AOS Pending...wanting Divorce.

Document everything, record all conversations on your phone. Keep a camera close by in case she does anything un-toward. Cancel her AOS, get her as far away as possible. If you're able, try getting a restraining order if she pursues VAWA. The courts are already biased enough against men, so cover EVERYTHING. Don't be alone with her as often as you can. It's your place of abode, so she has to leave.

She can not AOS without you and VAWA won't be a success significance on her part of you abusing her. But good luck boss man.

Friends of mine offered here a place to stay.  She just left the residence took most of her stuff with her and ID cards and passport. I am shattered.

Sorry for the situation. Would just like to emphasize getting that I-864 revoked, ASAP. If by some chance it were "accepted" by the government  (maybe by VAWA and/or her actually getting accepted and approved for AOS somehow), you are then obligated to repay anything she might incur as a public charge, REGARDLESS of whether the marriage ends in divorce or not. And that stands until she naturalizes (if she ever decided to) among other things. It's a heck of an open-ended document with risk in this circumstance.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You may be trying to help her to stay in the country despite her wanting a divorce, it's your choice, your decision, but remember you will be accountable for her I-864 until she becomes a citizen which is for the next 5 years+. Also she thinking about VAWA means she will go any length to put you in trouble, I don't think you will be proud of having a dirty criminal background. If she wants a divorce let her get it and go back because she is here because she married you.

She wants to divorce right after getting married in the US on a fiance visa....mere 3mths after the wedding took place? Doesn't that seem fishy to you?

In any event, sounds like she just wanted to place feet on US soil and used you to do so....this can be deemed as immigration fraud on her part.

 

Retract any docs you have sent forth (if it can be retracted) and let her handle things on her own (selfish, I know) but you spent time and money to have her now come and say that you are toxic? I don't know your personality but she should have seen the "toxicity" before committing to marriage.
