Flying in the U.S. without AOS

Hello everybody,

 

I'm hoping someone can help me with this. I got married to an U.S. citizen using the K1 visa about a month ago and soon I want to fly from Atlanta to New York for a few days for vacation reasons and I'd like to know if I have to expect any difficulties since we hadn't filed for adjustment of status yet. Is it necessary to file in order to get on a domestic flight?

If your i94 is still valid you can travel inside the usa without any problem. If it's expired, I suggest you file aos before taking any risks even with moving around, remember a hugr crackdown will begin soon from ICE.

It appears your I-94 expired more than a month ago..As a result,  You are now subject to deportation.  I strongly advise you to file your I-485 asap to gain authorized stay in the US. Just recently a poster, who had not filed AOS, was in a car stopped by police.  Because she had not yet filed her I-485, She was jailed for 5 weeks, and her case is still on-going.  There are no benefits in waiting.  If you think you are safe, you are wrong....good luck.

 

Will you have problems flying domestic?  Maybe, maybe not......

You can afford vacation, but you're not willing to file and pay for AoS - the only thing that keeps you from being deported? Odd priorities.

Agree with the rest. I wouldn't risk it, prioritize and file for AOS. Once you have the NOA1 for the I-485 then you can move around domestically just fine, until then you chance being arrested and detained and possibly deported. But hey whatever floats your boat so to say.

Agree.  The OP's timeline and the statement that "I got married to an U.S. citizen using the K1 visa about a month ago" looks like he/she just barely (if at all) married within 90 days.........immigration requires a lot of planning and money........and procrastination can be costly.

New York City is within the 100 Mile Border Zone and you can be stopped and detained anytime without your AOS receipt.   File now, vacation later.

In a city that’s planning to issue Driver Licenses to illegals, at least getting stopped and detained should not be a worry in NYC but yeah, i too don’t recommend traveling without AOS receipt especially thru TSA checkpoints under current environment.

But I would not risk presenting a foreign passport with an expired I-94...........I have seen that there is a big ICE sweep coming very soon.
