Received 10 yr Greencard being married less than 2 years

I have looked around for a thread on this topic but could not find a recent one so I started this. Forgive me if there is one I just didn’t see it. I want to hear from anyone out there who entered on a K1 visa and filed for aos and got a 10 yr greencard while being married for less than 2 years and how they proceeded with their immigration path. Thanks.

I remember reading about a couple learnt about it when it came to the citizenship and had to route backwards get it corrected and then file roc when it was already too late.. can’t remember details just remember thinking why they didn’t inform anyone for 3 years... so maybe check roc and naturalization topic on it too not just the initial error. Cause the real problem occurs when order of things become apparent.

It's been happening DUE TO ERRORS. File I-90, you don't have to pay the fee as it's due to USCIS' error. You'll have to send the GC back to them but once you get a NOA1 for the I-90, you can take that & go to Infopass to get a stamp in your passport as proof of LPR status. Now is the time to be proactive.

Sounds like you are tempted to keep the 10 year GC and live happy after here not doing ROC and so on.

 

But even though it was a mistake from the USCIS part it was a mistake and it is up to you to correct it. If you don't it will bite you big time in the butt later on.

 

Just file the I-90 (no fee) and get it corrected you will still be a GC holder from the date it was approved.

As a follow up question, in the event this happens, does the card's issue date change when you later receive the correct card? Do you file ROC 90 days beforehand based on the first issuance date or the second one?

The first. You would still be a GC holder from the approved date. He/she will just get a new card with the corrected expiration date.

A friend of mine received the same thing.  I filed for my husband’s ROC 10 months before her and she told me she reveiced her green card without the conditional status.  If i remember correctly, i saw an announcement in the uscis website saying that it was an error on their part and that they these cards need to be returned for correction.

It happens far more often than it should. This isn't rocket science. I understand possible confusion in edge cases (i.e. if the marriage certificate lists a non-Gregorian calendar date), but how this isn't caught nearly every other time automatically via software blows my mind.

It is an error. It does need to be corrected. ROC does need to be filed.

I remember seeing a post (not that far back) with a beneficiary accidentally received a 10 year GC instead of a 2 year conditional one and not fixing this immediately. Like SERIOUSLY what do people expect to achieve in avoiding to correct this error?!!

Not that it’s anyone’s business but no I’m not intending to never file ROC. I’m not stupid. But apparently this IS happening a lot and it’s actually NOT a mistake and people just file ROC when the time comes and move on from that. Some are even told they do not need to file ROC and collect proof they were told so and file for naturalization later on without problems because they did everything they were supposed to. And yes I know the rules so I don’t need anyone telling me what I NEED to do. That is not the question I asked.
