The provision of having the vaccine waiver option is to get approved for the given legit reasons. Not sure what's the big deal about it. Be happy.

2015-08-17: I-130 approved

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Nobody here said they never get approved. The point was that you have to prove your claims to USCIS and that’s not always easy. That’s why you had to hire a lawyer. The reason people don’t report here is probably because they don’t have extra $1400 laying around to pay for that and thus, don’t make a good case without a lawyer and it gets denied.

I hear this all the time. People will claim they dont have money for emergencies, yet they have a brand new $1,000 iphone 13 or Android, ipad, iwatch and air pods.... On top of that, they drive brand new cars...

 

I have plenty of friends who are all materialistic, yet they all complain when they cant make rent... I tell them to stop buying stuff you dont need, like the things i mentioned above, but they all give me the deer in the headlights look...

 

some people know how to set priorities, and others dont...

Perhaps they do not want to spend an extra year apart?

 

Anyway when they do not come back we are guessing what happened.

My wife came here on a k1 visa. Vaccines arent required for K1. They are only required during AOS.

 

Thats why we went the K1 route and not CR1. We spent the time in the US together while her AOS and vaccine waiver got approved.

The K1 is obviously not a common choice and its many issues have only got worse over the last 11 years.

 

I can think of a few unusual situations where a K1 could be the better bet, first time I have ever come across this. Generally I would avoid the US Civil Surgeon need due to extra cost and hassle but I can see the reason here.

The K-1 medical would still be properly completed so I-693 would not be needed; i.e. the "K Visa applicant electing not to be vaccinated at this examination" box on DS-3025. https://www.cdc.gov/immigrantrefugeehealth/panel-physicians/vaccinations.html "refugees and K visa applicants are not required to receive vaccines before traveling to the United States" Also see: "K or V Nonimmigrants Applying for Adjustment" https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-3

 

But instead of Civil Surgeon costs it would be the Form I-601 fee ($930).
