This doesn’t sound like an immigration questions it sounds like you are having second thoughts on getting married. Clearly you don’t want to get married - so don’t- she should return to her home country. The purpose of this visa was to get married within 90 days. If she wants to come back to the US she should apply for the appropriate visa to visit.

I agree, you can't control everything in life. There are no guarantees. Many times I think I should go ahead and marry and adjust status and let the chips fall where they may. At this point that is still what she wants. I am a terrible person but I do hate the fact that I've hurt her so badly. 

 

I have already given her money for a plane ticket plus 4 months of her previous wages. 

 

I don't need anyone's pity, but I do detest what I've done and myself.

90 days after entry on a K1, she is out of status/overstay/"illegal alien".

That photo is for adjustment of status, not the K1 visa. But in totality, yes, K1 to green card involves a lot of paperwork. And yes, this is not for the weak-stomached. If OP couldn't handle the responsibility and details of bringing an immigrant over, he should have either stayed single or found an American woman.

All good points. We have already had the break up talk 4 times. Each time, I feel so terrible that I walk it back. If I had stuck to the first breakup 2 months ago, maybe some healing would have already begun to take place. 

 

She has been getting out and doing some things. She even went out of town with some friends she met for a weekend. This is a rare opportunity for her to visit this part of the world. She is aware of that and trying to make something positive of the situation, which I support. 

 

Meanwhile, we are spending time together and trying to enjoy each other's company. Of course that is difficult too, because there is this cloud hanging over us.

Okay??? None of this speaks to how you plan on resolving this situation. Instead you're still hemming and hawing when your previous hem-and-haw tactic has already caused a lot of emotional damage.

Stop playing with the lady's head by continuously walking it back---no wonder you are both confused over what the actual situation is.

Healing for her won't begin until she's actually away from you---bring infront of you every day prolongs the pain for her, and for you.

 

So when is she planning on departing the USA?  (this question went unanswered before)

Surely she knows she only has 1 month or so left before she is out of status and begins to accumulate illegal overstay.

Since this (very sad) thread is still open, I'll ad a question that came to mind as I read through it.  Would not OP's actions in this case rise to the level of visa fraud on his part?  He filed for a K-1 with a letter of intent to marry his fiancee, and followed through with the process, even sending tax information to her for the interview in Kiev to show that he would support her financially.  The 129F has a place for him to sign stating that it is true.  Can he now disregard all of that and just let this lady become illegal after 90 days in the US?  Or would her becoming illegally here in the US be on her, not on him?  If someone who knew his name called USCIS to report visa fraud and explained the situation, would they do anything?  Essentially he is causing her to become illegal soon, and that sounds a lot like visa fraud to me.  After the 90 days, with no marriage or AOS, is he breaking any immigration laws by continuing to use her, letting an illegal alien live with him, preying on her "hopes" that it might work out over time?  The evidence on his VJ posts would be enough to show his true intentions are not good.  Isn't he basically using the K-1 to bring girls to the US under false pretenses (to get to know them better?  companionship?  to hold hostage in a sense by leading them on and on and on...)?
