    For my previous packets, I was a little more diligent in not using paper clips, but putting the application and evidence in separate clear plastic dividers.  This go round, I didn't have any dividers, nor paper clips, so all the pages are loose.  But I did still include a cover letter explaining what was in the packet and how many pages to expect for each piece of evidence.

    Failure to apply for the SSN is the underlying issue and as many have said you don't need a SSN to get insurance. You might have to do it by phone (that's what I had to do) then update once the SSN is here.

    A WoM, especially against the consulate, is not something I would recommend without the assistance of a lawyer. This is a highly technical process outside the realm of somebody not experienced in this area of law.

    Previous marriages, arrests, and criminal history should be discussed... Not only because you'll have to disclose them, but also to start your new relationship by being open and honest with each other.

    You should not make life decisions based on immigration policies. Rather it is best to live you life the way you want and deal with the policies that apply at that time. Are you ready to marry>? If there were no rule changes upcoming would you still get married right now?

    3) File for AOS.*
     
    * You can file for AOS after the 90 days from POE just fine. But to maintain lawful presence the entire time (preferred!), you would need to file for AOS within that 90 day period as well.

    Something I learned a long time ago and it continues to be true today. He who has the gold makes the rules. You don't have the "gold"  and therefore you may face stiffer penalties from the one who has the gold.  
     
    Oh I see you have another post about not understanding why you need to fill out a I-134 when "most" of that information is contained in the I-129f. Your building yourself a reputation.

    Because when we began dating language wasn't a barrier. It was much easier for us to conduct our life in Chinese. We initially didn't have plans to have our life in the US but things change. She can't speak English yeah it's a minor inconvenience, but in the same way I learned Chinese while being in China, she will learn English while being in the US.

    It does not guarantee anything. But somebody who has a stable job for years is much more likely to ensure a beneficiary will not become a public charge than somebody who only has a promise that they will be granted employment when they return. The CO looks at the totality of the circumstances and makes a public charge decision.
    The US Government needs an actual assurance that somebody will be responsible for them and capable to provide for them so the general public is not left with the bill.
     
    As you are not currently earning income (unpaid leave), your I-134 would have to claim $0 in current income.
    You can get a co sponsor.
     
    I'd suggest not waiting on filing AOS  -not just because advising somebody to violate immigration law by overstaying is against the TOS, but there's a few reports of ICE agents making visits now. Plus the usual risk anybody that overstays faces. The stress and financial costs if that happens is never worth it.
     
    Whether you're a 7th gen USC, 15th gen USC, or 1st gen USC makes absolutely no difference. I don't even know why you would bring that up...?

    Being a 7th generation American does not entitle you to anything.  Laws are laws.  The law applies to everyone equally; even if you don't understand or like them.
     
    The laws are clear.  
     
    Your attitude that you are not concern with AOS and think that you can do it whenever you want is naive and disturbing.  It shows that you don't understand that people have been arrested and locked up for weeks because the US spouse failed to understand the system and follow the rules.  

    Comply with the system if you want a visa.  Don't expect the US government to bend to your understanding or your wants.  You need to accept that they are in charge and you have to do what they want.

    This is the harsh reality of the US immigration system.

    They currently have no legal status to be here and they are at risk of arrest and possible deportation.  You need to do whatever it takes to get their AOS paperwork filed ASAP.
     
    A lecture:  It is on YOU the USC to take care of the people you are responsible for and it is your (all of our) moral duty to get this done.  It is fundamentally wrong to bring someone here to our country and put them in immigration limbo.
     
    While you are at it also file for EAD and Advance Parole so she can work, drive and travel.  Even one unnecessary day of that type of limbo is also wrong.

    The AOS filing fees are a drop in the bucket relative to the actual living costs and sponsorship requirements for a spouse and child.
     
    File as soon as you can. The sooner you file, the sooner your spouse can work - even a few hours - to help if needed. Also, the costs associated with not filing and dealing with immigration court + a lawyer is much higher, let alone not a good experience.

    There is no way you guys should take that chance if she does not have the AP or Green card at that time. 
     
    Also there is no fee for the AP (and EAD) when filed with the AOS the fee is waived. You can still file it and get the fee waived with a copy of your NOA1 from I-485 but it will not arrive for October.

    Our DCF instructions required bringing the affidavit in person to the interview.  It is highly likely that yours also says that.  If you know you need it and do not bring it with you then chances are high that you will have to go back.
     
    Your joint sponsor will be needing to provide it to you to bring or you will need a sponsor who trusts you enough to provide it.  No amount of frustration or all caps posting will avoid this requirement.
     
    Option 2:  Wait until your spouse has the means and financial ability to sponsor you.

    I would find another willing, qualified joint sponsor and have everything ready at the time of the interview. It sounds like your joint sponsor is hesitant.

    "Still figuring it out" is not gonna fly. It is not a selection of items you can pick off a menu.
     
    Yes there are a lot of people who apply for asylum but have you seen the approvals? Asylum has a high rate of denials. It is because of the high amount of fraud. Which, if you are saying things like your are "figuring it out", it means you don't have a legit reason and this will raise suspicion.
     
    So if you haven't "figured it it" by now, I can tell you now applying would be in vain because you will likely get denied.

    Easiest solution to avoid even the slightest possibility of denial would be for your husband to move, and you visit him while your N400 application is pending.
    After approval and with a US passport in your hands, then move to permanently/temporarily live with him abroad.

    I assume the immigrant was a German citizen? How did she not have a choice? 
     
    I immigrated from Germany and my then husband lived in Florida. Well we were separated but it was doable. I don't understand how the beneficiary had no choice?
