A family member came to the US with pure intentions of being married to a woman. But no one told him his wife has schizophrenia and it is a mess that he didn’t see the few times they were together and chatting online.  Truly sad. He’s on a conditional green card now. If he ends the marriage, will he be deported or do you think it’s possible he could argue to stay here? He has a job and a support system.

He should file for divorce now. When his divorce is file, he can file I-751 under the divorce waiver to get to get his permanent gc card. He needs to file with a copy of his final divorce decree.

Who committed the fraud?

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

This is not clear. Was it just ANY woman, with the intention of just staying and filing for a green card? Or was he in love with this person?

 I am not understanding the issue.  If he actually dated his wife and had more interaction with his wife, he would have known her mental health diagnosis.  She would have been comfortable enough in their relationship to tell him.  Fraud does not pertain to mental health illness.

Agreed. His very first statement threw me off: "A family member came to the US with pure intentions of being married to a woman". Not clear whether it was any woman with the intention of getting a GC, and that's why it is titled as "fraud", or this woman in particular. Agree with you, strange to date someone and not know about mental health issues... Need more clarification!

OP its not fraud nor even underhanded if a person -even with an illness - wants to marry and try for a normal life

 

its just somewhat sad that we,  the public,  are clueless to those who need compassion or help
