Visit visa B-1 for mother

I need a suggestion, I am pregnant and I need my mother to be with me during my delivery period. I am green card holder here. She has applied for visit visa twice this year from Karachi Pakistan, which got rejected. Both time she told that sight seeing was the purpose of her visit, as people say that they reject visa when the reason of child birth is given. Now my question is that should she apply again third time for visit visa ? This time giving reason of child birth and providing a physician’s letter ? ( In my opinion, the rejection is not due to any incomplete paper work or financial incompetence; its maybe because of the fact that all of my siblings are in US, so they think she might slip here). Let me know thru ur experiences that what should be done ?

She won’t be getting a tourist visa with two recent denials. 

 

Hire a doula for birth and night doulas/nurses for night to mind the child if you can’t do it. 

 

Siblings should be able to lend a hand as well.

Unless circumstances change, another denial is probably likely outcome. The more denials on record in a short time also make one seem 'desperate' to get to the US in the embassy's eyes which is a red flag to them.

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Agree with @milimelo.  Seems her change in circumstances is an even stronger tie to the US.....

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Unfortunately she will not be able to come for the birth.  She appears to have more ties to the US than to Pakistan.  This circumstance occurs all the time in immigration.  It is one of the trade offs on starting an immigration path here.  If my wife becomes pregnant she knows full well that none of her family will likely be able to visit.  We already visit them twice each year.

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

For future reference, she should not lie to the CO.  It serves to confirm all the reasons why she and others from high-fraud countries do not get tourist visas to the USA.

It's not going to happen. Ask your siblings to be with you or hire someone. Your mother would NOT be allowed to help with the baby anyway.

Not sure what the Physicians letter is supposed to do, why would they doubt that as a reason? 

 

She can of course reapply, she only has the application fee at risk.

She will not be approved with so many denials and so many family members in the US.

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

It will also look suspicious that she didn’t mention the pregnancy before, when the timing of the birth will make it obvious that she knew already the previous two interviews. And the COs at those interviews probably suspected she was hiding something, they are trained to pick this kind of thing up.

 

Too late for you but almost inevitably when we see here “my X was told to say Y because Z would get a denial”... guess what, X got a denial for saying Y. Honesty is always the best way in interviews. At least if you get a denial with the truth, you don’t get tripped up next interview when the reason suddenly changes.

 

Unfortunately,, leaving family behind is part of the immigration process. We have all missed big occasions back home and had family miss our big occasions here. It should all be part of the factors that go into deciding whether or not to immigrate. If you need a big family network around you to give birth - which is very common in some countries but is just seen as a “nice to have” in the US - then maybe it’s not the right place for you. Is there any chance of you (and maybe your husband) going home for the birth? (Although reading again you say all your siblings are in the US...then you say it’s just one brother..confusing ) What about next time you get pregnant?

She’s applied twice already this year and now considering a third application? It’s only June. The CO has seen her desperation to get here. People are not usually so desperate to go sight-seeing. The COs are not stupid. 

 

How many children did she say that she had here? Your story also changed from “all my siblings are here” to “I only have one brother here”. 

 

 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

She lied on her application twice already this year and now all of a sudden she will change her story because she's desperate to get here. Don't you think the CO is smart enough to figure this out? This is why one should never lie to immigration and this is why it's so difficult for others to obtain visitor visas from high fraud countries such as Pakistan.

 

You do not need your mother here, you want her here. Big difference. You changed your own story by stating that "all" of your siblings are here in the U.S. to "only one brother" is here. Sounds like you aren't telling the truth, either. FYI the consulate knows exactly how many members of your family are here.

 

Your mother can apply as many times as she wants, she'll only lose the application fee but there is a zero chance she'll be approved. She has a pregnant daughter and all of her children in the U.S.. Her ties are much stronger to the U.S. than they are to Pakistan.
