  1. Re: CR1 Visa Can the Petitioner of the I-130 submit other forms concurrently? Such as I-864? If so, can someone beak down what forms can be added besides the I-130A? Also, do I have to date the I-130A or leave the date blank along with blank signature? Thanks!

  3. So my brother's son was born in the US but left at a really early age. Now my brother wants to come here with him now that he is over 21 and we both thought that he could petition for him while his son, the US citizen was abroad. On the I-130 it asked for an address in the US, which I believe should have been his current address but we entered mine (US based) since we thought it was something that was needed for communications to be sent. Now the case has been sent to the NVC (approved) but thankfully we caught it early. Is he out of luck? Does he son needs to enter the US first and start all over?
  4. Hello folks, This has probably been asked a lot of times so if I am posting in a wrong place, please do let me know! My husband just got DQ'ed last May 26th and we are quite confused on a few things. I know IL will take some time especially since January DQs haven't even gotten theirs, but if someone can answer, that would be very appreciated! 1. For interview, I've seen people say embassy will provide the date, and some booked their own appointments. Which one is it? Also if it's the latter, how do you know if you are allowed to book one already? 2. To book the appointment, am I allowed to create an account on the US traveldocs even if my case is still at NVC (as per CEAC)? 3. Are tax return transcripts enough proof of requirements that my husband can bring to his interview? 4. Upon arriving in the US, will he automatically get SSN or do we have to apply for it? 5. does anybody know any Group chat we can possibly join to get updates for manila embassy interviews?   5. I am a U.S. citizen and looking into helping my parents migrate to the US. Long story short, my parents do not live in the States; however, they have a 10-year ban on entry into the US. They left in 2013, making it exactly ten years this year (They left the US voluntarily). For me to petition them and give them a Green Card, can I apply for an I-130, or do I need to do something else before?
  6. Hello everyone! My wife already got approved I-130 and I-485 and green card made and on its way here, she received social security card today! And because she got the green card first, she won't need to rely the I-131 or EAD. I hope everyone's cases get approved soon!
  7. I apologize for the length. I am currently petitioning/filing form i-130 for my spouse living Egypt. Background: My spouse lives in Egypt and I live in the US I was born in Egypt and immigrated to the US when I was 4. My entire family is Egyptian. Me and my husband met in 2019. We are both 28 years old. I have traveled to Egypt 4 times since meeting my husband. On my last visit, I was there for a month and we had a civil marriage on 1/15/2023. I traveled back to the US January 20, 2023 because of my job. I have 3 more visits planned. 1 of those visits is for our Wedding ceremony in 2024. We got legally married earlier this year because of religion/Egypt laws regarding cohabitation of opposite sexes and because my husband has not fulfilled his military conscription which prevents him to travel until he turns 30. Egypt law states that men aged between 18 and 30 are required to undertake military service in the armed forces and they can not travel abroad without travel permit from the ministry of defense. Males cannot be enlisted when they turn 30 because they are considered unfit for the service and can receive exemption by paying a penalty when they turn 30. Getting married would now allow us to stay together when I visit and be able to start the paperwork for his Green Card and hopefully have it approved by the time he turns 30/is finally able to get his exemption to travel. (My husband turns 30 in July 2024 and plans to pay the penalty to the ministry of defense then Concern/Question: As of now we have only been married for 5 months and have not lived together. Because of this my concern is USCIS questioning why we got married instead of going the fiance visa route or waiting until I am able actually take time off from work to get married and live with him (which would be in 2024). Should i include the reasoning/explanation in the evidence for when I go to submit the i-130 Petition or just submit the evidence I listed below without the explanation? The evidence I currently have and will provide: Stamps on my passport of my visits to Egypt Hotel Iten of my stays when I visited -my name only. He was not able to stay with me until after our Civil marriage. I was only in Egypt for 5 days after so it's not much time spent after the marriage. Flight purchases to egypt for my 4 visits Prior to Civil Marriage: Photos of us together and friends/fam. during my visits to Egypt Photos of when My husband proposed to me/ The Proposal Photos of us with family at our Engagement party. After Civil Marriage: Proof he is my primary beneficiary on for my Life insurance/retirement Chat/call logs of our calls after our marriage (we communicate regularly) Additional: Gift receipts from 2019 to current A quick timeline of our relationship and the explanation above regarding why we chose marriage.   8. Hi, group. I hope everyone is doing fine today. 18 years ago my dad (LPR back then) applied for my mom (beneficiary) and me (me as a derivative) with the form I-130 in 2003. USCIS sent us a notice of approval in 2005, but after that, my dad didn't follow up with NVC. I asked NVC for my case number and they replied. I checked the status and it says "At NVC". NVC sent a notice of 1 year in 2011 but still my dad didn't follow up for reasons beyond his control. Is it possible to continue with this case after 18 years? maybe with a lawyer? Or do I need to start over with USCIS and a new I-130? I am 27 years old (not married) and my dad is a USA citizen now (naturalized). USCIS still shows as "My case was approved" NVC shows: At NVC. I hope someone can help. Thanks in advance!

Long story short – when I went to go file my taxes last month on TurboTax.com, hit a snag when filing ‘married separated’ due to my wife, who is awaiting a decision on our CR1 visa petition for her, obviously not having a SSN or ITIN. Talking it over with a CPA, I was advise I’d do better filing ‘married jointing’ as I’d qualify for a tax credit. I was recommended to just file for an extension and fill out a W-7 form to acquire an ITIN for my wife. Cut to a week later, I discover you CANNOT in fact qualify for a tax credit when filing ‘married jointly’ if also filing for a ITIN. *eye roll* So, now I just want to file my taxes and be done with it as I am now late and I owe by filing ‘married separately', so every day in theory I am accruing interest. My only option now is either file by mail, which I’ve never done, or just “fudge it” and file ‘single’ so I can be done with it and file and pay online right now. Thoughts? Recommendations? Would it look bad come CR1 visa tax review if they see that I filed ‘single’ when I was obviously married all year (she absolutely never lived here at all during 2022, only visited for 50 days). I mean in the end, I’m doing so to pay the damn government money… Does it really even matter the status, given the roadblock presently in place? Anyone have experience going through this? Any feedback would be greatly appreciated… Okay, I guess I lied; wasn’t quite so short – sorry.
  10. Hi, I have made I-130 applications for my husband and children, all still pending. I had to get permission from the family court in the UK to remove my eldest daughter from the jurisdiction. We were granted permission, based on our proposed plan, including timeframe. The applications are taking longer than anticipated to process and I am now concerned that we will not be able to meet our proposed timeframe. One possible outcome if this were to happen is that the child’s father takes us back to court to revoke the original order. Would needing to meet a court order’s timeframe be sufficient grounds for requesting and expedition of all of the I-130 applications? Thank for the help.
  11. I (US citizen) have filed I-130 for my huband and kids (Canadian Citizens) to move to the US. All of us currently live in Canada. While the I-130 is in process, can my husband apply for a work visa through TN visa or should I file I-765 Employment Authorization Document (EAD)?
  12. My daughter was born oversea in 2018 while I was a green card holder. A year later I become US Citizen in 2019. I filed I-130 petition for my daughter in 2019, got approved in 2020, and got notification from the NVC. I logged in the NVC, submitted the fee, got the invoice number. Due to COVID, it wasn't in the best interest of my child to be located to the US during that time, so I took no action. NVC in 2022 notified me that unless I start taking action, they will close my case. I responded to the NVC in 2022 to let them know that now that COVID is over, I would like to move forward with the visa processing. NVC emailed me back saying the case is under review, and will let me know when its done, aka. asking me to wait until further notice. Now, 2023, the NVC mailed me a letter saying since I did nothing from their 1st letter, the case will now be close. My question is, 1. Why does the NVC suck so bad? Is there a way to file a complaint against them? There's no way to contact them beside public email inquiry. They took 2 months to response. And their response is confusing, on top of that, no way to contacting them for clarification. 2. Now that I'm a citizen, can I just go to the US Consulate at my home country where my child is currently reside to do CRBA instead of redoing the I-130? Thank you.
  13. My wife and I are currently waiting for an I-130 application to be approved. I am a US citizen and she currently resides in the Philippines. She is contemplating applying for a workers visa in the Philippines as she has worked there in the past. Will applying for another workers visa and working in another country have any negative impact on our current application with USCIS? What challenges will we encounter if/when it is approved and she is currently in Japan?
  14. In 2021 my wife and I rented a house in her home country (Colombia), where I would say we "lived" together for 4 months. As an American, I was subject to a visa-free policy for up to 6 months. We had a notarized rental agreement which we both signed. When we rented the house it was my intention to apply for a residential visa to stay there with her for the next year or two. But our plans changed and we decided to travel abroad to third countries and see the world, which we are still doing. We have spent every day together for the past couple of years, but since we left Colombia I wouldn't really say we've been "living" together, simply traveling together for a very long time. I have read knowledgeable members of this forum state that to be considered to have "lived together" one must have a residential permit for the country in which one "lived". That makes sense. But it also seems counterintuitive to say that we did not live together despite having a joint rental contract and the intention to pursue a residential permit while not specifically being on a tourist visa, but rather inside of a visa-free period. It also seems downright misleading to list only my long-term home in the US on the list of places I've lived in the past five years while I had a rented house in Colombia where I spent every day with my wife. Please help me sort this out. I want to include the rental agreement as evidence of a bona fide relationship, but I want to be technically correct about how it is included and not contradict myself while listing our addresses. Some additional questions if you happen to know the answers: does the rental contract, which is in Spanish, need to be translated? And should any of the temporary rentals we've stayed in (some for nearly 3 months at a time) deserve to be included in the list of places we've "lived" despite having been there under visa-free regimes and with no intention of pursuing residency permits?   15. Hi All! My I-130 case was recently approved (Apr 22nd) and Case sent to NVC (Apr 27). I'm seeing what seems to be petitioners receiving the welcome letter, but when reading the i-797 Approval notice it states that the NVC will reach out to the beneficiary for further action. Can any one confirm if the welcome letter is sent to both the petitioner AND the beneficiary? (I've searched a million searches and can't seem to find a solid answer on this)
  16. Theoretically the goal is to get processing times back down to historical norms by September this year, with I-130s being back down to the far more reasonable level of 6 months. But honestly, how successful has it been? Processing times seem to keep going up, not down. Any thoughts on what their efforts are, and if anyone knows what they've tried that's worked and what hasn't?
  17. Okay, I (US citizen) am getting married to my girlfriend. Known each other for the past 5 years. 4 years cohabitation and slightly over 3 years of dating. I have already decided to include: 2 years of joint bank statements showing direct deposit of our salaries (~48 pages, two per month) Rental receipts of the past year (12 pages) Affidavits from my parents, my cousin (her best friend), her brother, and our friends (5 pages) I need advice on whether to include any of the following, listed in descending order based on an educated guess of what I think is important: Joint lease agreement (~10 pages + addendums) More rental receipts stretching back farther (~48 pages) My credit card statements with her as an authorized user (~2 years worth) (~48 pages) Her name on my notarized Advanced Directive, signed ~1 year ago (~7 pages) Proof my dad took out a loan and paid her university tuition when her parents cut her off for dating me (~2 pages) Pics (too many to count) 4 sets of hotel, travel records when we went on vacation together (~8-10 pages) Train reservations of routine visits to my parents (~20 pages) Receipts of our birthday gifts to each other (~10 pages) Finally, if one has anything to say regarding potential red flags, I'd appreciate it. My potential worries include: my history with her parents. I still have not met her parents because they remain opposed to our relationship she is Indian, which is probably amongst the most nationality by USCIS she is a semi-observant Muslim, another category of people who are not exactly favorably looked on by certain people the fact she is a Muslim also relates to the fact that for sometime, time her parents paid her rent, she hid from her parents the fact she was living with people of the opposite gender Her being a Muslim also plays into how we first started dating: one night we were watching a movie (I know... so cliche) and decided to uhm… do some stuff and we continue to do stuff obviously, so definitely not halal If we get a RFE, which I fear is a possibility, we have tons of more evidence we can present. But I'd like to not have that happen. Thank you for your time in reading this lengthy post. Tl;dr worried about our unconventional relationship but have evidence in the form joint bank statements, rental receipts, affidavits, and more to show the relationship is genuine. Is it enough?
  18. Hello all, I was wondering if anyone could help us understand what the next steps are after filing the petition through the consular? The I-130 was approved on the spot after the interview and I was told to wait 12 weeks. We just don’t know what to do next. What paper work should we be getting together? Is my husband able to do the medical exam now or do we have to wait until we are contacted? Also, can he start getting his police report now as well?
  19. Hi, I filed a I-130 petition for both of my parents. Beneficiaries/parents arrived in the United States last week of March 2023. How long after arrival will the green card arrive? Will there be any fees that I will need to pay for their green card? They both have a "UPON ENDORSEMENT SERVES AS TEMPORARY I-551 EVIDENCING PERMANENT RESIDENCE FOR 1 YEAR" on their passport. I also applied and paid the Immigrant Visa and Alien Registration Application (DS-260) and Affidavit of Support fees a couple of years ago. Thanks in advance to anyone who can help.

  21. I received an RFE yesterday stating that my marriage certificate didn’t meet country requirements. However the original marriage certificate has everything they’re asking about. It was prepared by the adoul, it has all the required signatures and judges stamp and signature. I also have the English translation! They said it needed to be an Aakd Zawaj?? I’m feeling so stressed can someone help me?
  22. Hi all, apologies if this question has been asked previously - I couldn't seem to find any information on it. My fiancé and I are planning on getting married in June. She is a US citizen and I am a UK citizen. I will be on an ESTA. I was just wondering if there are any rules/recommendations about getting married and then me staying with her for a couple of months. I am not planning to stay permanently, but I have an opportunity to stay for a couple of months. So my question is can we file the petition whilst I am there and can I then stay there for a couple months after filing? Or will I have to be in the UK to file the petition? Thanks!!
  23. My sister-in-law obtained her US passport through the U.S. embassy back home. The embassy did not give her a CRBA because she was over the age. She was able to get her US passport since her dad served in the Army. Now, she wants to petition for her husband. How can she obtain proof of her citizenship, besides her passport? I’d appreciate all your input!
  24. Hi! I am writing this with a lot of anxiety and stress as my husband and I we are in NVC stage and I as the beneficiary I have a criminal record of minor theft, this was 7 years ago. I was a first offender and had clean record. This is the only offense committed and I had done restitution during my court hearing & attended all my hearings until the verdict was announced. I have not committed any other crime ever since then and have been clean. I was given a 5 years probation in 2017 and it has completed. I will be going to get my police clearance done soon, i am not sure if it’ll show on the clearance or not but I choose not to lie. What I would like to know is that if this will affect our NVC stage from being DQ’d or approved. Your advice and feedback will truly calm my nerves down. Thank you in advance.
  25. We've applied for the I-130 on August 1st 2022. I just found out that our service center is not what was on the confirmation paper that they sent out but is actually the Vermont Service Center. We were basing our timelines on the Nebraska Service Center and now have had to change gears to the Vermont timelines. I graduate college in Spring of 2024 and would really like my husband to be there to see me walk and be able to spend some time with my family in the U.S. celebrating my achievement. Based on the timelines here and from what I've seen on Reddit, we probably won't have his visa ready to go by the time I graduate, or it will be very close. So now my question, is it possible to apply for a tourist visa for him to come to the U.S. for a couple of months WHILE the I-130 is processing? Would he even be approved at the time of the B2 visa interview? Would the embassy officials think it's suspicious and that he's going to overstay the B2 visa? Has anyone else applied for a tourist visa and gone to visit while the I-130 was processing?
