  1. once ESTA is revoked, it is gone for life. she wont get approval ever for ESTA again . the only way she can enter US is with an immigrant visa at this point ( considering she got twice entry denied)
  2. File divorce first asap if situation has changed in your life. you simply wont get your current i-751 approved. USCIS does not accept stay married but living apart. you are either married or not. You can file a new i-751 with divorce waiver( this will be a fresh application for i-751) . you also need divorce approval by court before getting this i-751 approval. so its going to take time.
  3. congrats on the case moving forward. hope you all get naturalized soon and you can back and share your experience and pay it forward to others looking for help.
  4. your emotions are completely valid . Some times it can take 30-60 days before checks are clearly. as long as the mail package says its delivered it is delivered to uscis. Do not worry. as long as your package has the minimum documents and the cheque clears.. you are safe. not to worry
  5. you only need a valid ticket , valid visa and valid passport to board. Whether you get one way ticker or two way ticket is not airlines concern Never heard of airlines demanding you have a two way ticket.

  7. 1) did your employer apply for h1b visa and you have i-797 approved ? than yes . you cannot reenter unless your new employer has petitioned for your h1b and its approved 2) Yes
  8. Your naturalization has not been approved. It does not matter what documents you used to file n-400 , they will verify your entire immigration history at N-400 interview. It does not matter what you applied the application with
  9. you cannot enter the US without visa stamping. That is the whole purpose of visa stamp. it is an entry ticket. Also if the child mother does not have custody, the child no longer has h4 status.
  10. they think 1) you are a potential immigrant to USA and will never leave US. if your entire family in US, there is a good chance you will never leave USA 2) they think you lied to them during visa application if the above 2 changes than you can try getting a waiver
  11. Correct. Age < 18 are considered as children and will be derivate of you when you submit their info with your n-400 application
  12. Give her the divorce. File i-751 with divorce waiver. As long as you entered marriage in good faith, you should have no issues On other hand dont mess with uscis , it will haunt decades later. Always stay honest with the intentions, you have nothing to be fearful
  13. if the consulate is not interview, i dont see a WOM value. if you file is being punted by NVC and consulate and delaying your case, i see value in filing WOM.
  14. what country ? you need to provide details why they are not interviewing.
  15. dont see any issues. You have a valid F1 visa and you are coming to do OPT Your best choice is come to US and get married and than figure out the wedding in Korea. That way everything is clear for records
  16. Quickest way to file a lawsuit in court . it is called writ of mandamus and should get you a decision within 30-60 days of filing . i have posted details about how to file .
  17. fly to Spain Get married in Spain and come back to usa File for CR1 visa. It will take 12-18 months She gets her CR1 visa . She lands in USA and becomes a green card holder/permanent resident on the day of arrival on US soil ESTA can be tried but as long as she tells the CBP / Border patrol the truth that she is entered the country to get married and adjust status .
  18. correct. OP has to maintain legal status until H1b kicks in and also has to get picked in H1b lottery . The only choice is enroll in college/university on F1 visa
