People never have the intention to stay when talking to a CPB officer, now when they go past the arrivals gate that's another story 🧐

 

With immigrant intent or not, OP's fiance was adjusting status in the US and USCIS obviously has a record of that. Even if her sole purpose now is to study and then return to her country, she will need to substantiate that claim if asked at POE, assuming her visa is still valid. What documents is she going to show, if they ask her to show what ties she has to her country of origin?

Most likely would be denied on a F1.  Married to a USC usually shows immigrant intent. (What is your I-130 status) Plus . . .

 

 Is she even registered at a school?  Did she need the DSO to sign off on her travel?

 

Based on your previous posts it doesn't sound like she is adult enough to make life choices.  Figure out what to do on your I-130 and see if she is patient enough to wait.

Yeah that one. She cannot enter on the existing F1 visa even if valid and still enrolled, without DSO/ISO’s signature on the I20 authorizing the travel.

Timeline

She abandoned the adjustment of status application when she left without AP, this is all on her record via the databases and she will be subject to a great deal of scrutiny if she tries to enter with any visa other than a valid immigrant visa.  If you still want her to live with you as your wife, file an I-130 petition for her, the spousal visa process takes about a year.  In that time you will find out if she really wants to be with you or just wants to get back in the US.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I see......My point is that she can not enter the US via the F-1 if she intends to stay and adjust status....and I see a difficult path ahead for her regardless.....good luck to you....

I don’t mean to be harsh s it sounds like you’ve been through lot.  But doing all she’s done in a relatively short time sounds very impulsive or possibly bipolar.  By taking poorly thought out actions she’s messing up her options.  I wouldn’t invest more money in a new plan given the recent track record.

I won’t invest anymore. If she wants to reapply for a gc she’ll need another sponsor and someone else to pay the fees.

Yeah, no confirmation from USCIS yet but I called in recently and they said letters take about 60d for a reply so about another month.

Then as @jeaniecz stated, it is time to think about you.  Since you pulled the I864, you have to start thinking about divorce. As to her, if she wants to come back to the US legally, it will be her journey which may have some hurdles.
