I honestly hope you get an RFE. These days USCIS is denying applications without sending RFEs.

Just curious.....if for some reason an RFE was not issued, and it was an outright denial, could the OP simply reapply?

I don’t think OP can simply reapply as majority of denials come with NTA to appear in the immigration courts. That one needs to be resolved first i guess.

There is a pinned thread in the beginning of the group started by CookieCat where she explained in details all the documents that she submitted with an example of a cover letter and made it very easy to follow. Take a look at that and gather all the ones that you have and be prepare for a response later on. In your case you should have sent them with the difference of including the reason for the late filing in the cover letter.

@PandO,

Please correct me if I am wrong (as I might not be remembering correctly).

 

I seem to recall reading somewhere on VJ that simply providing reason for late filing as tardiness is not going to be enough. You have to provide a very solid reasoning for filing late. I really hope that whatever reason you provided would be enough for them to consider your petition.

Yes. Although if an NTA is issued as well (there is usually a small delay between denial and NTA being issued, but not always)., then it gets more complicated. USCIS is still the one to adjudicate the I-751 - an IJ won't make a final determination to revoke status until that is adjudicated. And that is years down the line if one fights it.

 

Edit: Note this is different than AOS. If AOS is denied and an NTA is issued, the I-485 has to be submitted to the court. They will then refer it to USCIS, if things go well.

You gave a reason for filing late and you submitted the mandatory evidence.  

So you will likely get an RFE. Maybe an interview. That's not the end of the world. The RFE will just ask for more documents and you can start collecting those now so they are ready to send if you get a letter. 

As far as an interview, although it's common to have it waived in this process, they certainly do interviews and again, it's not the end of the world. I always expect an interview. If I don't get one, no problem. But it's not a bad thing. It just gives you a chance to provide more evidence in person.  If you do get an interview, take your spouse with you.

There was just a thread earlier today where they approved like 97% of ROC applications and how it is the biggest waste of time in the whole process. I wouldn't worry too much, seems like they just open the envelope and stamp it approved from the 2nd quarter filings. I couldn't find the post, but if I do I'll post it here. If you spelled your name right your probably good. LOL.

If all you sent was the green card, marriage certificate, and photos, you did not follow those instructions.  

 

Personally, I feel like writing “I didn’t submit in time bc I didn’t know” isn’t acceptable.  Ignorance of the law isn’t a valid defense.  Having kids also does not mean a bonafide marriage.

 

To be helpful to you, I would suggest getting copies of the birth certificates of your children, your tax transcripts, anything showing shared domicile (licenses, lease/mortgage/deed/mail), banking and credit statements (financial co-mingling), joint assets (car titles), insurance policies together.  You definitely don’t need 600 pages, but you need more than what you sent.

 

Hopefully you’ll have someone compassionate that will give you a chance to submit the required evidence.
