Happy new year in advance House.

 

Please I need someone to clear this confusion for me. 

People have been telling my husband that our marriage is not yet legal  recognised in America until I get there or have my green card.  They said it does not matter if we had filed and waiting for interview, my husband can go and collect marriage licence to marry someone else and he will give it.

 

Please is this true.

Your marriage is legal in the US. Married is married, doesn’t matter where you got married.

I asked our lawyer about this as we were married in another country. He said of course it is! As long as you have your marriage certificate it is recognized and of course you can file your taxes as married.

in Nigeria a man can take a 2nd wife but not in the US

if he married while still married to u,  its bigamy here 

 

u legally married to him in Nigeria, under Nigeria law,  its legal in the US

she is in Nigeria and he is USC and he can file taxes as MFJ or MFS

There is no way they can check if you are married so yes it is possible for any married person to get a marriage license.

If your husband commits bigamy, then your marriage will not be a legal basis for an immigrant visa.

You mentioned two different issues.  Of course your marriage is legal and recognized in the USA.  It is also true that if you married in another country, your husband could obtain a marriage license in the USA and marry somebody else.  It would be a crime, but he could do it, because the USA has no national registry of marriages.

Facts are cheap...knowing how to use them is precious...

Correct.  The criminal act of Bigamy by a US citizen does not (in and of itself) disqualify them from bringing their legal foreign spouse to the USA.
