Did my EAD just get approved??(merged)

We didn't have issues with biometrics never being scheduled, but we had issues with USCIS making other errors (by giving us and RFIE asking for an untranslated, non-English BC when my husband was born... in England.) We ended up reaching out to our congressman to determine why we were asked for it since it seemed like mistake was written all over it.

 

If they've already opened a service record, you're probably in the clear and will get something in 15-30 days. We ended up with an SR open for our issue through USCIS's phone support, but our congressman's office got it all wrapped up quicker for us in the end.

You seem very impatient, sending a service request when your NOA1 did not come immediately. It is not unusual for NOA1 to take a bit over a month.

I know it is frustrating, especially with a job offer. Expedites are possible, but for some parts of the process you still just have to wait in line like anyone else. Meanwhile, make sure you keep communicating with your employer, to let them know where you're at, and hopefully they'll hold the job for you. Good luck.

1) In my previous posts I was advised both to wait, and to try and go forward with an expedite either way. So yes one way or another I was going to 'ignore' advice. Also, I have already gotten an RFE for my 485 concerning my birth certificate, so it seems like yes they are able to do at least some things without having your biometrics.

2) for NOA1 you are allowed to open a service request if you have not received it within 30 days of delivery of your papers. If you wish to label me as impatient for doing that, feel free, but the officer who opened the service request for me clearly didn't seem to think that and said I was within my rights after 30 days to open a SR for that.

3) Thanks for the advice I am in constant contact with my employer.

I wouldn't bother with them directly anymore, and would instead contact one of your congressional representatives to try and intercede on your behalf.

OP, I notice that you are filing through California.....this center is greatly delayed with various applications.

USPS is known for losing people's green cards, supporting docs, etc.

USCIS is known for blowing smoke when they don't have the answer.

Neither organization can be held accountable and that is grossly unfortunate.

 

Also, I can't help but notice that you seem to STILL be livid and your posts seem to be like you're angry typing. Members here are only trying to help you with the possible scenarios of why this is happening with your case. Chin up, you should hear something good pretty soon. :)

Yep! USPS marked my husbands 10 year green card as delivered. They delivered it to the wrong box. We had to get USPS to find where they put it and redeliver it or we would have been out the 600$ to get it replaced.

 

 

 

with that said I can say I’ve seen a number of people constantly contact USCIS relentlessly only for that to backfire on them. Depending on who is running the case, people have seemingly been punished for contacting them too much by having their cases take way longer than normal.

This just cracked me up. You made my day. USCIS is so great, they asked for a non-English birth certificate for someone born in England.

The California Service Center on the OP's profile is a relic from his I-129F petition (which is always handled there).

 

Nothing in AOS from a K-1 is handled by the California Service Center. Initial I-485 processing and EAD/AP are done by the National Benefit Center (in Missouri); the interview is done by your local field office (which if the OP's profile is correct, is Providence, RI.

 

Some of the CA field offices are exceptionally slow for AOS (mostly in the LA and SF metro areas), but some are pretty average and one or two might be on the fast side.

The situation is I applied for AOS as K1 on april 15th. It took over 30 days and a service request for me to receive NOA1 on may 20th. Because of all of this stuff, and bc I know I need to have biometrics done before I get my EAD, I have been on the phone with them almost daily to figure out when my biometrics is (making sure I wasn't missing any appointment letters etc.) every time all they told me was to wait, that my service request had not reached 30 days yet, and that there has been no biometrics appointment scheduled.

 

This morning, I received an email from them regarding my expedite request. It states: 

 

'Our records indicate that we are awaiting your appearance for biometric processing.  USCIS requested that you appear at the Application Support Center (ASC) for biometrics processing associated with your case. It appears that you may have missed your appointment.  Your application information has been re-entered into the system which schedules applicants for biometrics at their local ASC. Biometrics appointments are scheduled as slots become available at the ASC. Once you have been scheduled for an appointment, you will receive an ASC Appointment Notice to appear at a certain date and time at your local ASC. You must take the ASC Appointment Notice and photo ID to your appointment. You may request expeditious processing again once USCIS has received your biometrics.'

 

Naturally, I am beyond livid. I'm back on the phone with them waiting in line again now but I just wanted to see if any of you guys have any advice on this: I clearly did not miss my biometrics appointment- it was never scheduled by their mistake! Can I somehow hold them accountable for this? Can I find a way to have my biometrics done earlier rather than later? Is there a way to expedite biometrics? I already called them this morning and the lady was able to tell me I was in a 'que' because there weren't any available slots right now. How long the que was or when there would be new slots she couldn't say.

 

I am so upset that I followed all of their directions by the book and they have the nerve to point out I missed something. 

Normally, as advised earlier, it would be suggested to go to the ASC and walk in to see if they allow you to do Biometrics, but considering you don't have the appt letter, perhaps you can still go and show them the email (or print it out) and see if they have any insight. You may have some luck.

Yikes. Well, IMO you will not get anywhere asking for an expedite based on "their error". What exactly is the error you are claiming they made? There is NO requirement to give someone a biometrics appt with in a certain time frame. I read the email more like ' you are asking for an expedite but you didn't do biometrics. If you missed it- they are entering you again in the system for it. If you didnt miss the appt, then wait for the appt and send the expedite again afterwards.  Also if there is a que waiting it is unlikely they will be welcoming to a walk in. A full que means they are all booked up- so a constant flow of people with not much downtime to squeeze in emergencies.

As soon as the letter arrives, do the walk-in at the service center. I had no problem doing my wife's bio metrics early. At the ASC here they said the best day is Wednesday to get things done, as it is the slowest day in most ASC's. They actually said they call it " Walk in Wednesday" for this reason. They were really cool about it, and had no problem taking care of us. They did need to see the letter though, you won't get past security without it. And follow the instructions included. At our location they had a strict no cell phones policy ( We left them in the car) and only had our appointment letter and passports for identification. It's the usual Blue glove treatment if you set off the metal detector, so you don't want that.
