  1. I am currently filling up the I-130a form . I am a student , and have been doing my bachelor's degree and now my Master's. I don't have an employment history yet other than one internship I did . Should I put that I am a student in the employment area? This is what they said to do " Provide your employment history for the last five years, whether inside or outside the United States. Provide your current employment first. If you are currently unemployed, type or print "Unemployed" in Item Number 1. below. If you need extra space to complete this section, use the space provided in Part 7. Additional Information." It doesn't mention studies anywhere in there. I would really appreciate your help with this . Thank you so much

My wife has her interview scheduled for September 13, which means her 6 month window to enter the USA will expire a few days before our 2nd anniversary, assuming that 6 month window starts from the interview date. Does anyone know if that’s the case or is there a delay in processing a passport as it typically takes awhile to receive it back after the interview from what I’ve read? It is possible to reschedule the interview with cause, but does anybody know how feasible that option is?

Context: My husband and stepkids are currently scheduled for their interviews at CDJ in Mexico on September 26, and our plan is to have them cross as soon as they get their visas (hopefully a week or two after - early-ish October). Our second wedding anniversary is March 11. We are (like many of us here on VJ) dying to finally live together; plus, getting my stepdaughters enrolled in school and having my husband get a U.S. job sooner rather than later is a major advantage. Could you expand a little on why ROC should be avoided if possible? I've read through this thread and others that it is expensive ($595 x 4 for us - goodie!) and is extremely delayed. I guess my initial reaction is - well, sure, it may be a lot more waiting, but at least we'd be waiting together, living together. It's been hell doing all of this paperwork and paying all of this money, plus the waiting and waiting and waiting, all while living apart. Is the ROC process particularly nerve-wracking? Is there a chance of losing status? Are the chances of getting denied high? All that to say, this thread has me rethinking our plan a little bit. To wait until March would break my heart and crush me, but I'm curious of ROC is bad enough that it would be worth it to wait.
  4. Hello all, My spouse received her immigrant visa approval on July 31, 2023 under the CR1 category and we have planned her arrival to the US by September 2023. The consular officer gave my spouse a note about the removal of CR1 status, which had the following text - "If at the time of admission to the United States you will not have celebrated the second anniversary of your marriage, you will be granted conditional permanent residence by an officer of USCIS at the time of your admission to the U.S." Based on this can someone please elaborate, if the immigration officers at the port of entry will no longer consider this to be applicable if my spouse traveled to the US after October 2 (our second marriage anniversary date) and that we would not need to file I-751 for removal of CR status? TIA.
  5. Related question, if the immigrant enter the US before the 2 year mark and receives a 2 year GC, what is the process for switching to a 10 year GC once you pass the anniversary?

So it has been 7 months since my husband interview and it is suppose to be sent back for revocation i emailed the consulate to see if I could try and see if they still had my case at the embassy and try and get the Diplomatic pouch number and I noticed the date updated on ceac so does this means it is still at the embassy I assume ? I sent a inquiry to uscis they got a few more days to respond to my request. Just wondering lately have anyone who had a case returned get a notification on ceac or just logged onto uscis and saw the update for a noir or reaffirmation

  8. Hi everyone. My husband's CR1 recently got approved. Our second year of marriage will complete next month on the 9th of August. I was wondering that should he delay him coming to the US after the USA after 9th of August so that he gets 10 year greencard rather than 2 and we wont have to go through the hassle of removing conditions for him. One more thing is he travels after the 9th of August and at the port of entry should we tell the immigration officer to stamp him 10 year greencard rather than 2 or they will do it themselves? and Should he carry the original marriage certificate with him?
  9. So I got an email late last night from NVC saying I had insufficient income even though I provided proof that my annual income is just shy of 40,000 a year. I work for the local county in a government job. With either net or gross I make in excess of the requirements for a household of 2. The only thing I can think of that hurt my affidavit of support was that during part of Covid I was unemployed after undergoing a major surgery and needing recovery time, which also didn’t matter since very few places were hiring during Covid. Anyways, I now need a co-sponsor and the only one I can ask is either my mom or dad. I don’t think I can use my mom because she’s medically retired and only received about 29000 on her retirement last year. She does own a house but I don’t know how assets are counted and what is enough to qualify. My dad (they’re divorced btw, sorry I didn’t mention sooner), recently retired so I don’t know what his annual is yet with his social security and pension but while he was working his annual was about 80k a year. please , any advice would be helpful or any info about cosponsors and how their income and assets are used. Are they counted along with my own income? Also which parent would be the better choice? Mom is remarried and husband has no income, and dad is single but doesn’t own a house.
  10. Not sure if this is the right forum for this question. Asking for my friend, he is within the 90 day window to apply to get the conditions removed from his green card. He came here on a spouse visa and got a conditional green card. They are in the process of getting a divorce, but the divorce papers won’t be finalized by the time he needs to submit his papers to uscis. Does he have to apply jointly with his wife? Or can he still file separately even though he doesn’t have divorce proof yet?
  11. Hello, My wife got an RFE on her CR-1, which I guess isn't all that uncommon. However, what seems odd is that there is no mention of anything missing, only the whole list of suggested items to show we share a married life together, exactly the same as for the I-751. We were very meticulous and included all of that and more in our original packet, submitted Sept. 2021. For this next round we wouldn't really be able to provide anything additional, except for: birth certificate for our baby born last fall, and then more recent copies of the same stuff again (tax returns, insurance policies, etc). If I didn't know any better I would think they just lost our first packet or never looked at it. I found it odd also that a couple months ago her temporary green card was extended another 2 years to fall 2025. Could it be that they are just so far behind that they are not even reviewing packets and asking for evidence all over again? Has anyone else experienced this? Thanks and best regards, Burt
  12. Hello, I'm going to get married in Brazil and my spouse will apply for the CR1 visa immediately. I was wondering if my spouse changes her name to my last name at the date of marriage, will it complicate the process for the CR1 visa? All of her Brazilian documentation, including passport is in her maiden name. It would take time and money to change all the documentation. Also, would I put down her maiden or married name on the CR1 application? Would it be better for her not to change her name and change it later in the United States after the process is over? Would it be a red flag to not change her name? Thanks.
  13. Hello, We are pretty sure my husband's visa will be issued soon as the embassy has requested we send them his passport. My question is, our 2 year wedding anniversary is September 10th. Should we wait and have him enter the United States after September 10th? Would it then change to an IR1 visa at the time of entry? Or is it based off when the visa is issued? Thank you!
  14. Hello members! My question is simple, say you get your visa sorted out and in hand before the 2-year wedding anniversary mark and you decide to wait until after the anniversary to enter the US. Does that make you illegible for the 10-year green card? Or will you still be given the 2-year conditional green card? Meaning, does the counting start when you get your visa in hand or when you enter American soil? I'd like to thank everyone for taking the time to check this post.
  15. Re: CR1 Visa Can the Petitioner of the I-130 submit other forms concurrently? Such as I-864? If so, can someone beak down what forms can be added besides the I-130A? Also, do I have to date the I-130A or leave the date blank along with blank signature? Thanks!
  16. Hi, My husband is still in Afghanistan and we keep trying to get a visa for him to go to Doha so he can do his interview but we have no luck with how to get one. I tried online but too many options so I’m not sure which one is legitimate and when he goes to a visa place in Kabul they just show for Islamabad or Brazil. I know on deptartment of state site it says they may provide departure assistance for family reunification for US citizen family members (parents, spouse). I guess my questions are: 1. has anyone received departure assistance to a third country due to the embassy in their country being closed? 2. What does that departure assistance include? visa to third country? Flight to a third country? 3. If they do provide assistance can you choose what third country it is or do they choose for you? any insight would be much appreciated and apologies in advance as I was unsure what to list the topic under.
  17. Hi, I am Canadian and my Fiance is a US citizen. We are in a long distance relationship but only 4 hr drive away from the border and we see each other once a month for few days regularly. We want to get married soon and planning to go with the CR1 process rather than the K1 but I was wondering if I can just cross the border with my Canadian passport to get married in the US then come back to Canada and start processing the CR1? Or would it be easier if my American Fiance will just come in Canada and get married here instead?

  19. Hi Folks, I am a USC and have lived in the US continuously for over 20 years. I applied for a CR1 visa for my wife (Canadian citizen) last year. Our I130 was approved and we also cleared the NVC step. Our interview date is in July. My wife gave birth to our first child just last week in Canada (after we received the interview confirmation). Based on the Consular Report of Birth Abroad (CRBA) rules, our child qualifies for US citizenship. However, we are not sure how to proceed. Should I fill out the CRBA forms and get a separate appointment for child's passport? Or should we just take the forms to my wife's interview for CR1 visa since it is only a month from now? We would like to have my wife and my child move together to the US. Any insights on this is appreciated.
  20. My CR1 interview at the Brussels embassy is on July 7. I have been receiving public benefits for a few years from the Belgian government due to chronic fatigue and fibromyalgia. I have been working towards regaining a more independent status, and new medication recently has been helping me along. For example, I now have my own business as a part-time editor, which I'm hoping to expand, but my main income currently is still the government benefits. Is my case at risk of being refused under the pretext of 'becoming a public charge' (not my intention!). If so, is there anything I can/should do to prepare a rebuttal during the interview?
  21. Hello folks, This has probably been asked a lot of times so if I am posting in a wrong place, please do let me know! My husband just got DQ'ed last May 26th and we are quite confused on a few things. I know IL will take some time especially since January DQs haven't even gotten theirs, but if someone can answer, that would be very appreciated! 1. For interview, I've seen people say embassy will provide the date, and some booked their own appointments. Which one is it? Also if it's the latter, how do you know if you are allowed to book one already? 2. To book the appointment, am I allowed to create an account on the US traveldocs even if my case is still at NVC (as per CEAC)? 3. Are tax return transcripts enough proof of requirements that my husband can bring to his interview? 4. Upon arriving in the US, will he automatically get SSN or do we have to apply for it? 5. does anybody know any Group chat we can possibly join to get updates for manila embassy interviews?   22. Hello all! Hope this finds you all well! I've been having a recurring worry, was hoping I could put it to rest with your guys' help. I'll try to be concise. I'm a US citizen. Went to Pakistan to study 10 years ago. Got married (to ex wife) 8 years ago who came from Canada, but marriage was in Pakistan. Finished university in 2019 and moved back to Nevada 2019. Ex wife and I got a divorce in early 2021 in Nevada (she mailed her paperwork from Canada, everything was uploaded to the Court website as the court was closed due to COVID). Originally I had filed a petition for the ex wife but rescinded it because of the divorce, so she never interviewed. I then got married to my (current) wife Q3 of 2021 in Pakistan. My question is this: since my first marriage was in Pakistan, then my divorce was in US (because I moved back to the states in 2019), then my next marriage was in Pakistan in 2021, will that be an issue? I did do some research on this issue a few years back and came across reciprocation, in that a US divorce is (apparently) valid in Pakistan. But now I'm just wanting to double check that. Any insight would be greatly appreciated please
  23. Looking for comments. So my spouse interview at the Jakarta Embassy was scheduled by National Visa Center for July 18th, 2023. Yesterday, my spouse attended the medical exam and because of prior TB infection they always make him do a sputum test which takes three months in Indonesia for the results. Rather than canceling the interview and then reschedule, I am leaning towards having him go to the interview and just have the embassy hold the decision until the Medical results are delivered and then if all is well they can send him the passport to the pick up location after. Thoughts? Thanks
  24. Hello everyone, Quick question to all of you folks that are more experienced on the CR1 side of things. My other half is Russian, she lives there. I cannot just simply go there due to the current world situation, so we just meet in 3rd countries. Our next trip will probably be in Dubai or Turkey due to the relatively ease of travel for her to be able to go there. Now we are also in the process of deciding if go with K1 or CR1, for CR1 my question now is, I read somewhere that the interview is had where you get married. Example, if we go to Turkey and get married there, then our Visa interview WILL be in Turkey? Am I correct in this? I cannot marry her on Moscow for obvious reasons that is somewhat dangerous for me to go. Another thing would be to do a Utah Zoom Marriage, which apparently it is fully recognized by USCIS and there are no issues with it whatsoever according to some posts here. Is that correct? In the case that we marry using the Utah Zoom Marriage, where do we have our Interview? (Assigned consulate for Russia is Warsaw, Poland. Problem is that Russians cannot enter there unless they get REALLY creative, so most people doing K1 for example are having the case transferred to Turkey, or Kazakhstan.) As a side question, any idea if AFTER applying to CR1, will it be ok for her to apply for B2 so we can at least meet here whenever we want while she waits for the I-130 to process?   25. Please house, am from Nigeria and my husband is an American. We want to file for form i-130 and form i-130a online, but we don't know if it's best to do it ourselves or is it better to employ the services of an attorney? I would really appreciate if I get feedbacks. Thank you.
