LPR to U.S. Citizen. Will lose job if I go see wife

Hello,

 

I recently became a u.s. citizen in March 5th. I had applied for passport and I have expedited my passport so that I can be with my wife. She has been living alone for 5 years now. We have been documentarily approved since January 2020. I just recently asked my boss if I can travel to india to be with my wife since she is alone. My boss replied that the company does not allow remote work offshore and this is against corporate policy irregardless of employees situation. My wife cannot live alone anymore and she cannot risk living in someone else’s house during Covid.

 

If I leave my job, I will face extreme financial hardship. I have a house for $650k and my monthly mortgage is $3.4K. By losing this job, I will ultimately burn through my funds while risking a default on my loan and my home could be seized by the bank. I have bought the house with my brother but he alone cannot afford the mortgage on his salary if I lose this job. On this grounds, could I expedite my wife’s case? If I leave to support her, I will lose my job and fear losing my house. This has caused me terrible anxiety and I am medication to deal with the stress.

not sure about the criteria for expedite. 

I think India allows DCF. You can move to India for few months. 
You can rent your house while you are gone. That should cover rent. 
Your wife can live with your parents or her parents while her visa get processed (If you are filing CR1 or IR1).

Unfortunately her parents are supporting her younger brother in Canada and they’re working to support his college education. If one of them leaves, they will not be able to support the college fees on one income alone

You mean to say you have no family from her side or your side in India. 
Even if you get expedite approved, i don't think it will be any quicker than 9-10 months. Consider COVID delay in processing time

Unfortunately your situation does not qualify for an expedite. Expedites usually are granted when there is a health emergency threatening the USC, which does not seem to be your situation based on your narrative. You can try to request an expedite, but I wouldn’t count on it working.

I would not leave your job, that’s not smart to do in the middle of this process. I understand COVID is a fear, but is there a possibility your wife could get a Roomate while she waits on the process?

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

When is the last time you visited your wife? 5 years ago or have you been married for 5 years? Will your boss give you leave for a short visit ( 2 weeks or so?) 

I would send in proof of citizenship to NVC so they can move your case from F2 to IR1/CR1.

People DQed in 2021 have been interviewed so you might not need to request expedite. There is a good chance your case will move to the embassy once you alert them of your newly acquired citizenship.

f You Were an LPR and Are Now a U.S. Citizen: Upgrading a Petition

 

If you filed a petition for your spouse when you were a lawful permanent resident (LPR), and you are now a U.S. citizen, you must upgrade the petition from family second preference (F2) to immediate relative (IR). You can do this by sending proof of your U.S. citizenship to the National Visa Center (NVC). You should send:

  • A copy of the biodata page of your U.S. passport; or
  • A copy of your certificate of naturalization

First things first.  Have you notified USCIS that you are now a U.S. Citizen?

 

Note, U.S. Citizen petitioners  have priority over non U.S. Citizens.    Why you ask.  Because WE can VOTE.  And we can also contact our Congress Rep.

 

So, with that said, notify USCIS that you are a U.S. Citizen.  Then ask for an expedite.  Then if they drag your case on, Contact your Representative in Congress.

 

And if that fails, then contact a lawyer to file a Law Suit against USCIS.  Usually if it get this far, USCIS will approve the I-130 and ask the law suite to be dismissed because there is no more controversy.

You can try to expedite - as always - but your case is extremely weak since this situation already lasts 5 years.

Seems like USCIS is no longer involved -- OP said he was documentary qualified in January 2020, meaning his case is with NVC.  If they are notified of the new US citizenship, like you and others have advised, the case should likely move to the Embassy for interview fairly soon.

Have you notified NVC that you are now a US citizen?  If not, you need to do that immediately in order to upgrade the case to an IR-1.  Failure to update the visa category could be seen as misrepresentation, according to some attorneys.  

 

Personally, the last thing I would do is to leave my job at this point.   I think there are some parts of this story missing.  Good luck.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The primary reason of expedite here seems to be "my wife can't wait anymore" which NVC or embassy doesn't care as waiting is the game in immigration.

 

Any financial hardship by voluntarily leaving the job has nothing to do with immigration/embassy/NVC
 

Not sure how often you've been visiting your spouse, people usually travel to their loved ones time to time may be for 1-2 weeks if their job doesn't allow long vacations.
