OK. Seems you are not fully caught up with the immigration process in total. Just because you have the K1 visa does not mean it is the end of your journey. In fact, you have a lot more to do. I advise you to sit down somewhere and take some time to read the guides on the forum that @geowrian posted. You have to still get married within the 90 days, do the AOS, get SS number and card, get EAD/AP, in 2 years you have to file ROC, and then after 3 years you can apply for citizenship.

 

You are about to make your first mistake by having a wedding before entering the US on a K1. You should read all the guidelines and rules of this long process. You not know about AOS and ROC could cause you to make other mistakes down the road.

 

It cost nothing to read and learn the process.

 

Hold off on the wedding in your home country for later. Trust us, it will be worth it.

As noted, assuming they won't find out or know is totally wrong way to think about this. Even say they didn't find out for 3-4 years until you applied for ROC or even citizenship, if they find out then they can strip you of everything because of that lie and fraudulent claim. Why risk it? Just get the K-1 visa, come to the US, marry, apply for AOS. Get AP or green card then go back home and do a ceremony there for your family; but don't even risk your journey by doing it before hand.

Listen to those advices and actually READ about the process. K1 is just a first step. 

 

How did you expect to get a green card without any knowledge of AOS? Are you even aware you can't work or travel for a period of time once you cross the border on k1 visa? 

 

If you get married before entering the US they will not issue you a green card (if it comes out during background check) and you'll say goodbye to the USA.  Worth it?

Adjustment of status (AOS).  It will be your next step after entering the US on a K1 visa and getting married.  The newly married couple will file the AOS to essentially apply for a Green Card for the immigrant spouse.

Good idea.  If they don't know about it, then you should totally do it and you will get away with it.

I had my ceremony wedding before entering US as a k1 holder. During my interview, the Interviewer asked me to provide my marriage proof. I showed them my pics with friends at my courthouse wedding. She wasn’t happy with that saying ur special day and no family around. I then showed her my ceremony wedding photos in my home country with my husband’s family attended. She then said “you come here with k1 visa right?” “If you want a big ceremony like that why don’t chose spouse visa in the 1st place?”, “what date is actually your wedding day?” To answer to these questions I had to tell her my situation that filing k1 seems faster for us to be together, my mom had a heart surgery this year so she cant fly to US and attend my wedding; so we all agreed to have “ceremony wedding” in my home country instead. My

offficial wedding day would be the date getting married at court. 

Later she was convinced and said my decision made sense. 

Its judgmental decision depending on the interviewer. So you should think carefully about it.

Well, another one who thinks hiding things from USCIS is a good idea. You’ll come back crying to this forum when you are not allowed in the country at POE because they found out you are not free to marry and you’ll have to wait another 15 months before getting back in because you will need to file CR1.

If you intend to begin your life in the US with a lie, be prepared to suffer the consequences.

The immigration process is expensive and stressful.  If you can't follow the rules that apply to the K1 visa then i suggest you get married and submit a Cr1 instead.  AOS, ROC and citizenship all require background checks - You don't want to face a problem of misrepresentation in the future.  I'm sure most of us who went thru the K1 process would have loved to have had a ceremony in our home country, but it was part of what we gave up in exchange for going the K1 route instead of Cr1.

It can be considered as marrying before fulfilling the FIANCE visa requirements, which could trip you up at any point or stage throughout the process. If you'd rather marry first at all, you should've gone for the CR1 instead.

 

How will they know? There's lots of ways, it's the government. Most simply? They could just ask either of you at any point, and it's never. ever. ever. a good idea to lie to a CO throughout the process. So that'd be one way of them finding out.

 

Also - please do not misunderstand me, as I don't intend on sounding inconsiderate, but I say this as a general observation - you seem to be unfamiliar with a lot of standard, important terms. Perhaps you're just not familiar with all of the abbreviations. At any rate - I strongly encourage you spend more time researching the process, including steps that have yet to come, to better prepare yourselves for this journey. Research is your best friend with this process.
