Wife left US before getting advance parole (merged)

I found out my wife snuck a flight back to her home country (well, I had my suspicions as I heard her booking an urgent flight). She‘d expressed concerns about her father’s health (reportedly had a stent put in recently) and homesickness. I-131 was sent out very recently but she left without having been approved for advance parole. She just had to wait several more months. I’m guessing her gc application is now definitely in the water? Anything that can be done to rectify it (would urgent family issues have any weight?) or would she have to start from scratch? Though she has said multiple times she doesn’t really care about a green card so not sure that would happen.

There is a very strong chance that her AOS has been abandoned.........If so, the only solution is a CR-1/IR-1 from the beginning.

Note: Cardiac stents are are pretty routine these days......

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Unfortunately, she has abandoned her GC application. I don't think that her father having a stent (a pretty common procedure) would be considered a medical emergency, and urgent family issues are not considered. If she ever decides that she does wants to return to the US, I believe that she will have to apply for a spouse visa while outside the country. She may have trouble visiting as a tourist due to her past immigrant intent, but I could be wrong about that.

Agree 100%.......imo, the chance of a tourist visa is probably less than 1%....

Actually it would be best to withdraw the I-1864 and let them know she has also voluntarily left the country.

Correct me if I'm wrong, but for the last few posts there has been a relationship problem. Especially when you say sneaked out of the country. Withdraw I-864 like previously planned and divorce.

There are two types of I-130 approval notices. For an I-130 submitted with an I-485 it's the following:

It mentions AOS and alludes to the need for a I-824 for it to be sent to NVC.
