Hello All,

 

My fiancé and I have had our application in review since April.

 

With everything going on in Russia, should we wait for our review and interview, or should we try to get her here and seek asylum?

 

It is an uncertain time, and I would like a second opinion on the idea.

 

It seems as if we do not try asylum, we will never get the chance to get her out.

Your fiance does not have to come here to file for asylum.  Other countries have opened their borders to allow Russian citizens to flee Russia.  Have her go there and then have your file transferred to another country.

How did you come to that conclusion?  Has Russia banned travel out of the country?

Not a newbie but lost my old info years ago) I have been through this process before --all the way through naturalization-- This site has always been a great help to me.

Asylum has very particular grounds; simply being "afraid" isn't enough for relief. If you think you have a good case nonetheless, you should consider trying an expedite first on your I-129F while she relocates to a third country. As others have said, if she's never actually been persecuted (arrested), I don't think the asylum, or even expedite, claim has much merit.

Not sure if I understand everything correctly, but there was a similar situation on here. The petitioner expedited his K1 due to the war. His fiance was Ukrainian and they were approved in 4 months. I'll try to find the profile and attach.

 

If it's not the same as your case, sorry for  misunderstanding

So, based on telegram chats, not a single person has been stopped from crossing the border so far.

 

Does she live within 100 miles of the border with Ukraine? Does she have a military-grade occupation (ask for "Voennyi Bilet" / "Военный Билет")?

 

An expedite request is a logical choice here, yes, but so many are getting shot down that you'd genuinely need to have all the ducks in a row first.

Sadly, Russians are treated quite differently than Ukrainians in this war. For example, several bordering countries have flat out refused to accept Russians fleeing mobilization.

 

I'm aware of two successful expedites of Russian K-1s. Both were in March; one fiancée was able to claim Ukrainian heritage despite living in Moscow, and in case of another, American fiancé appeared to have had troubles at the border when visiting Moscow after the war had started.

OP's fiance is not Ukrainian.
