1/IR2. I had a few tax related questions Since my spouse and children only lived with me part of the year (rest of the year they were in their home country) 1) Can I file MFJ with my spouse for 2023 2) Can I claim my bio child and stepchild as dependents for 2023 even though they weren't living in the US with me the entire year? (The other bio parent of my stepchild is an Indian citizen who lives in India, and my wife has full custody) Thanks
  4. Hello again everyone, starting from January 2024 I can file the N400. However, the main concern in requesting the US citizenship or not, is the tax implications. I basically own an apartment in my country, which was purchased by my parents in 2014 and right after was donated to me. It has a certain value (range 500k to 1M $), hence I am afraid I have to pay high taxes on it. Btw, I am not getting any income from the property. My parents live there. Question is, if I decided to become a US citizen will I have to pay taxes on it? Or, since it was purchased before US neutralization and do not get income, should I be fine? thank you !
  5. Hey, I had my interview last week, and ISO asked how much did I make in 2022. I replied $25,000. And I made all that money working under the table, so my employer never reported anything to the IRS and I never got a W-2 either. So, I unknowingly did not file any tax on it. Thus only reported income on the IRS was from my USC spouse, and my tax transcript only had that income which was lower than $25,000, ISO said so you did not report it to the IRS, and I said "Yes". Now I think that this falls into tax evasion and could be considered a crime involving moral turpitude. So, how do I avoid getting denied based on CIMT? Should I amend my tax return and pay taxes on that? if so, How do report that income as I don't have a w2 or any proof other than a cash deposit at the Bank? Please help me out am panicking. Thanks
  6. I submitted form 1040 tax returns for myself and the joint sponsor. NVC sent a message asking for W2 or 1099 forms. we dont have these as joint sponsor is self employed and I am not employed and live abroad. What should I do?
  7. I have been filing as single on my W-4, but recently married my wife on a K-1 Visa and I am not sure exactly what to do. Should I file as Married filing seperately, or Married filing jointly. My wife does not work, but she does have an SSN and is currently waiting for her greencard and work employment authorization. Also if I decide to file as 'Married filing Jointly' then should I claim her as a dependent? I just want to make sure I am filling this form out correctly since this is the first time I am filling it as a married man. I would appreciate any help I can get. Thank you in advanced.
  8. My husband and I are currently waiting for his spousal visa interview (CR1). For the past two years, since we have been married, I have filed MFS. I have filed through TurboTax and mailed my filings with non resident alien written in the spousal SSN. If he is able to get an interview and get his visa this year and able to enter the US, I would like to file MFJ. My questions are related to his income earned in Mexico. (1) Since he doesn’t have a W2 or a similar document, does anyone know how I would enter that income into a tax prep software? (2) How would I convert pesos to USD? Would it just be on the conversion rate at the end of the year? (3) Is there a way to deduct what Mexico taxes my husband has paid from my tax liability? (4) If he enters the US this later year, do I have to claim all of his Mexico earnings even though he was not in the US all year? If anyone has any suggestions on this topic, I would greatly appreciate it.

  10. Hello all, I have a question about something that was put on our file. So my wife doesn't files taxes or tax returns which she have written a letter explaining that. Today we got anoter RFE after her 1099s and Letter of Explanation for not filing taxes was accepted that she needs to send/upload Federal Income Tax return or transcript...well she has been on Social Security Disability for 11 years and she has not file any tax returns etc. Anyone has the same situation and how did they resolved it? Cause this is insane and we don't know what to do once its says on a irs website that she doesn't have to file taxes if she is on disability SSN....ANY HELP will be greatly appreciated it and it will be highly rewarded with good Karma and great luck for all of you.   11. Hello, Please advice. At the beginning of our visa journey we hired a lawyer in hope we will not have any surprises and mistakes. My husband is US citizen and we were hoping I will join him soon in US. We got married in July 2020, filed everything in September 2020, first part was OK and in March 2021 we submitted all documents to NVC. My husband owns a S-Corporation and has no W2/1099 only 1020S for 2021 individual tux return. Form 1020S prove his income through S-corporation. Since he often travels outside of US because we use our last chance to have kids through IVF (we are in our 40s). We literally have natural IVF cycle every month, he is not employed and does not have W2 or 1099, but he has more than enough income through his S-corporation to support me. We did submitted tax return for 2021 for our company, 1099 for company, his individual tax return with 1020S and information of his income through s-corporation. NVC keep asking and asking for his W2/1099 form. Unfortunately our lawyer told us at the begging that this will not be a problem, and now he telling us that they changed rules. He advised us to find sponsor with W2 form (which was not logical to me, but we did it anyway). He submitted all necessary documents for my cosponsor. I received the same message again “Please submit every W2/1099 for XX (my husband) for 2021” We are miserable and to be honest we don’t know what to do anymore. Do you have any advise for us? We will greatly appreciate any help
  12. Greetings, I am a USC, currently waiting on I-130 approval for my Pakistani bride. We are not at the NVC stage yet. I went to file my taxes and the only option H&R Block would give me is to file as single. Since the wife does not currently have an SSN, is unemployed, and resides overseas. I do not have or plan to get an ITIN for her. My question is that would filing single while married to an overseas spouse cause problems at the NVC? Do I have to file an amendment immediately and have it ready by the time NVC requires it? Can I send this amendment after she finally arrives in USA and get an SSN? Has anybody here ever had a problem with the NVC process due to this filing as single, instead of Married filing separately or Head of household? Anybody ever experienced any negative impacts on the immigration petition or embassy interview stage due to having filed single while married to a foreign spouse? Do I have to go back to H&R block to request an edit/amendment or just leave it be? Please send your reply in detail with credible sources.
  13. Hi guys, I have a slight dilemma. I am a USC whose wifes i130 just got approved. We are moving to the NVC stage. Last year, I got overzealous and filed for an ITIN number for my wife with my 2021 tax returns (married filing jointly). Finally after a year, she got that approved few weeks ago however, my 2021 tax return is still not processed and might take another few months per IRS... I know the requirement is only latest tax year which would be 2022 returns (correct me if wrong), so I am debating about just e-filing as married filing single this time around to avoid anymore headaches - despite having an ITIN number for her (I will get less refund back but that's ok). Do you think my strategy sounds right? P.s - there is no way for me to get a transcript for 2021 as IRS says they are processing it...and I keep hearing that sending last 3 tax returns is safe bet so I'm stressed. Thank you
  14. Hello everyone, My fiancé filed his taxes on Feb 2nd and we still do not have the 2022 tax transcript. I have received package 3 from the US embassy in Madrid where they ask me for the most recent tax transcript, however, the most recent one we have would be 2021. In 2021 my fiancé was not working for his current company. He has been working there since January 2022. In both companies he exceeded poverty lines. All we can do is submit the tax transcript for 2021, W2 for 2022, plus pay stubs for the last few months and the welcome letter from his current company stating the annual salary. Do you think this is enough or do you recommend us to wait for the 2022 tax transcript? Thank you so much!

  16. Hi All, My wife (fiance at the time) arrived in the US in August of 2022 and we got married in September 2022. She also applied for and received her SSN in September as well. She applied for AOS with an NOA1 date of October 10th. We are now filing our tax return for 2022 and ran into a question. We would like to file jointly (MFJ) but it is unclear to us what her current status actually is. From what I've been able to find on here it seems like for tax purposes she might be a Resident Alien, even if by USCIS standards she isn't one. In reading on if this was correct or not, I found several older posts here on VJ stating we had to file the 2022 tax return by mail (was planning on e-filing with TurboTax) and send in some statement asking her to be considered a Resident Alien for the IRS. Is this correct? I'm unsure if it matters or not, but she had no reportable income for 2022, so we don't have additional forms from that angle to file. Happy to provide more clarification if needed, thanks in advance everyone!
  17. Hi I'm applying to bring my husband to US under IR1. My husband received a 221g slip after the interview asking for a missing tax document from the joint-sponsor. However, I noted that in this last year, the sponsor did not make the minimum income under the poverty guide. So, I'm thinking about applying with my husband's foreign income instead. He works remotely for an American company but he's in a branch, so his income is not in USD but he makes way more than the minimum. My question is: As I'm not sending what the 221g is asking for, will that be a problem? Can they terminate or send back my case to USCIS if, for some reason, my husband's income is not accepted or I get a new chance? THANKS
  18. Hello, I'm eligible to apply for my N400 and I qualify for the 5 year Green card category. I understand that I need to have last 5 years worth of Tax return transcripts. I recently got married and my wife is Non resident alien i.e she lives outside the united stated and she is going through immigration process. Last year I.e 2021, I filed a the return return through paper filing instead of e-filing and the tax return was accepted by IRS. I have a copy of the paper returns from turbo tax which I used to prepare. Unfortunately, When I try to access the transcript for 2021 on IRS.gov, It says it does not have any record for 2021. But when I checked the IRS's "where is my refund?" tool, I can see that the "return was received" by IRS. My question is if I cannot get the tax return in time, Can I take the returns from turbo tax instead and my W2s? I can also show that I send in the check that I owed extra which IRS cashed in. is there anything I can request from IRS that helps? also do I need to submit the tax return when I submit the N400 application or can I just carry it for the interview. Thanks for your answers.
  19. Hello, my wife (US citizen) and me (German) live in Germany, already for 10 years now. Before we had been living in the US. When we moved, we brought our household with us, at least a good amount of it, and were able to ship it without paying any custom taxes. However, some nice furniture has been sitting in the attic of my wife's parents ever since. Now we would like to ship it to Germany. Is there a way to avoid having to pay custom taxes in Germany for importing those pieces of furniture? We know there is a 12 month limit for shipping household items as part of a move...   20. Hello everyone, I have 2 questions that I am hoping I can get some help with or information from anyone who has been through a similar experience. I applied for my re-entry permit (i-131) in July and gave my biometrics in September (online status shows that my fingerprints were accepted). Once I had my biometrics appointment, I left the USA and came back to the U.K. I understand that a re-entry permit can take up to a year to be completed. I wanted to know if I can still travel to and from the USA with this permit pending? Or should I wait until I have my re-entry permit in hand to be able to travel? My next question concerns taxes. I became a LPR in May 2022. I have not yet moved to the United States (for various reasons) but I will be making the permanent move in 2023. Do I need to submit a tax return for 2022? Or do I only submit a tax return once I have officially moved and resided there for a longer period of time. Any answers would be massively appreciated. Thank you.
  21. Possibly a long shot given the sparsity of results when searching this topic on VJ - but is anybody here making voluntary NICs to HMRC? Keen to do so but Form NI38 is a bit confusing - the "Ordinarily Resident" question in particular seems counterintuitive. Would be interested if anybody is doing this and how they went about filling out this form. Cheers!
  22. My friend’s lawyer said to my friend that ”You can work and pay tax since you are a spouse of US citizen. It’s nothing have to do with immigration process, but to work and put tax. She said it’s kind of special measures so that IRS can collect taxes because a lot of people work under table anyways and there is income limit of course. If you file tax for the income, you should file as a sole proprietor. “ Anyone knows about this? If you know the information and or the link? I will help the friend’s tax file for this year, so I need to know but my friend didn’t ask her lawyer much about that.. Thank you in advance.

  24. Hello, everyone! I have my citizenship interview next week. I am filing under the 5 year rule. I just learned that I may be not ready for the interview. I would like to seek help on what to do. I have all my expired and new passports, I have my green card, my 1st and marriage certificates and 1st marriage divorce papers. I have 2019, 2020 and 2021 tax transcripts. I did not work the whole of 2018 and 2019 and filed nothing with IRS. My thinking is that since I did not file anything on these years, I have no papers to show the immigration officer for these years and I would have to explain that I did not work. However, just today, I learned that there is such a thing with IRS called transcript of non-filing, However, it will take 5-10 days to get this paper. Today is Wednesday and my interview is Thursday next week. Should I reschedule my interview?
  25. My husband had his citizenship interview under 3 year rule and he passed civics test but he got rfe The officer said he was missing past 3 years worth tax returns. We filed jointly the last 2 years but didn't file in 2019 because we did not meet minimum threshold to file a tax return. When the RFE notice becomes available to us ( the officer verbally explained to him why he is getting rfe but we didnt receive any official mail yet) we were going to send our most recent 2 years tax return and explain why we didn't file in 2019. But I just checked our documents and we answered NO to a question that asked Have you ever NOT filed a tax return.............. And now I'm scared that his case will be denied for not answering truthfully.....although it was a honest mistake. We are planning on sending our tax documents for 2019 that shows that we were not required to file a tax return and we are also planning on filing late tax return for 2019 anyway and send that as well... Is filing a late tax return anyway a bad idea? If we attach a letter explaining that we realized we answered a question wrong hurt our case? Any answer would really help...
