Hello guys,

 

My fiancee and my (biological) son had their K1 visa interview this morning and they have been denied.

 

The reasons: Original copies of Affidavit of Support, More proof of relationship and copie of divorce decree.

 

I am confused! I have been communicating with the Embassy for a month about what documents to submit and they have never mentioned "copy of divorce decree" even the affidavit of support was mentioned a week before the interview just because I kept asking them if I had to submit that and they told me NO at the beginning!!

 

I have visited my fiancee twice in less than 10 months. I have even traditionally engaged her and organized a party for that. Pictures were submitted! Plus we have a son together!! But they are asking for the proof of relationship!

 

Please guys, help me! What can I do ? What type of proof will be more than a son , engagement party with a turnout of  almost 60 people and proofs of meeting twice in person for less than 10 months plus copies of financial support thru western union can I submit?

 

Am I missing something apart from the original copies of Affidavit of Support? I would like to add that 2 days before the interview, I scanned the Affidavit of Support and asked if they were accepted and if we were good to go for the interview and they said yes! But surprisingly everything has changed at the last minute! Please help me with your ideas guys!! I am really disappointed right now!

Were they denied or given administrative processing until they get the documents? 

 

Those are pretty  standard documents, the original affidavit and the divorce decree.

I mean they were given administrative processing... But why are they asking for divorcece decree? All the documents were submitted with my I-134 package. They should normally have it with them.

Another option would be to marry her in her original country, and apply for a CR-1 marriage visa.

It doesn't sound like a flat out denial, they were just put under AP because of the missing documents. Submit the original affidavit of support and divorce decree and see where it goes from there. 

 

It's a bit strange that they would ask for more relationship proof, but you could also provide things like passport stamps, receipts from when you were there with her, and your son's birth certificate to prove you are the biological father.

I advise you to cancel this case because the administrative verifications can take more than two years. The documents will be returned to the usa and go around I know something I was victim of this.

The divorce degree was among the documents that we submitted at the USCIS. Please read my post before answering! The USCIS approved my case 2 months ago. The case is now at the Embassy. The USCIS knew when my fiancee was 6 months pregnant until the day she gave birth! And they had told me what to do for my son. What about having met with her twice in 10 months?? Is not enough as proof of relationship? The original copies of Affidavit of suppory makes sense because I had faxed them to the embassy. But more proofs of relationship does not make any sense to me.

 

Now, all the documents we submit with the I-134 application are all forwarded to the NVC and then to the Embassy. But why are they asking about that divorce decree now?!!

OP Soumettez simplement ce qu'ils demandent ... complètement et complètement.  Est-ce important pour cette raison? Voulez-vous votre fils et votre fiancé ici? Ensuite, il suffit de leur donner ce qu'ils doivent être approuvés.

You are coming from a tough Embassy, just like many MENA countries. Divorce decrees, most of the time, have to be shown at the interview stage also, many embassies or consulates go by this and having a child is not solid proof but just provide the documents they ask for and you will be just fine.
