So if I’m reading this right there is no ban on Non-Immigrant Visas. That would include a K visa. More specifically a K1 visa. So the Fiancée comes on a Non Immigrant VISA. Then gets married to the US citizen. Then they would be exempt from the Green Card Ban

K1s, L1s, O1s, HBs

It does not appear anyone in the US is impacted, i.e. AOS.

I know lots of people have been asking the same thing over and over again, simply trying to understand. If someone is the fiancé (K-1 visa) of an active duty member, it doesn’t apply to them?
It’s just confusing honestly.

It says that K1s are exempt from it anyway

This is totally speculatory of me, but they might wait to pass something related to work visas closer to the election. For 2 reasons:

1. Use the momentum and the impact of this action to drive more votes (too early and the votes could fade away)

2. Mitigate the risk of this action backfiring before the election

So, brace yourself. I think this journey has just begun. There will be a lot going on in the next couple of months.

Mod announcement:

All,

I have created an official EO thread that has the link and wording of the EO. You can ask questions about who is impacted in that thread. Please follow the guidelines of posting in that thread as moderator monitoring will continue.

As of today. If he was serious about going after it from an employment perspective, he might do something on the NIV work visas as well

People who left the country to wait for their employment based visa are the ones targeted by this. Also those who will soon have to leave so they can re-enter for an employment based visa are affected.

Nothing in the wording suggests that there would be any change in processing or issuing currently in process i485, i765 or i131APs under an EB based category, right?  Does the issuance of the green card count as exempt because an AOS is in country?

Correct. AOS is not impacted.

As usual, the devil is in the details. A full ban is really a ban on a segment of the cases it implies.

So once again my case is too complicated. Nobody really knows if this applies to my 6yo stepson, my wifes biological son but NOT my biological  son, whom I have not adopted.

This is very niche and has no reason to be affected by the EO.
