There are some banks (TD for sure) that will give you an account with just an ITIN. So as long as the fiance qualifies for an ITIN, they are golden.

If you’re following all of the rules and procedures you shouldn’t have any fear of deportation because USCIS shouldn't have any grounds for deportation.

 

these people that are being talked about here are those who stayed illegally, not those who came in legally and continued to maintain some form of status.

I've been saying this for years and people look at me crazy and argue it. Many people think it's okay because the government makes staying and adjusting okay by making it an option. Take it away and it stops. Heck, they may even see a decline in visitor visa applications.

 

One girl on a K1 visa page on FB even said to me "Well, if we had that chance to use a tourist visa, we would have. I don't see why you would want to take that away." Some people actually think that's okay, even if they are told it's fraud. They don't care; anything to get their beloved here faster. It's frustrating.

I got a bank account before even filing concurrent AOS. My bank didn't require anything other than a passport.

I can tell you from two women I personally know with the men they met. One overstayed by 3 weeks and another was just before his Visa expired. They married immediately and adjusted. In fact I asked advice here on one of the women just a few days ago. So Im glad they arw enforcing this.

It appears that the memo applies to countries with overstay rates greater than 10 percent. Those countries are mostly African and Middle East, and include:

• Angola
• Burundi
• Chad
• The Republic of the Congo
• Djibouti
• Eritrea
• Liberia
• Nigeria
• Somalia
• South Sudan

Other sources, including USA Today increase that number to 21 countries, still mostly African and Asian.

Same here. Got our bank account set up by showing them our 'placeholder' marriage license which they give you in this county before you pick up the certified copy after a small waiting period. They weren't supposed to let you do it with that document but the lady let us slide. We applied for the SSN on the same day, so he didn't have that yet either. Passport was fine.

I took my marriage certificate, but the bank didn't even need that! Just the passport. This was International Bank of Commerce which has branches in Texas and Oklahoma.

Same with us. My wife and I opened a joint account a credit union. We had to sign some form because she doesn't have SSN/ITIN then they took a copy of her passport. There was one catch though. The bank said she couldn't be the primary on the account because she's doesn't have SSN/ITIN. So whatever.

 

(Next time she visits we plan on getting her a ITIN)

Both. The ones I know about came here on tourist visas*, and got jobs at one of the following: restaurant, corner store (aka bodega aka small non-chain convenience type store), housekeeping, or child care. Some eventually married US citizens and adjusted. Some still here illegally. One woman I met lived here for several years, eventually married an American, and as soon as she got her citizenship, sponsored her son, who she hadn't seen since he was a little child (and was a teenager when he immigrated here). And it is people like her that basically make it impossible for my wife's siblings to get a tourist visa. 

 

*Pretty much all the ones I know about are Indonesian. I don't know about other nationalities... 

 

Edited to add: what made her story even more "interesting" was she came here via a "recruiter", who connected her with her first job in the States (some Chinese restaurant in Colorado). That was over 15 years ago though, and I am under the impression it is harder for Indonesians to get a B2 visa now than back then, so that business might have gone away, but I don't know.

Yes, because it's just so much easier to throw the baby out with the bath water instead of actually educating themselves on the immigration process, understanding what the problems are and/or come up with ideas to solve the problem. It's just so much easier to believe what the MSM is telling you and blame it all on Trump and oppose anything he suggests.

I was excited about this reform until I read the articles. Upon reading, it seems like a thwarted way of doing things. He is going by percentages which can't define how many people ACTUALLY overstay based on country. Percentages can vary by the whole sample size. For example, Brazil has a 1.65% overstay but at a 2.2million expected departures, you're looking at 36k people overstaying in 1 year. As opposed to the 44.67% overstay from Djibouti (the highest I found on the list) with a total of 403 expected departures, leaving the overstay number of people at about 180. I agree he shouldn't make it easier for them, but these tiny countries are not where the numbers are coming from. Makes you think.. what is he trying to accomplish exactly? lol If he truly wanted to reform immigration, you would think he would target total numbers not percentages.
