Before this gets chastised for thread drift, as proof of this is the fact that diversity visa immigrants - a totally random selection with merely completed high school as the education eligibility requirement - have significantly higher average educational attainments and work in significantly more white collar/managerial jobs than family based immigrants. Imagine what it would look like adding in tertiary education and/or skilled work experience into the requirements.

It is not feasible to cut the wait without greatly impacting the rest of the categories.

 

The reason why the wait is so long is because the US is one of the few countries that allow immigrants to bring over family members outside of spouse and children. Cambodia may not even offer petitions for siblings in its country. So when there are so few countries that have this option, the line is going to be very long. So that means people have to wait many years. And I'm sorry, but I would rather give priority of spouses and minor children than siblings.

 

The reason why there is a proposal for a merit based system is because chain migration can not be sustainable forever. US immigration is 66% family based and 20+ % work or education based. That means a person who has a sibling in the US but they have no education, knowledge of English language, or work skills have a better chance to come here than a person who is a college graduate and speaks good English but have no relatives here.

 

The proposal is to simply even the balance.

 

 

Just increase the number of immigrants let in from all categories until we catch up, I am not intending to put a delay on the other categories. I am not asking for them to delay spouses or minor children, etc... 

 

Just don't see any good reason why it is going to take 15-20 years for her brother/sister to be granted a visa. If they are offering that visa it should not take so damned long! Perhaps they should increase the income limits for petitioners to be at a median USA income level, not this poverty level they use now.

No amount of work will change that. It's a function of the limits imposed by law combined with demand, not processing speed.

 

Edit: Even if both USCIS and DOS increased 10-fold, facilities, and all related systems, the total wait time would only (directly*) decrease by a couple months out of the ~15+ year wait.

*I say directly as it would actually have a side effect that would also somewhat decrease wait times - less people being covered by CSPA means less visas issued to both F2A and derivatives, and therefore more visas available to others.

That would require the support of both chambers of Congress and the president (or a super majority in Congress). It's not happening, period.

 

The only way to decrease the wait for siblings (F4 category) now would be to make another category wait longer.

Immigration to the U.S. (or other countries) is a privilege, NOT a right.  No one is entitled to a visa, even if they have family, or a great education.

 

The harsh truth is simply that not everyone who wants to immigrate to the U.S. can.

The fact is that the siblings I am bringing in CAN immigrate. It’s just wrong it takes 2 decades to process. Increase category 4 allowance while leave the others the same. 

 

Immigration is a basic human right. Not a privilege.

Canada...but the rules around it are extremely strict in detail....sibling has to be under 18, AND not married or in a common-law relationship, AND both parents must be deceased.  With siblings over 18, only allowed if the Canadian sponsoring has NO other living relatives already residing in Canada as a Canadian citizen or Canadian permanent resident.

 

Failing to meet the criteria above, the sibling would have to apply for immigration on their own merits/other ways.

 

So not as wide as the US's generosity in allowing sibling sponsorship, as you can see.

And that is why a lot of people come in and get married to a US Citizen. So they can then bring their family members in. That’s what is making things so hard for most of us. I’m sure they’ll work on that time frame for you.

Be glad you are not from India, Mexico, or the Philippines. The current wait time is 20+ years to bring a sibling.
