Rose711 got a reaction from Mrs Ryan Carreras in London Interview Tomorrow - Any tips ?
Not sure if this helps but my Japanese friend married a man 30 years older that she had known for 10 years. They were friends all that time. They fell in love and married 2 years after his first wife (who she knew and was friends with) died of leukemia.

They had a few photos and things  supporting their friendship and events they had done together with groups. He had met her family twice on trips to Japan. They got easily approved once they went to the interview.

Sorry if this is hijacking OPs thread mods.

Thanks. I know it adds to the supporting income so I don’t know it does but adds to how much money I need to support us. 😱
Anyone these days can have children but raising children together is what is so amazing.

I appreciate the feedback for sure as she is a blessing to us regardless of immigration.
If it helps than great but honestly I was so happy to be able to have a child with him.

As much as he loves me, the fact I did not think I could have children again bothered me.

I had always felt that one day he would resent me since I was not of child bearing age and was doubtful that children would be in our future.

low and behold, she arrived  and healthy and I can say the most precious little girl and as parents just so very blessed.

    Thank You 😊

I agree with geowrian, consulates can extend the validity dates of the approved K1 petition, if the petition is still being processed. If you want to be sure, contact the consulate and inquire about a petition validity extension. There is some information about that very topic in the DOS link FAQs:

I wouldn’t be too worried about that. Get the right document to them and you should be fine.

Not even sure how this can happen as the fees are very different to AOS and file CR1
bring that to the attention of USCIS and the lawyer

Take the death certificate to the interview and explain the error.....when does correcting an error equal immigration fraud or misrepresentation?   Stop listening to your husband's brother regarding immigration......

Yes they can all be filed at the same time. Don’t forget the I130a which goes in the I130 packet as well

And the I-131 for advance parole, just in case.  When filing concurrently, there is no filing fee for I-765 or I-131.

The USC can file an I-130 and I-485 concurrently. No I-140 for family-based immigration.

Rose711 reacted to JMPM in I-130 Priority date, contact USCIS?
Because Nebraska Service Center is the most mismanaged service center in the entire system. Example If they get 20,000 petitions for I-130 in a quarter they process 10,000. So 10,000 gets added to the backlog. This has been happening for many many quarters. While Potomac is processes example 20,000 petitions they process 23,000. So they 3,000 gets removed from their backlog. Texas isn't as great, but they are keeping up and not adding a lot to their backlog

So yea if it's still there. That's where it is 12.5-16 months of processing time all sorts.

Source: Just look at the quarterly reports for the form I-130 at Nebraska, and compare it to the other service centers.

Actually, the grounds for sever financial issues with the USC can work against you. One of the main requirements for petitioning people is for the petitioner (US citizen) must show that they make enough to support the immigrant. There is minimal salary guidelines and affidavits of support the US must sign. As well as send in evidence of employment and previous years tax returns.

Also, there is no guarantee that the immigrant will be able to work immediately when they arrive in the US.

You can see how a claim of finance usually doesn't work.

You can get a job here and then she can join you. You don’t have to coordinate both. You’ll need a job to live here anyway unless your family will support you.

Rose711 reacted to Georgia16 in I 485denied. Can I get work visa or something instead?
Didn't you get medical with the K-1 then it is not required to get it again.

It will not be $3000 to file for the AOS for the both of you. The EAD and Ap are fee waived for the both of you when applied for with the AOS.
Depending on the K-2's age they also received a lower fee for the AOS.

Your main problem here is you don't read the instructions right and therefore make mistakes on your case.
I would suggest to re-fil the case for the both of you. Come back in here with a complete list of what you are sending so people can help you in case you are missing something. You may be lucky that it will pass your 2. anniversary and you guys will get 10 year GC instead. But your main issue right now is that neither you or your son is in status here.

Sister, what i can tell you is to pause the filing for now and build enough evidence and maybe file it this same time next year... Visit each other and spend enough time and gather everything, it also helps your relationship too... According to everything you said you have i think you need more evidence. US embassy in Naija can be a hard rock to crack with a weak case...

Right now the CO is probably going to link his rekindled enthusiasm for the marriage to the loss of his visa.
    Add that to MM’s list.
Your tax filing status (huge deal) is not going to help.  You signed and submitted a document to the government that you have been single.

While I am not familiar with Nigerian or African culture as a whole, the fact that you guys have had little visits on top of having separated for a whole year and not having enough evidence for an actual bonafide marriage, these are massive red flags and I do not see this being successful, specially with Lagos being one if not the toughest embassy, I'm sorry.
I'd recommend to have him be there with you for as long as possible (just to 100% settle if the both of you wish to be in that relationship) or just have him move there altogether if you both are definitely sure that you guys are indeed what you each want. If the idea of living in the U.S. still is what you both desire, then you can file, but as of right now, I can't recommend that.
If you do decide to go through the CR-1 route, I only wish you the very very best and that everything plays out in your favor because you have a tough tough road ahead of you that could even take a couple of years. Expect not even bumps but mountains to be put in front of you.

A violation of an injunction makes you deportable, the USCIS doesn’t need the conviction tho. It’s damn serious. The Board of Immigration Appeals has already decisions stating that a  conviction is not necessary just the violation of the injunction is enough to remove the person. I don’t know where you learned that biochemists and microbiologists have little lab experience in the US. I can’t speak for every university but it is typical for every biology, chemistry and physics class - outside of purely theoretical high level classes- to have a lab every week.
The lab course is usually registered separately as an additional  1 credit class to the main course. Maybe that is where the confusion arises? Many grads do required senior projects that involve independent lab work as well.

i have no idea how your degree will
translate. As for credentials, you would mostly be looking at getting an advanced degree, though that isn’t something you should pursue until
    you know the job market.

Yup. Otherwise, technicalities come into play; "If she overstays to..." part:
"There are cases of it being disclosed and naturalization being approved so that is definitely on the table too."
If after properly disclosing the 8 U.S. Code § 1324 harboring OP's naturalization is still approved, then his mother becomes an Immediate Relative per the INA and is then eligible to adjust status: https://www.uscis.gov/policy-manual/volume-7-part-b-chapter-8 "An adjustment applicant applying as an immediate relative may be eligible to adjust status even if:" "The applicant is not in lawful immigration status on the date he or she files the adjustment application; The applicant has ever failed to continuously maintain a lawful status since entry into the United States;"
