Denials come along with other factors that you are not fulfilling either.It has to do something with relationships history and bonafide

Well yes, but this denial is specifically due to the public charge, as stated in the letter.

The letter was specific that the denial was due to public charge.  There was no reason to question anything else they submitted to prove bonafides.  Google - Denial for public charge and it will give you more information.

no,  immigrant's job is not the basis for the income

but,  the CO in many embassies will ask "what plans do you have for life in the US?"

they want to know if the person plans to work or study or have any idea what is expected

Im interested in what the answers were on the sworn statement he was asked to provide were (posted in another thread). It was asking him to list the  number of people the USC supports and other members that live in the house and their income sources. It seems the USC works a minimum or low paying job and based on what he says there are also 4 other adult (children?) in the house. I suspect they are either unemployed or under employed and perhaps may even be using social service programs.  So it would seem even though her household size can technically be 2 on the 864 (if she doesnt claim the adult children on taxes) but she should actually have a higher household size if she accounted for them on the 864 as her dependents. So it seems they are considering her to have a higher household size based on the fact she does support the children. 

 

The only solution here is a change in circumstances. He can further his education and obtain degrees to secure a well paying job after completion or if school is not his thing there are plenty of trades or jobs that provide on the job training that after 1-2 yrs with them he could be certified in some field. Another scenario would be for her to reduce the size of her household. It may be time for her adult children to leave the nest.

Job hopping isn't uncommon and wouldn't be an issue so long as employment is consistent (rather than the job) and income exceeds the minimum requirement. 

Job hopping + a huge age gap + other factors that don't match up (ie: beneficiary claims to not be working as they "must" look after an ill parent despite applying for an immigrant visa would would take them away from said parent that needs so much nursing that beneficiary can't work?) + Petitioner being almost at retirement age = a group of circumstances that would make most CO's do a major double-take. 

I make above the income requirements (43 k) a year and he has had stable employment. So I'm hoping that's enough!
