Hello all! I just wanted to share USCIS’s proposed rule for fee increases: 

 

Page 18 is where the proposed increases start. An example is the I-129F increasing from $535 to $720. They are open for public comment and the instructions are listed on page 2 so if you want to submit your comment make sure you do!

Table 29 has the entire proposed fee schedule.

 

I-751 will increase from $595 to $1195.... a 101% increase.

N-400 will increase only $60

Why is the fee increase directly proportional to the processing times increase? 🤡

And let's not even talk about how useless that form is altogether...

Also looks like the elimination of free I-765 and I-131 with a pending I-485 application seems to have stuck from the 2020 proposal.

Looks like we'll have a new thing to add to the list of why K-1 is not a good choice anymore over CR-1, if these proposed changes are approved/implemented.

Also looks for I-130 they are trying to force everyone to do online filing by making paper filing more expensive. I guess so they can eventually kill off paper filing.

Holly cow, the increase for I-751 is insane. Whopping  101% (77% with Biometrics) increase. I-751 has become a cash cow for USCIS. Seems now biometrics is just automatically going to be inclusive of general I-751 fee.

My spouse entered the US with CR1 about 7 months to our 2nd anniversary. If this increase had come in play then we would have just delayed everything until 2nd anniversary.

looks like since the I 130 only goes up $15 and all the fees for fiancee including AOS  ( adjustment of status (green card) application costs would jump from the current $1,225 to $1,540.)

 

USCIS is attempting to persuade USC to marry and abandon the fiancee visa (my opinion only)

 

Not only does the I 129 involve the extra fees and more documents for the USC with the AOS and ROC requirements but it adds a lot of office time to USCIS officers with the additional forms and interviews 

 

seems if they had their way,  the fiancee visa would be discontinued altogether

Even pre-pandemic, K-1s were significantly less popular than both CR-1/IR-1s and AOS from non-K visas (yes, you're not supposed to enter the US on a tourist visa with intent to AOS and stay, but we all know how that works out in practice).

 

It made sense to do a K-1 for us at the time (no Utah Zoom marriages then, marrying a foreigner in Russia is a pain, and young single Russians couldn't easily get tourist visas), but I'd certainly advise against doing one now.

Actually I think the Biden Administration propose charging more, I saw that EAD and AP will be charged and not included.

They want to charge $2,820 for I-485 with concurrently filed EAD and AP…. 130% increase. Yikes.  And they can’t even guarantee that EAD/AP will be issued well before GC. What is the point of those forms then? I, for example, received my GC several months before my EAD/AP were even looked at. 
 

USCIS complains that fee increases haven’t gone up in years which affects their productivity yet they propose such drastic and extreme increases without guaranteeing reasonable processing times.

I-751 fee increase is quite bonkers to be honest. Seems quite unfair that folks that by definition are permanent residents, but have conditions on them that they have to file this stupid form otherwise face removal are being extorted up the backside for it. Go figure, easy targets.

 

I wouldn't mind so much if it came with some guarantee that they'd process these within 12 months, but it's a tough pill to swallow when these forms are yeeted into a USCIS pit only to be fished out when the N-400 forces their hand.
