Did my EAD just get approved??(merged)

Hi guys,

 

Super frustrated over here trying to get some advice...

 

The situation is I applied for AOS as K1 on april 15th. It took over 30 days and a service request for me to receive NOA1 on may 20th. I applied for 765 with the 485 and have requested expedite processing on this based on personal financial loss (category 1) because I've gotten a job offer. This expedite request was made June 6th. Since then Ive gotten a RFE for 485 that Ive responded to and has been processed.

 

The whole time this was happening there has been NO SIGHT of my biometrics appointment or appointment letter. On may 30th because of this I opened another service request to find out whats going on to which they have not yet responded. Because of all of this stuff, and bc I know I need to have biometrics done before I get my EAD, I have been on the phone with them almost daily to figure out when my biometrics is (making sure I wasn't missing any appointment letters etc.) every time all they told me was to wait, that my service request had not reached 30 days yet, and that there has been no biometrics appointment scheduled.

 

This morning, I received an email from them regarding my expedite request. It states: 

 

'Our records indicate that we are awaiting your appearance for biometric processing.  USCIS requested that you appear at the Application Support Center (ASC) for biometrics processing associated with your case. It appears that you may have missed your appointment.  Your application information has been re-entered into the system which schedules applicants for biometrics at their local ASC. Biometrics appointments are scheduled as slots become available at the ASC. Once you have been scheduled for an appointment, you will receive an ASC Appointment Notice to appear at a certain date and time at your local ASC. You must take the ASC Appointment Notice and photo ID to your appointment. You may request expeditious processing again once USCIS has received your biometrics.'

 

Naturally, I am beyond livid. I'm back on the phone with them waiting in line again now but I just wanted to see if any of you guys have any advice on this: I clearly did not miss my biometrics appointment- it was never scheduled by their mistake! Can I somehow hold them accountable for this? Can I find a way to have my biometrics done earlier rather than later? Is there a way to expedite biometrics? I already called them this morning and the lady was able to tell me I was in a 'que' because there weren't any available slots right now. How long the que was or when there would be new slots she couldn't say.

 

I am so upset that I followed all of their directions by the book and they have the nerve to point out I missed something.

Feb 5 2019: Interview (approved!)

Feb 12: Passport received, visa in hand

March 12: enter US, POE; Boston

March 21st (1st day of spring🌻😞 married!

AOS (2019) 

April 12: Sent in AOS, EAD and AP

April 15: Delivered at USCIS

May 15: Opened service req for NOA1

May 20: NOA1

May 30: Opened service req for biometrics appointment scheduling

June 6: Requested expedite processing on EAD (via phone)

June 12: Asked to fax evidence for expedite, sent in job offer (non-profit) and cover letter

June 17: Received RFIE (birth certificate) - notified that EAD expedite was on hold

June 20: Evidence received by USCIS after overnighting

June 21: Asked for expedite request to be re-activated (via phone)

June 26: Expedite could not be completed because of missing biometrics (E-mail)

June 26: Biometrics appointment got scheduled (for July 9)

July 3: Walk- in biometrics

July 8: Asked for expedite request to be re-activated (via phone)

July 13: Expedite request for EAD was approved (E-mail)

July 17: Hard copy of Notice of Approval for both EAD and AP in snail mail- online status changed to card was mailed to me 

July 20: EAD/ AP combo card in hand

I think some offices allow you to do a walk in for this. Depends on the office. I could be wrong))

Not a newbie but lost my old info years ago) I have been through this process before --all the way through naturalization-- This site has always been a great help to me.

Do they still do Infopass in St. Paul? They are stopping in two weeks in St. Louis. How long will you have to wait to hear back for your service request?

The usps never had an appt letter to deliver bc the bio appt was not scheduled that's the issue it's uscis that made the mistake and they are telling me it's on me. It's not on me or on usps there was never a bio appt made in the first place...

Like somebody mentioned there needs to have been made an appt to even do this which never has been made

Frustrating...

According to the response it was, you never received it because the USPS didn't deliver

No this isn't the case. On the phone they can all look at my file directly and tell me that there was never a biometrics appointment scheduled for me to even miss. The reason in the email they tell me 'It appears that you may have missed your appointment.' Because the officer handeling my expedite request probably knows that I  should've already had an appointment and it seems to me he doesn't want to admit that they were at fault for never scheduling me one. 

 

Think of this: If I actually had mist my appointment he could have easily just said: You had an appointment on <date> and never showed up.

There was never any mail to go missing. On the phone T1 and T2 tells me they can see there was never a biometrics appointment scheduled. Additionally, they all took notes on when I called them (almost every day since May 20th) to ask if my biometrics was scheduled yet, and when it would be because I was afraid to be missing my mail. Additionally, why did they let me open a service request on may 30th (to date it has not been solved yet) for this exact problem (not being scheduled for biometrics), if I had been scheduled for biometrics (which they claim)? Its very clear they've made a mistake and don't want to own up.

Holding USCIS accountable is a dead end for sure.

Per https://www.uscis.gov/about-us/contact-us , the best you could do is email public.engagement@uscis.dhs.gov

about the issues you faced. Will anything happen? Likely not.
