Our Story

  1. Background: I am a USC petitioning my husband who is F1. The 130/485/etc package was sent in January 2023 and priority date is current. No movement except for biometrics. We met after he arrived on F1. My husband will complete his edu program next month however our lawyer is giving confusing advice. She says "you should keep going to school during AOS. Don't stop going to school." But she doesn't explain or offer any more info. He is not dropping out, he is finishing his program. I thought as long as he completed his F1 program, there should not be an issue adjusting as he followed through with the original intent of the F1. Questions: Does he have to enroll in more school or no? If yes: What about when his EAD arrives? He would begin working, which invalidates his F1 correct? So this conflicts with the "keep going to school" advice. We assume he will not receive or active the EAD anytime soon anyway, possibly not for many more months. If he does have to enroll in more school until his GC is approved, does he have to finish that program too or can he stop going once the GC arrives? Wouldn't enrolling in another edu program be considered F1 fraud as he now has immigrant intent b/c he filed for AOS? We can't afford to pay for school for potentially another 2 years. Would this be taken in to consideration? I believe the lawyer is advising him to stay in school in case of GC denial, he would have F1 as a safety net. But we don't really foresee a denial, our case is strong. If he is in fact denied, he'd have leave the US anyway. There is no point in remaining on F1 forever. Please help me understand what he is supposed to do next. Thank you.
  2. Hi! I submitted my AOS sept 29,202, on march 23,2023 I was asked to submit my medical and mail it to NBC. I submitted it last week & my status changed on April 3 to “RFE RECEIVED” just wondering how long it takes after a medical RFE to make a decision?

Did somebody take foreign property as an sponsors assets for i864 form (USA) in Adjustment of status (AOS) process? if yes, what is the better way - to make foreign property valuation with foreign appraiser, translate it notary to English (with apostille?) or with American appraiser making evaluation remotely (if possible)? Thank you!
  4. Hello, it's complicated here but any suggestion appreciated.. I came to States under J1 (2 years rule waived) 09/15/2012 - Changed the status to F1.. while on F1, my wife's employer sponsored us for Green Card. She was on E1. Her status approved to PR but I got denied because didn't maintaine the F1 status for a week or so.. because I forgot to pay school fees and the school removed me from Sevis. after couple of motion applications and re-applications I kept denied. so we decided to apply for 601A along with the I130. I130 approved no interview but 601A got denied. Now my wife became a US citizen and I applied for AOS again on 04/04/2022 with my consular approved I130. On 01/13/23 I have my AP approved. didn't used it for travel still waiting.. no rfe or interview request since then.. what are my chance to be approved for AOS. no criminal record or anything.. no deportation letter.. it's been a year since I applied again, people keep getting rfe's for medical but I didn't receive anything yet.
  5. Hello, I am filing for AOS for my husband which I brought to the US on K1 visa. I am trying to complete the I-864 as the sponsor. I have a question however, I just started working in January, this is my first job since my last one two years ago. My job from two years ago doesn’t meet the requirement, but my current job does. I make enough to sponsor him but I do not have any tax returns for this job since I just started. I have two or three pay stubs and that’s about all. Should I make a joint sponsor or can I be able to sponsor my husband with an employers letter and pay stubs plus whatever tax returns (which do not qualify) I had prior?
  6. Hi everyone, Me and my fiancé finally got married on March 18, 2023 on a K1 Visa. We are currently filling out forums I-485 and I-765. But cannot find clarity on how to mail them in (since we are mailing both forums together) and can't find the filing fees. If anyone has been through this process and can advise us where to look, etc. it would be greatly appreciated. We tried looking on the USCIS website but it wasn't giving us much information.   7. Hi all, My wife and I just moved and registered the change of address with USCIS through their website. We received an email confirmation that the change was successful however when my wife goes on her USCIS online account she can see the following under her I-131 application: We're a bit confused, do we also need to follow these directions as well to register the address change with I-131? Or is this not relevant to us? Thanks in advance for the help!
  8. To do the AOS, adjusted gross income is required to show (I am self employed). This whole covid thing really kept me from making the money I needed to make, but I did finally recover in 2022. How many year's back taxes do we need to show to do my Wife's AOS? Would 2022 alone be sufficient, or do we need to show 3 years of back taxes. She is not planning to work anywhere, so basically at this point, we just want to do a AOS, if more than last years taxes would be required. I had a loss for 2019, 2020, and 2021. Again, 2022 I did well and am quite a above the 125% of poverty level. Just me and the Wife here. Will I need a co-sponsor to get this done?

  10. Hello everyone! Earlier last year, I dropped down to a per diem position at my 12-year-old job to work at another full-time contract job that paid significantly more. After the contract was ended, I applied for another contract job, but nothing was available anymore. I was able to keep my employment at my old job by picking up the required shift. By the end of last year, I was back working full-time hours at my old job, still as a per diem employee. After getting our NOA2, I knew that I needed a permanent job soon in order to provide proof of a stable income. I am planning on taking a part-time position at my old job due to the fact that I will be able to earn more this way. My position would be part-time, but I will be picking up full-time hours plus OT. I also get health insurance benefits for being a part-time employee. But I am worried that we might end up being asked for a co-sponsor because of my part-time position. I'm already close to meeting the 100% poverty guidelines this year for a two-person household, and I'm above the 125% poverty guidelines from the last 3 years. I am confident that I will be over the 125% poverty guidelines this year too. Being employed by the company for the last 12 years should also be good enough proof that I did have a stable income. I have been working more than my full-time hours on this job for years, and I plan to keep doing it. I spoke to my manager, and she said that she would even write a statement for me saying that I do work full-time hours as a part-time employee. I have yet to talk to HR about the employment letter and am hoping they'll also make the same statement. Of course, I would be providing a current six-month paystub for the interview day. I've never been married and have no children. It's only going to be me and my fiancée. Does the petitioner really required to have a full-time job position? What is everyone's opinion on this?
  11. Hello everyone, I hope this is the right section, if not my apologies! I am writing today regarding a RFE for my I-693. The note says: Submit a completed Form I-693, Report of Medical Examination and Vaccination Record. The medical that you submitted to the consulate was signed by the physician more then 1 year from when you submitted form I-485, therefore you must submit form I-693. A USCIS civil surgeon must complete and sign the form, and you must also sign the form. If the civil surgeon refers you to a specialist, the specialist must include his or her medical exam results and complete the proper sections of the Form I-693 before the civil surgeon may sign the form. Once everyone has signed, the civil surgeon will place the completed Form I-693 in a sealed envelope and give it to you. You must submit the sealed envelope containing the original Form I-693 that the civil surgeon signed and the medical exam results; we will NOT accept photocopied Form I-693 and medical exam results. Civil surgeons must use the current Edition of Form I-693. You can find the current edition of Form I-693 on USCIS’s website at www.uscis.gov. In addition, the civil surgeon must ensure that all parts of Form I-693 were properly completed. Please Note: All Forms I-693 signed by civil surgeons on or after October 5, 2022 must use the 07/19/2022 edition of Form I-693. USCIS will not accept the 09/13/2021 version (or any previous editions) if the civil surgeon signed the Form I-693 after October 4, 2022. Therefore, the civil surgeon administering your immigration medical examination must complete and sign the 07/19/2022 edition of the Form I-693. I was surprised to receive this note for the following reasons: 1. My physician signed the I-693 on 6/29/21 and I submitted form I-485 on 12/21/21, only 6 months after and not more than 1 year later as stated in the RFE 2. In addition, the USCIS website states that I-693 is valid for 2 years, from the website: We generally consider a completed Form I-693 to remain valid for two years after the date the civil surgeon signed Form I-693 (https://www.uscis.gov/i-693) 3. Moreover, the same website states: From Dec. 9, 2021 until Mar. 31, 2023, we are temporarily waiving the requirement that the civil surgeon’s signature be dated no more than 60 days before you file Form I-485. Should I still book another appointment for I-693 or talk to a lawyer? I feel overwhelmed by this never-ending process and would appreciate your thoughts on this. Thank you.
  12. My mom's AoS interview has been scheduled for mid-March. She doesn't speak English and has also travelled on AP. Can you share your experience and guidance? How to you request the interpreter? WIll they allow me to interpret? How to go about it? What questions are asked to parents?

Hi guys, this is my first time posting on here after quietly sleuthing for months.. my immigration journey has been unique, initially filed for consular processing and started the process March, 2021. i130 was approved Dec 2021, and I began my NVC process. However this past June while visiting my husband I went into early very early labour and had my baby in Michigan & while my baby was in the NICU we decided that we would have to change to AOS processing. We submitted the I-485 & I-864 Sept 26, 2022- I had my biometrics Oct 28,22 & my case went into active review Oct 29, 2022. There has been no updates since then... I am now realizing that I should have submitted the I-693 medical exam and am now worried that I did this incorrectly. I am assuming I will get an RFE for a medical & can submit it then but I am wondering if I can go ahead and do the medical and submit it on my own before the RFE? Or should I wait? Any advice would be greatly appreciated.. thanks :)

  16. Hi everyone! I would like some advice, my envelope for the 693 has some scratches because my dog the envelope has two parts that is broke/open, but these are no more than 3 centimeters for one and 1 cm for the other one. Is this going to be a problem? USCIS can reject our form for this reason? We don't know if sending in that way o put it some tape, since the scratch is not too obvious but enough to be notice.   17. Hello there. asking to file i864 and i864a I need to add to my current income, the taxable income + the non taxable VA disability compensation benefit. We r not 100% but 90% disability. 1. Is possible to add that kind of income in part6. item 7 and 2. in the part of tax returns, do i have to put the year and the taxable income without the non taxable income? how is the proper way. thx you very much. I m sponsoring my dad IR5 and i m a USC.
  18. i recieved my gc approved but the aed and travel authorization was terminated. The application was closed "because the applicant or petitioner received a ststus or benefit through other means". Should i apply for another aed and travel authorization?
  19. I am in the US with my application DQ at NVC (waiting for the interview to be scheduled) back at home. How to answer this question on the form i-485: "Have you ever applied for an immigrant visa to obtain permanent resident status at a US Embassy or US consulate abroad?" So should I say Yes and then say "Pending" about the decision? Or simply answer "No" ?
  20. Hi All, My wife (fiance at the time) arrived in the US in August of 2022 and we got married in September 2022. She also applied for and received her SSN in September as well. She applied for AOS with an NOA1 date of October 10th. We are now filing our tax return for 2022 and ran into a question. We would like to file jointly (MFJ) but it is unclear to us what her current status actually is. From what I've been able to find on here it seems like for tax purposes she might be a Resident Alien, even if by USCIS standards she isn't one. In reading on if this was correct or not, I found several older posts here on VJ stating we had to file the 2022 tax return by mail (was planning on e-filing with TurboTax) and send in some statement asking her to be considered a Resident Alien for the IRS. Is this correct? I'm unsure if it matters or not, but she had no reportable income for 2022, so we don't have additional forms from that angle to file. Happy to provide more clarification if needed, thanks in advance everyone!

  22. Hi everyone, This is my first time posting here, and I have some questions. I have my N-400 interview next month, and I plan to apply for my mother's green card. From my first GC until my citizenship, I did everything by myself without the help of a lawyer, and everything worked out great. My mom came to the US one year before me with a P1 visa, but she overstayed. My question is: Is the process for her AOS the same as if she has come here with a B2 visa? Will USCIS do more questioning why she stayed? Or it doesn’t matter?
  23. Hi, I received an RFE from my I-485 asking me for my marriage certificate and my I-693. I sent everything through the mail with FEDEX (original with seal marriage certificate and I-693 sealed by the doctor) and it says it was received and signed for on 12/19/2022. But my status online hasn't changed. It still says "Request for Initial Evidence was Sent". I have tried the chat on the USCIS website and they won't confirm that they received my package and keep saying I have to wait 60 days after I sent the response to talk to them again. Has anyone experienced that? I am trying to stay calm and wait the 60 days, but I'm scared and can't think about anything else. My timeline: USCIS received I-485 - September 22nd, 2022 Scheduled Biometrics - September 30th, 2022 Biometrics Appointment - October 17th, 2022 (Case status changed to "Being actively reviewed" on this same day) RFE was sent - December 5th, 2022 (letter available online 2 days after that, then response was received according to FEDEX on December 19th, 2022).   24. Hello all, Our Adjustment of Status application was moving along nicely. EAD and AP approved, 200 days since filing. My USC wife was filling out a different federal form and a question made her think: hang on, am I naturalized or do I have citizenship derived from my parents. The long and short of it is, she’s ‘derived parents’. Our issue - we didn’t know this and put ‘naturalized’ on the I-130 when we filed. Our lawyer missed it too and just took our word for it. the confusion stems from the fact she was 17 when she became a citizen, but 18 when she had her oath ceremony. We included copies of her passport, certificate of citizenship, and her Mom’s passport too as part of I-864. We’ve given them everything they need (A number, certificate number) but we just ticked the wrong damn box. We are absolutely kicking ourselves over this. What are the consequences? We’re worried that this small error might be enough to deny our application, and with it, my EAD and current job. Would they issue an RFE for this? Or should we write in to correct it unsolicited? part of me says this is a minor issue, but the other half of me is scared of losing everything. Thanks

Hello everyone, my husband and I are filing for AOS, I am in the USA under a F1 visa (currently OPT) Page 10 item 15 asks if I ever got denied a visa which I did, my F1 visa got denied at the Milan US Embassy and then got accepted about a month later in Rome, what do I need to write in the additional information page? When my visa got denied the office person didn’t really give me an explanation so I don’t know if I have to go into details. Also would this cause a problem in my application? Thank you
