Cr1 Visa Denial letter. what to do next ??

So if you cannot work because your dad requires your help, what would be your plan for him if you immigrated?

I took a great interest in this as my husband was unemployed when I had my visa interview (and had been for some months). We had a joint sponsor, of course. 

 

I was asked about work during my interview and what my plans were. Fortunately I have an MA and am pretty advanced in my field. I already had been offered a position over here prior to my interview and I took the paperwork about that to my interview. I think that significantly helped my case. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

I think you have two options.

 

1, time for wife to consider moving to Jamaica 

2, total overhaul of her employment, your employment & education.

 

based on your previous post history of

- admitting to smoking pot to CO

- her interview requiring sworn statements of finances in addition to the norm

- now this denial for public charge

 

future is not looking bright, you need to work harder at demonstating both financial responsibility and clean drug free practices. Remember NVC are looking for responsible adults for immigration to the USA, not those that are risky with regard to financial liability, breaking laws etc.

 

if your serious about moving there, you may also want to consider placement of your sick father into approved care facility..you can’t move if you are caring for him and he will not be able to come with you without his own visa unfortunately.

So...It should work on a Tourist Visa also?

An affidavit that the traveler will not overstay!

Yeah well it won't be possible in this case. There are many things in this case that don't add up and the CO rightfully denied them

Immigration is not based on wishes....the LAW determines what is possible and what is not.

We provide a lot of encouragement on doable things based on the laws & regulations otherwise they would be wasting time, money and making their journey more complicated.

An affidavit promising anything is all it ever takes... smh

 

None of the the above addresses anything in the refusal letter.

The refusal has nothing to do with requested info..
