We filed a i 130 form , ( with lawyer ) he mistakly added that I’m in the US and I want adjustment of status ( and my case was APPROVED, we got the approval form saying I’m adjusting status  instead of going to the NVC  ( I’m not asking for adjustment I’m out of the US it should go to NVC .

 

HOWWW. Can we fix this and how long it will take to fix it ?

That makes no sense.  You can't adjust status without a visa. 

 

Which visa are you trying to get?

I am assuming they have an I130 for a spouse visa via Consular processing , but the lawyer 🤪 messed up and marked the box that triggers the AOS rather than Consular Processing.  Am I correct ?

Tell the lawyer to fix his mistake

I may be very wrong, but as far as I know you can’t file i-130 alone to adjust status without filing i-485, and also the i-130 is only approved after the interview... there’s something very wrong there.

 

Even if your lawyer did make that mistake, how could USCIS approve your i-130 without an i-485 and interview? I’m very puzzled.

That’s what my approval form say , 

 

 

The above petition had been approved. The petition indicates that the beneficiary is in the United States and wishes to apply for adjustment of status to that of a lawful permanent resident.” 

 

Then when I asked the lawyer way it say adjustment instead of going to NVC for my interview process , he said I mad a mistake ( TYPO ) he is so strange

There's missing information somewhere here. You need to reach out to your lawyer ask them to explain this grievous error on their part, and what are they going to do to fix it.

Have you met this lawyer in person, or has the petitioner? Can they visit and speak to the lawyer face to face? I know this is distressing and it sucks that a lot of time was already vested in this situation.

NOTEEEE:

 IM NOT IN THE US , the lawyer incorrectly did that mistake.

No non of us meet him in person , he was recommended from friend of us , bad choice, it’s very stressful situation we are waiting for that approval sense 8 month , he is in NY, and I’m in Saudi and my husband in Los Angeles ,, so sad

Well your husband needs to be the one that looks into fixing this. He needs to speak to that lawyer. If he doesn't attempt to fix it. He needs to file a complaint with the NY BAR Association. If the lawyer doesn't want to do anything. Your husband will have to pursue some legal action against him, and your husband needs to call USCIS and speak to a supervisor. Hopefully they can fix the issue.
