And this advice is not for you as well. Every move he has now is all risky because of that lie. If he really wants to be with his girlfriend he has to take the risk. It's not you or anyone who will decide if he will take the risk or not. It's him.

Op you have received a great reply from other folks. 

 

  • You lied so you face consequences. 
  • You are out of Luck 
  • YOUR US VISA WILL BE A UPHILL BATTLE (which everyone said so)

If you really love your lady, then start planning a resident visa to some other country where you can live with her peacefully.

Marriage is not going to solve anything. Worst case scenario they get married, realize he's not getting a visa and she doesn't want to move to Jamaica and has to go through a divorce. Marriage shouldn't be rushed into without serious consideration.

I know we're beating a dead horse here, but hopefully this can be a teaching lesson for other people reading the forums: Never lie in an immigration process. Not on paper, not to a POE officer, never ever, even if the lie seems small to you. They can come back to hunt you, and this is a perfect example of it.

 

The only viable thing you can do now is to tell the truth. They have everything on file, those 5 times that you applied and got denied, and since in that information, you wrote down that you were married, it is a possibility that they can ask for proof of divorce.

And I'm sorry but 5 times does seem desperate and it can be another issue. You come from a high fraud country and repeatedly tried to get a VISA, and you lied, which is something you now have to disclose.

 

I'd say if you're really serious about this relationship, your best option is to wait, get married and file for a CR1 instead, be ready to have to explain and face an uphill battle. Lawyering up makes sense. FYI, on the DS-260 at the NVC stage they do ask about previous VISA denials and if you ever lied, so it's pretty much unavoidable. 

Continuing to lie can and will probably cause a permanent ban.

08/31/18 Entered the U.S with my husband 

➺ 02/13/19 Husband confesses he cheated, leaves

➺ 02/16/19 Husband decides to abandon the marriage

➺ 05/13/19  I am officially divorced. 

 ➺ 07/03/20  I file to remove conditions on my own     

 ➺ 08/13/21 I finally get my biometrics appointment 

➺ 02/26/22 I got my interview assigned: March 31st.

   The lie has come to your door ,  it will be held against you .  Your basic choices are 

 

1    Try another lie with showing your are divorced from your fake wife.  This has a high probability of blowing up and getting you so you will never come to the US.    Only a pure idiot would try this path 

2   Confess and pray for the best.  This will make you seem like a desperate man and may lead to a full ban or a ban that needs a waiver .  If it is a waiverable  ban then you may be able to straighten this out before your child starts school.  This is the only path with any real chance.  There is a very small chance that it will lead to a quick path to the US.  About the same chance as the Jamaican bobsled team has of getting gold next winter Olympics.   

This will not be over quickly. You will not enjoy this.

How is it disrespectful at all? Someone asked a question and I gave my opinion based off my experience here on VJ. Based off of the username and what happened I gave a educated guess as to where he is from. Because usually doing something like putting your married when your single to try and get a B2 approval is something that people are told to do usually in Africa or the Indian Subcontinent. As someone who has only been on here a little more than 6 months I don't expect you to know that.

When I first started here, I was astonished to see how long USCIS was going to take to process a simple spousal application.  Now I can see why there is such a big backlog.
