Child left off ROC and Naturalization

Hi guys, I am asking for a friend. She needs a some advice, as when she applied for ROC she left off (did not state on forms) her kid from wedlock coz she's not living with her. And so she got approved for ROC, now she is applying for Naturalization and she is thinking if she'll do the same thing? Since she did not put the daughter on the ROC. Will this cause a conflict on her case if she'll tell the officer on her interview?

Probably. They will want to know why your friend lied on her RoC, since the instructions clearly state to include all children regardless of whether they live with you or not.

Will raise some questions, yes.  Likely questions on where the child is living now, and whether she's supported the child.  And of course why she never mentioned the child on the previous ROC.

 

Curious....if the child is not a USC, is she planning on sponsoring the child after citizenship?

Was the child not included in the other papers? CR-1/K-1/AOS?

 

I would put the child down and then try explain at the interview. The child not being with her is no excuse to not list the child.

They will go through her entire immigration file, yes.

No, She’s not in good terms with her ex.

She said she put her daughter on CR1 not on ROC and Naturalization.

Well she better get that fixed for the interview. They will question what happened to the child.

There's also the part at the end of the application form where the applicant swears by signing that everything stated is truthful and accurate---so it would be a misrepresentation on her part to NOT list the child.  She will also swear again infront of the officer during her interview that everything stated in the application and during her interview is truthful.

 

She needs to disclose the child's existence at the beginning of her interview.

Yes she has to tell them right away at the interview. and be ready to explain why she left her out.

Good luck to her.  

 

If she has been financially supporting the child, she should also bring any proof of those support payments to her interview (whether court-ordered or not)---the IO will be interested in that, as well.
