  1. Hello everyone, Me and my partner filed for K1 Visa in October 2022 and never heard back. We never received our NOA1 and they never cashed in the payment, even though we have confirmation that they received our I-129F application. Now I'm planning to visit him in the States in April (using my ESTA) and he wants me to stay, get married and file for AOS. I've read that it might work but I'm also worried since we have already previously filed for K1. But since we never heard back we might not even be "in the system"? Thank you all for any advice you might have for us!!!
  2. Hey, I just received and RFE from local FO saying "Submit evidence [my name] and [my wife's name] share a marital life together. It should cover the time period from [Marriage Date] to the present etc." But the thing is we have been married for over 2.5 years and also submitted bunch of evidence when we filed in December 2021, such as lease, credit card statement, bank account statement, renters insurance, photos, jointly filed tax return and such. So, I am not sure why would USCIS will need evidence from the day we got married rather than the day after we filed which was a year ago. Should I resubmit all the documents already sent again and just add updated bank statement and leases and stuff? Thanks for your help
  3. Hello everyone, hope you are all having a great start to the New Year. My fiancée and I are getting married in a week and we will be sending off our AOS package as soon as possible. We currently have most forms filled out and have most documents gathered, just waiting on a few that have to wait till we are married, such as marriage license and our health insurance plan together. My fiancée came to the US on a J1 visa (no two year rule requirement) Here is the list that we came up with and I was wondering if someone could review it to make sure we are not missing any of the required documents.   4. Hi. I also received this notice stating that my income doesn’t meet the minimum requirement, but according to the Poverty guideline chart my income is adequately above the cut off value. And they are asking me to submit a joint sponsor even though my father, household member is adding his supporting income. What do I do in that case? Appreciate any input!

Hello all, I arrived to the US last month on a K-1visa, got married and currently and the process of filing paperwork for AOS I’m starting school next month, so I needed to get a driver’s license. Turns out I can’t do that without SSN. Then I read that here in Florida I’m allowed to drive on my foreign driver’s license if l’m enrolled in a in-state college. Next issue was auto insurance. Unfortunately, insurance company told my spouse that they can’t add me to the policy as a driver unless I have international driver’s permit, which I don’t (although I have a certified translated copy of my driver’s license) Are there any alternatives that would allow me to drive while waiting for my Social Security card? Thanks
  7. I searched on the topic and saw several people already posted about this topic. I want to know if recently someone experienced USCIS home visit? I married a US citizen and currently my 130 , 485 is on process. AOS from Tourist visa to green card marriaged based visa. Does the USCIS visit after the interview? My husband works far from our home so hes renting a room near his work. he only comes every thurs to sunday at our home. So what if the USCIS agent look for him , what should i do? Shall i give his number so they can call him and validate hes working right?

  9. Hello everyone, I was wondering If anyone had any advice. I got an RFE last night asking for more information. I originally included my marriage certificate, but they are requesting it again; is this normal? They also want evidence that we share a marital life. Is a utility bill, health care card, being an authorized person on my credit card enough evidence? Also, we didn't have a wedding ceremony, but it says, "other events", any idea's on what that might mean? Anyone have any advice? Any help would be greatly appreciated!
  10. We filed for my husband's AOS on January 2022, our timeline goes something like this: January 2022: Filed I-130, I-130A, I-485, I-765 and I-864 in the same package. Two weeks after we got the I-485, I-130 and Biometric receipt. February 2022: Biometrics appointment March 2022: Received EAD June 2022: Received AP (we filed these last two separately without knowing it could all be filed at once) November 2022: Received a RFE and sent evidence two weeks after December 2022: Evidence and I-130 approved, BUT the I-130 approval letter asks to file a I-485: "The petition indicates that the beneficiary wishes to apply for adjustment of status to that of a lawful permanent resident. They should submit a copy of this notice, along with a Form I-485, Application to Register Permanent Residence or Adjust Status." Does anyone know why this is being required again? Or is it just a template and our I-485 is actually being reviewed now? Our assessor says we don't need to worry since the USCIS clearly already received our I-485 and has been paid for, but I can't find any information on this online. Any suggestions on what to do?
  11. I had the green card interview in the end of June 2022, was told to expect the card within 3 weeks. Happily came home and waited for the status to got updated. Nothing happened since then. The online status is still "Interview was scheduled" till now. One time I got to talk to USCIS service representative, she says USCIS has to make a decision within 120 business days so I can call back after 120 days. I marked the 120 business day deadline on my calendar and called back today. This time the representative says there is no 120 day rule, I will have to wait for 16 months until I can schedule a info pass. Thanks in advance for any advice!
  12. Hello! We applied for AOS and immediately got RFIE for our form I-864. I am very confused why, since my husband’s current income is well above the 125% guideline (his last year income shown on his most recent tax return was not sufficient tho). We provided his employment authorization letter with his current salary and his bank statement showing his salary transfers for the past 6 months. We also provided his full tax return, tax return transcripts and all w2s he had for the most recent tax year. Now we got a joint sponsor but reading the rfe I realize that maybe there was some mistake that triggered it and the inly thing I can think of after going over the copy of the form we have, is question 24a-24c: “My total income (adjusted gross income on Internal Revenue Service (IRS) Form 1040EZ)“. My husband is self employed, and we put his adjusted gross income from his 1040 there (line 11 on his form 1040). Maybe this was our mistake and we had to put the total income from the line 9? Please enlighten me, should we put his total or adjusted gross income there, we are worried that that putting his gross income was the reason of him “not qualifying” and genuinely not sure what line we should use there for our joint sponsor as well and if we have to refill my husband’s I-864 together with our joint sponsor’s affidavit
  13. Hi guys this is going to be a long post so bare with me. I came to the US on the 27th of October this year. I am German. My boyfriend and I are long distance. My flight back home would’ve been the 17th November.(I am from Germany) We decided that we wanted to get married because we didn’t want to be separated again. We heard that filing for AOS May be an option. I had no intent staying here because I have two sick parents in Germany and bills to pay. (I am unemployed but I still have important appointments that I now have to cancel in Germany) I am very anxious person that’s why I’m asking so much. Which documents do I need every website tells me that I need different documents. Which evidence do we need? Can we file I-130 and I-485 together or do we have to wait for I-130 approved because I don’t have a an alien number. Can we still file for I-485 even if we’re married less than 2 years? How do we file I-485 concurrently if I do not have an alien number, and it says we have to attach a copy of the form I-767 but we don’t have the copy if we don’t file for I-130 first If we have to file I-130 separate how am I protected from deportation if I’m out of status Do we need an immigration lawyer? I don’t want to make any mistakes and it will be denied because of making mistakes Do I have to do the medical right away or can I do it a few days or weeks after my initial application because I want to file before the 24th of January so I’m not out of status Another thing regarding the medical I heard you should never disclose that you smoked (even if it was once) or are smoking cannabis even if it’s legal in that state because you can fail your medical because of that, is that true? What if you fail your medical in general can you get another one or will your application be denied, and if it’s denied do you have to go back to your origin country? Also on my ESTA I answered the drug question with no (if I would’ve ticked yes my ESTA would’ve been denied) even tho I did Cannabis a few times in my life so I don’t want to put yes on the drug question of AOS application when I said no on my ESTA because I don’t want them to think why did she say no on ESTA but not on the AOS Application I am currently taking 3 medications for my depression could it effect my medical negatively Another question regarding the medical I have mental health problems and I self h4rmed in the past. Would it make me inadmissible for a green card because in the USCIS Rules it says no mental illness that could cause harm to you or others. It caused harm to myself. But not anymore. How long does it take to assemble the package? I want to file before my I-94 runs out on the 24th of January. I know people can overstay their ESTA as a spouse of an US Citizen and it can be forgiven but I don’t want to overstay because I’m scared I could be deported (I’ve heard one horror story here on visa journey where a person got deported even tho she was in the process of filling but hasn’t got his/her NOA1 yet) What if we fill out everything before the 24th of January and I send it before the 24 January but it will arrive after the 24th January then I’m out of status and have overstayed but on my application it will say that I have not overstayed. Do you get what I’m saying? I just don’t want to get in trouble I was also put into secondary when I arrived here in the US could this affect my application? If I need to overstay because we can not file before the 24 January do we also have to send that one waiver of inadmissibility What if the AOS from ESTA doesn’t work out will I get a ban? I’ve also read many different stories about it being legal or illegal even from lawyers When we get married and I decide to take my boyfriends name, on my passport and id has still my old name how does ist affect the AOS filing? Is it shady that we’re getting married so quick? In January we are together one year but we saw each other 3 times in that year and have tons of photos etc together and we wanted to get married sometime and we decided to do it now Sorry for rambling so much. I am just so scared that my bf and I have to be separated again or that something will happen and I need to go back to Germany. Thanks for reading and thanks for your answers in advance.
  14. Hi all, has anyone here ever being asked to have an appraisal done in their house as part of requirements for aos and greencard application? I know over hundreds of immigrants but have never heard of this except from the lawyer of a friend. According to the poverty guidelines you need to make about $34k for a household of 4. My friend has his own business and makes way more than that also have 100k on savings but aside from a bank statement and itr his lawyer advise him to get his house appraised to show equity of his house. Is this really necessary?

  17. Hi, i just received our rejection notice for my green card application. I applied for a concurrent filing i-130 and i-485 (from tourist visa). It was rejected due to missing one page. Which is i completely sure i submitted all pages and the missing one page is the page 16 of i-485 where i signed. All documents submitted were returned with their initials and barcode st the bottom of each documents. My question is do i need to print all forms and supporting documents? Or only the i-485 which is they told me there is missing page. And when i checked the updated forms online the i-765 and i-131 has oct 31, 2022 edition. My i-765 form is july 2022 edition but valid til jan 2023. So im confused if i need to reprint it again with the new edition. i hope someone can help me with my inquiries thank you
  18. Hello everyone; I am a US citizen and I have been living in Spain the last 20 years. I got married in Spain to a foreign woman (non-US citizen) and I have just been offered a new job in the US. I can go work there wherever I want, but my spouse can't go live there since she only has a B-2 tourism visa. The company I would work for told me that this is a somewhat frequent situation and that usually the spouse enters in a tourist visa, and then does an AOS. All advice I found on the internet (including this forum) is about getting married on the US on a B-2 visa and then AOS. We are already married so we won't get married again in the US. I have the following questions: What are the chances they will let my spouse in with her B-2 visa? When the ask about the purpose of the travel, she will answer along these lines: "I am married to a US citizen who is moving back to the US and I intend to file for AOS in the near future". Of course we will have all documentation showing we are actually married and it is a "bona fide" marriage so it can be consulted by the border guard when we enter if neccesary. The inmigration consultant for my company states that although the writen law says that B-2 is a noninmigrant visa, in practice all AOS from spouses of US citizens are accepted this way. Anyone had a similar case. If it is not possible, I guess I will pass on this oportunity and then file ourselfs for a CR1 visa and then find a new job on my own. I am just asking if anyone knows other cases like this since if I commit to go there I will lose my current position and if my spouse cannot enter the US I will leave the new position and will be jobless. I will certainly look into this with two or three inmigration lawyers, but would like to have feedback from the community. I will also update with what the lawyers tell me in case this is of use for someone in the future.
  19. This was the recent update I got on the website. Oddly enough the AOS is approved but no updates have been made on either the EAD or AP applications. Does this mean I just won't get those anymore and might be receiving the green card in the mail soon? Will I still have to do an interview? I'm so confused because it just seems very abrupt. The off "cancellation of additional evidence" too is pretty weird as I never received an RFE. I have seen many post on other sites though about interviews being waived. No matter what it is though I'm just glad there's finally movement happening on my petition. Hope the same for all of you!

Hi all, I am a K-2 expired visa holder applying for AOS (see my other posts for more information), I have gotten legal help to sort through most issues, but have a few remaining questions that hopefully the community can help answer. I currently don't have any unexpired photo identification documents. From my understanding, I shouldn't have any issue renewing my foreign passport, and after receiving it, submitting my AOS documents. Does this make sense? Timeline wise, is there any possibility of submitting the AOS while waiting for the new passport to arrive in the mail as it is said to take 4-6 weeks, and just use the old passports/receipt from the new passport(?). I will be submitting photocopies of my expired passports with expired visa (one passport is already invalidated with holes punched, and I would expect them to do the same when I renew to my other passport). I understand this is unlikely, as I do not have any other valid forms of photo identification. My ideal plan would be to renew my passport in the next week, and submit my AOS after my medical exam in the next 2 weeks. Thanks for the help, and I look forward to hearing back.
  21. Hi I am an international student married to a US citizen and waiting for my interview date. But I have been issued an EAD since March 2022 and advance parole in October 2022. I am still in F1 status since I have not used the EAD, but now I want to use my EAD because I have an internship/Co-op position I need to purse before graduation. I was told if I work with my card, I won't be on F1 and will face consequences that might relate to my green card application for being out of status while awaiting green card. my EAD says I do not have any restrictions on it. What would you advise me to do? Thank you as you provide answers for me.
  22. Hello, I have a questions on form I485, doing AOS for mom. Part 1 2a: did you mention your mom's maiden name? My mom doesn't have any document to show this, so will it be better to leave it out? Part 2: 3 and 4, do we get this right away after we submit I130? I have not yet submitted it? or do we need to wait until we have these numbers? Part 3: 5,6,7: Address history, my mom travels alot, and stays for extended period like 3-4months with my other sibling in a different country. Do we write her addresses from travel history or this only refers to addresses that are domiciled home? Also, do we need full hisotry of I94 or just the latest I94.

Question: Do I need to apply/eligible for INA 245(i) and do I need submit Supplement A to I485? Appreciate any inputs. Thanks!
  24. Long story short, married spontaneously while he was on his trip in the US to see me, now he’s my husband and is here and we planned to adjust status. We spoke to a lawyer to get rid of some doubt who said we had to wait three months after we marry to submit the CR1 + AOS paperwork. I thought it was immediately after receiving the marriage certificate one could send in the forms? Does anyone have any experience with this?
  25. My fiancé and I are finally together and getting married this Friday! I wish it was as happy a time as it should be, but this whole Adjustment of Status thing is hanging over me. Our deadline for marriage is the 26th of November, and I know we have to apply for the AOS before then. So we're getting our civil ceremony and marriage certificate appointment on Friday, the 21st of October. What happens if they don't give me the certificate by then? And these fees are killing me. I make a good wage but I live in California, so I don't actually make a good wage. I'm supporting my aging Father after he lost his job, so I'm worried that I might not have the funds for the fees in time. I've seen lots of talk about people filing for an AOS very late, but still married before the deadline, and they seem okay. Is that possible or should I start panhandling now? 😅 Thank you all for your help and please be kind, I know I probably sound like a dope who's way over his head 😂
