As noted above, if filed under the 3 year rule and are no longer married, then the N-400 must be denied. Whether that occurred after the 5 year period or not doesn’t matter...just that it was filed using the 3 year rule. So withdrawing it was correct.

But yes, no issue filing for naturalization now, assuming he meets the other requirements still.

Mindo2019 reacted to aaron2020 in Does Immigration automatically result in dual citizenship?
Immigration does not automatically result in dual citizenship.   US citizenship is a choice.  After meeting the 3 years or 5 years residency requirement, a green card holder can choose to apply for US citizenship.

The US does not care about dual citizenship.  There's no law allowing it, and there's no law prohibiting it.  Therefore, it's okay to have multiple citizenship from the US Government's point of view.  The US will only care that you a US citizen and ignore your other citizenships.

Some countries like Germany, South Korea, etc. do not allow adults to have multiple citizenships.  This is why people from those countries will choose not to become US citizens as their home citizenships would be lost.

Canada allows for dual citizenship.  Nothing will happen to your Canadian citizenship when you choose to become a US citizen.

Funny how your sister inlaw and her lawyer were comfortable getting your sensitive personal informations such as ssn,tax returns yet she is reluctant to give just a simple case number. Well if you have her full name and address you may want to use that and contact uscis, call or go for an info pass if it's possible where you live.

You’re right! leaving my own minor 11 year old child behind to look after someone else’s child does not fit my mindset.
But the actual point was your phrasing of “had to”, no-one is being forced to do anything here - it is all your choice of what to do.  You could equally say you “have to” return to your home country to keep the extended family in one place. Your choice, nothing forced.

When you fill out your email address on I-130. After USCIS approved the I-130, NVC will send the welcome letter and instructions to that email. If not, they will send it to paper mail to your address.

Based on your timeline you are still within normal current processing times. K1's can take 9 - 12 months to complete (especially for difficult embassies like Ghana). Based on that, an estimate is between now and the beginning of next year. So your efforts to get them moving faster is futile.

    (From my blog)
A Warning To Green Card Holders About Voting
Do not register to vote in any election until you have officially been granted US Citizenship.
Going into this election season, it is very important to understand that for a Green Card holder, (Lawful Permanent Resident) to register to vote is not only improper, but can have severe consequences in the future.
Even though there are States that have instituted policies that do not require evidence of US Citizenship when registering to vote, the voter registration documents do ask whether the person registering is a US Citizen. Many have simply checked the box and gone ahead and registered, knowing that even if the State Law requires showing government issued identification, their driver license will suffice.
While this is not legal advice, the publicly searchable “9 FAM” (Foreign Affairs Manual) is quite clear regarding the potential consequences of falsely claiming US Citizenship. There is no more serious a misrepresentation, based on the consequences, dealt with in 9 FAM. The potential consequence of registering to vote or for any other federal or state benefit afforded only to US Citizens includes Deportation and a LIFETIME BAN from entering the USA.
If any reader who is not a US Citizen, has registered to vote in any official State of Federal election, I advise them to seek competent legal advice as soon as possible, to discuss minimizing or eliminating the risk of any future deportation and ban.
The law is, what the law is. Regardless of whether this particular or any other immigrant related law is being consistently enforced today, that can change at any time.
False claims to US Citizenship are taken very seriously by Customs and Border Patrol Officers. Some years ago, I was traveling with my step daughter, when we encountered a border check station on Interstate 10 in West Texas. My step daughter was quite proud of passing her citizenship test just the day before, and proudly answered yes, when a CBP Officer asked if she was a US Citizen. I quickly corrected her, so the officer would hear me, saying, “You WILL BE a US Citizen after your swearing in ceremony, but you’re aren’t a citizen yet.” Fortunately, the officer was understanding and we were soon on our way without incident.
Many have registered to vote, somewhat “innocently” because of the misrepresentations or ignorance of well meaning officers at the DMV (Driver License Offices) or even a campaign worker.

Hey, I don't fully get it - German myself. If you can stay in Germany by finding work and you want to stay there, then I would suggest you to find a job in Germany. Obviously without advertising that you intend to leave that job once you get the visa approval. Even if you get a one year work contract, you usually agree to a probation period/Probezeit (usually 6 months duration) with a shortened notice period of 2 weeks, and after that you usually have a notice period of 3 months. 3 months seems very reasonable?! Especially if you have 6 months to go to the states.
Edit: notice period by german law for a job after probation is usually 1 month unless otherwise agreed upon.

Firstly both you and your husband would need to provide affidavit of support that would then show that there is 90K around to support your mother. 90K is actually pretty substantial based on the guidelines as it''s more then 250% of the poverty line. Obviously though it's hard to say the bar being placed or to predict the future and it also comes down to a number of factors.

If you are supporting others like the other children this will affect your case. Your mothers current health will affect, ability to pay for health plan. Her ability to work and history of work will matter too. it's a very comprehensive set of things that are looked at, a number of factors.

All that said I'm no legal expert to say how a consular officer may assess the situation, but you certainly don't have a bad case to present here. This could go either way. For sure if your mother is uninsured and has a major medical issue the 90K a year would likely not cover that, but then again even making a $1 million a year in U.S you can still run bankrupt on medical expenses and so you would hope the assessment would have some level of reasonable review, but like I said hard to assess what a consular officer may or may not do, their ability to adjudicate the situation is pretty large scope.

Just another anecdote, my mother was a very healthy woman up to one year ago. She had no chronic medical issues and exercised 1-2 hours daily. One morning, she slipped while exercising and injured her neck. She was admitted to the neuro ICU, ward bed, then rehab. In total, she was institutionalized for 5 months. The cost of her care exceeded $500,000. Fortunately, we live in Canada with a public health care system and it ended up costing only parking passes. However, this forever reminds me how fragile we really are.

Unfortunately, life can be unpredictable. You can be very healthy today, very sick tomorrow.

I do realize because I used to work as a visa analyst back home and I was trained by the government as to how deal with all information and documents provided. What questions to ask and what assumptions to make.

When filling the DS160, the applicant already reveals plenty of information about themselves. What they do in their home country, the people they need to support, who will be paying for their trip, relatives living in the US and their occupation. What kind of document is required at the interview is at the discretion of each officer. Add to it the fact that the legitimacy of papers shown at the interview needs to be verified and that takes time.

Either way, I wish you luck in your immigration journey. No one can tell you for sure what the outcome of your application will be but hopefully we have pointed out concerns that you can now address and cover so that when the time comes, the IO will be satisfied and grant your mother her visa.
