Hello everyone.hope we all are safe. I have a fiance back in africa. I knew him before and we got separated. He found a new relationship with a lady and the lady happen to travel to the united states. The lady filed for K1 visa and later cancelled it because the lady found another guy in the united states and she has moved on. So i and my ex we reconciled. I travelled back to africa to see him and discuss some important issues. Before travelling to see him, he asked me if i will marry him and i accepted. He went and paid my bride price when i went for a visit. So when i came back to the united states, i filed for k1 visa. They refused him the k1 visa. He showed all the evidence and the officer was convinced. They denied him visa because of the previous relationship that filed for him. He also went to the us embassy in 2005 and the agent that was trying to get him visa said he was married with kids but he has never been married before and he do not have any kids. I am to go back to africa so we can get married. Do you think with all the evidences i will provide will help him get a visa. Please i need my husband to be close here with me. Any advice will be greatly appreciated. Has any body been in same situation?

Please what advise exactly do you need? Tell us so we know where to respond from because from your story seems like you know what you want/doing,the reason for denial is quite clear

Your case is not DIY, make sure you have a good lawyer. This man is not simple.

The US is going to want to see evidence that his previous marriage was legally terminated, which isnt going to be possible to do because there never was a marriage. You definitely need a lawyer this case has come up many times here

We've seen this too many times.  This will not end well.  

Your husband lied to the US Embassy that he was married in 2005.  Now, he wants to immigrate to the US based on a bona fide marriage to a US citizen.  The US Embassy will want proof that your marriage is valid by him providing evidence that the marriage he reported in 2005 was legally dissolved by divorce or death.  He can not provide the evidence because he lied.  Lying to the US Embassy for a visa can lead to a permanent bar to entering the US.

 

You need a lawyer.  This is going to take years.  Lots of money.  And may not end positively.

I have never seen one of these " the agent claimed he was married for a tourist visa" cases resolved......either they never fix the misrepresentation or they just never come back to update us.   This is not DIY.  This will possibly not end well.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Nobody ever comes back to update. 

 

I bet this is a Kenyan case. We're known for this "agent" story.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Most people never come back here to report on cases like this, but I've never seen one be successful.  The first lie was the agent's idea but not the agent's lie.  Your man signed the application knowing it was a lie.  Second issue is paying a bride price and then seeking a fiance visa.  Get advice from a lawyer experienced with family based visa denials, or just give up and move on.

 

Facts are cheap...knowing how to use them is precious...

OP,  your guy is so desperate to get to the US, that he committed a material lie on a visa application.  Use of an 'agent' does not matter; ultimately, the applicant is 100% responsible for the content of their application.

 

He may have a small chance with a protracted and expensive legal process, but in the meantime,  you may need a plan B (moving overseas) if you wish to live together.

This happens often times in the Philippines as well. I have seen a couple cases like this and they never came back to update us what happened with their cases. The last case I saw this woman said she was married in 00's as well to try to get a tourist visa. She then met, married, and had a family with a American. He petitioned for her and everything came out in the interview about her claiming that she was married before. The CO flat out told her "Bring me the annulment, divorce decree, or death certificate and I will issue you this visa". Needless to say the husband was mad saying that it was the embassy's fault.
