Question about my wife with her temporary green card

She is clearly telling me she wants to move out and/or divorce me once she obtains her permanent green card . What happens if I tell USCIS this is a troubled marriage and that she is making plans to leave the marriage once she obtains her permanent green card ? What’s the process if we fail the next interview for permanent green card status ? I’m not complaining at all - but she is telling me there is nothing I can do if she wants to stay in the US permanently without me . I’ve spent easily $30k  so far flying her here and daughter back and forth from Russia - and on her daughter who has chronic condition with her hospital bills. I make really good money-we live near the beach in Florida. I got her a job making more money than most Americans make at my company- yet she is completely unhappy with me and repeats constantly she wants to “live her own life “ without me involved at all .

She can remove conditions on her own with a divorce waiver, pretty common. Should not be an issue.

You guys can separate if it’s not working out, she can remove conditions without you and stay in the US.

Money doesn’t buy happiness  You could try to leave immigration out of the discussion when working on your marital problems. That ship has sailed, you are husband and wife now, not petitioner and beneficiary.

I was under the impression that temporary status means we have to be living together as a couple in order for her to be granted her permanent green card. Now I’m understanding she doesn’t need to stay together as a couple she can stay here on her own completely without me and the immigration interview doesn’t matter even if we are divorced . Hmmm

Correct. The immigrant is not a package that can be returned.

Nope. And you are on the hook for her and her daughter to make sure they don’t become a public charge. You are no longer responsible only when she becomes a citizen, works 40 quarters or dies. Based on what she said to you it sounds like she was using you but she got through the AOS (where you needed to be together) and you no longer have an influence on her immigration status. Sometime sim not surprised when I see this from certain countries. Best you can do is divorce and move on with your life. Hopefully you don’t live in a community property state.

If you feel she lied and used you for a GC, you can contact USCIS and report fraud if you have concrete proof of that and can show it to USCIS. If the marriage started out as a bona fide relationship and just went south over time, she will be able to apply for ROC with a divorce waiver. Either way it is up to USCIS to decide.

I would suggest you to revisit the thread you created around two years ago, when you shared you were facing same issues at her arrival. There were some honest opinions there that offered some good insight and advice relationship-wise.

 

Immigration-wise, I'd suggest exactly what @millefleur recommends: report fraud to USCIS IF you have evidence. 

As everyone else mentioned, she can apply for removal of conditions with a divorce waiver.

Unfortunately the moment she arrived to the US she no longer needed to remain married to stay in the US. Assuming she entered the marriage in good faith. Once divorced she could have filed for ROC even before the two years.   You now have a family law issue with an immigration twist.  You signed a contract with the US Government that said you would support her for not becoming a public charge. Potentially the rest of her life her.   

 

Get a lawyer and get it done.

All green cards are temporary.

 

She is a conditional resident. That conditions are not restricted to your ongoing marriage. It is based on entering the marriage in good faith.
