Sounds difficult but not impossible.  There are schools in Pakistan too.  The biggest challenge might be getting permission of the father of her children from the previous marriage to leave the USA and immigrate to Pakistan.  If you continue down the CR-1 path, buckle up for a long and bumpy road.  If your relationship is real, if you truly love each other, you'll find a way to be together, somehow, somewhere, even if it takes years.  Good luck!

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

As long as you married  after her divorce was final. And you meet the waiting period if any for your state to remarry. Like Texas it's 30 days, California is 6 months and Nebraska 1 year to name a few.

I live in Texas and Got divorced and got married to my current husband in 25 days. My ex signed a waiver so we didn't have to wait 30 days.

And like you my marriage was over 2 years prior due to my husband marrying someone else. So mine was pretty cut and dry. However at interview it was many questions to my husband about my ex.

Why would it be a red flag if he gained his citizenship legally? I believe there is only one class of US citizenship.

Why would it be a red flag if he gained his citizenship legally? I believe there is only one class of US citizenship. 

While there is only one class of US citizenship, it matters if a person gain US citizenship through marriage to a US citizen.  The obvious question is did the person used the US citizen to immigrate and gain citizenship through fraud so the person could divorce and go home to marry their real love.  If it happens in a short time, then it's a red flag.

As a consulate officer told a beneficiary who was interviewing for visa, the officer said a child only means the female had sex.   (Paris France)    A child don't prove a true relationship in the eyes of USCIS.

July 11th 2019   Green Card in Hand
