    Ok, I see I might have caused some offence while that was not the intention at all. 
     
    English is not my first language, more like my third actually, and is far from perfect, I definitely speak with an accent that immediately reveals my Slavic origin. My wife-to-be was born in the Philippines and speaks flawless, accentless American English which I am jealous of! 😜
     
    But it looks like that my initial response to this topic launched an off-topic discussion, which I didn't intend, so please ignore what I said.

    Venue does not a wedding make.  Someone's backyard,  hot air balloon,  street corner,  mall, or even your kitchen.  The list of possible venues is endless.  For most locales it is the bride, groom, qualified officiant and two witnesses 
     
    If I needed to, I  can marry two people in under one minute

    Highly agree.  My wife's and I wedding happened on Halloween, so it was definitely a party afterwards!

    Courthouse weddings with a party afterwards are WAY more fun (I say that because that's what we did, and it was fun!). You can dress as beautifully as you like for the courthouse wedding, bring a couple of witnesses, whatever, and go out to a nice supper afterwards, then plan a big party. Weddings cost so much; people in the US sometimes spend the equivalent of half a house on a wedding which, to me, is a complete crazy waste of money...but it's important to some, so whatever floats your McBoat. 😀

    Unfortunately, this is not uncommon. It happens. They may think that you were of a high risk of using the visitor visa to stay instead of filing the usual way. This is the most common reason for those type of entry denials. It raises the risk if you have a love interest in the United States. They may think you are simply moving here instead of visiting.
     
    To be successful for a visitor visa the applicant must show that they do NOT have immigrant intent. Kind of hard to show that when you have a fiance or spouse in the US. Also, if they see you planned to stay here for several months with no job or responsibilities in your home country to return to... it makes it harder.
     
    Fortunately, it shouldn't have a bearing on your K1 unless there was something big like misrepresentation. 
     
     
    The above in bold May have actually been the problem with her tourist visa denial. The most important thing people must remember with visitor visas is to prove why you must return home. The officers don't care why you want to visit, they want to see why you need to return to your country. Showing an ongoing relationship with someone in the US only makes it easy for an officer to deny a visitor visa.

    Indeed, that's the best way, the only way, really, you can streamline your wait time to as short as is possible (that is in your control, I mean): to have everything exactly as it should be and don't leave anything off the list. Check and double-check, and make copies of what you send, so you'll know, "yep, I sent that.' Time gets added on when you get a notice that you've not sent a document they asked for, or filled out something incorrectly.

    My husband was baffled. Why would I wear jeans at a such solemn event? on this very day I became an American?
     
    little did he know,  I wore it to honour my aunt, who was killed by the Chinese communists over a pair of blue jeans.
     
    My dad escaped the Chinese civil war and arrived in Hong Kong, left behind two other  siblings who remained in communist controlled China. Dad worked few odd jobs so that every time we visited our relatives, we would be able to bring necessities, be flour, rice, clothes, radio or even salt and sugar.
     
    I still remember my dad's loud cry when upon returning to China, he learned my aunt had committed suicide, over the very pair of jeans he brought her from Hong Kong.
     
    Only when I grew up, I heard the story from my cousin that auntie Mui lost her life to the heydays of cultural revolution, when every single wrong doing could land you in jail and every little mistake earned you a good beating.  Jeans in all the madness became a gesture of contradicting  supreme leader Mao and a symbol of supporting American Imperialism.
     
    So her very friend and comrade stripped her and did the unthinkable and unspeakable in public.  My aunt couldn't take the humiliation and took her own life the same afternoon.
     
    As years go by, all my families escaped communist China and landed in Hong Kong, Aunt Mui was gone, but she was never forgotten. 
     
    And that is why I wore jeans, a indisputable symbol of Americanism at my oath ceremony, and if aunt Mui is above there somewhere watching over me, she knew I did it for her honour.

    These are the questions I ask when trying to understand the circumstances of a case.
     
    How did you first become acquainted?
    How many times did you meet in person?  For how long each time?
    What is YOUR age?  
    How many times have you been married before?
    When was your last divorce? (if applicable)
    How many unmarried children do you have under age 21.
    What to you do for a living?
    How old is HE (your spouse)?
    The four questions that followed the one about your own age.
     
    When a visa has been denied and you are expecting a Notice of Intent to Revoke from USCIS, I always suggest the foreign spouse immediately write a detailed report of everything that happened from the time they arrived at the Consular Unit until they left, including every question asked, in order, and every answer given.
     
    Without this information anybody trying to help you at this stage is really just shooting in the dark.

    Interesting question. And I will give my honest opinion here and I apologies for offending anyone in advance.
     
    I have never had the dream to move to the States and I am not moving to America for the American Dream. I'm moving there to be with my love.
    If life worked like a fairy tale and we could wave a magic wand a go *poof* he'd be moving to the Netherlands, cause in my honest opinion our social system works better. But reality is different. He is a single father to four, their mother deceased. He is all they have. Moving to the Netherlands would mean leaving behind his 19 and 23 year old and uprooting his 17 and 15 year old. There's no way I could do that to them.
     
    The American Dream to me is a historical one. Back when Europe was in such a bad shape, ripped apart by war and famine and America was an up and coming nation with great opportunities. A time where an impoverished Irishman could get on a boat and become rich by nothing more than hard work and determination. I don't see that any more. I see a lot of hardworking and determined people struggle to pay rent. Often working two jobs to keep food on the table.
    Perhaps the dream is still alive for countries less fortunate than western European ones, but I can only speak from my point of view.
     
    That being said, I have come to love the country and the people. Yes I still see it's flaws, but I also see the wonderful things. Things you do better than us Dutch or Europeans. I love how open and friendly every one is. How sociable. Its amazing to see how the way your communities work together. How when someone falls ill the whole community chips in to help them back on their feet. I love your customer service and overall friendliness. I love how neighbors still know each others names and help out when the dog needs walked or a tree needs cut down. I love the landscape and the wildlife. I love the fact that there's still so much uncultivated and even unchartered land. I love how most people still know that milk comes from cows and you need chickens to get fresh eggs. People are more self reliant. More resilient.
    And again I only speak of my own experiences based on a few small Midwestern towns in rural Indiana.
     
    All in all I cant tell you, I have traveled all across Europe. I've been to Belgium, Germany, Check Republic, England, France, Luxembourg and probably some other countries I forgot. But I have never felt the way I felt when I came to America. It felt like coming home.

    Horrible advice. Fiance visa is strictly for people who are ready for marriage. 
     
    If you're not ready your it option is b2 - tourist visa.

    You need to bear a few things in mind.
     
    To enter on a Tourist visa with intent to stay is illegal
     
    To work on a tourist visa is illegal
     
    And both are against the VJ ToS.

    You guys are already married. You can't get married again unless uou divorce each other.
    I think you may want to renew vows infront of family and friends. You don't necessarily need to go to a court house for that. You could book a nice chapel or have an intimate back yard celebration. Just my two cents.

    You're going to be giving enough of your money away during this process. Don't waste any more of it than you have to. 
     
    It looks like you're from the UK. Great. This will be easier because presumably you already speak, read, write, and understand English. 
     
    You can download all the forms you need directly yourself - you shouldn't need a lawyer or a preparer at all unless you have some seriously complicating factors like prior criminal history or previously being denied entry to or removed from the US. 
     
    Start here:

    Read up and download the first form that your fiance needs to send in to USCIS. 
     
    Whenever you run into anything that doesn't make sense, ask a question here: (there's also heaps of great information here that you can read up on in advance!)

    Do not, under any circumstances, use any company like "Rapid Visa." They take your money to file papers you could easily file yourself, and you still need to come up with all the information and proof (which is the time-consuming part, usually) They can't make any of this go any faster, and they often mess it up or slow it down, because you and your visa are not their #1 priority. You've found the VisaJourney "family" and we'll give you all the help you will likely need to do this yourself.

    You have enough evidence of a valid marriage to continue with AOS on your own. If your divorce is final, you can go on and file the paperwork yourself to get your 10-year card, if you want to stay in the U.S.

    Since he entered on a K-1 visa he can only get his residency/greencard through the original petitioner - that would be you. He can marry this new woman all he wants after you get a divorce but he can't adjust his status through her, he needs to go back to his own country and start a new visa process from there. He has no legal way to stay legally in the US at this point.

    You can also do a Living Will for each other (get the forms online, fill them out for each of you, and have them notarized at your county court clerk's office). Show also anything mailed to you both with both of your names in the address.

    Yep, if you're the US citizen and you fit the description geowrian gave, go to the U.S. consulate with their birth certificates, and have them help you do a Consular Report of Foreign Birth.

    If that's the case, then they probably are USCs. The USC must have lived in the US for at least 5 years - of which at least 2 years were after age 14 - to pass citizenship to the children at birth. Otherwise, they need an immigrant visa and can become USCs once they enter on those visas.

    There really should be an Annulment Forum on VJ, a very common subject.
     
    I see no immigration issues for you, just a Divorce situation and sounds simple, especially if he just signs before or after he leaves.
     
    Consult with a local lawyer.
