Agree. The prior occupant whipped a pen and created Daca... which by all accounts is and was illegal to do, Congress has to do that, yet it's still in effect somehow.... anyways. People are always shocked at how many either, Trump (or administration) supporters are on here, or at least how many people on an immigration site actually are for immigration reform. People really find that surprising, not sure why but oh well, world keeps spinning.

I have been reading the papers and reputable sources online that really tend to frankly, scare me, about the administration's plan for either slowing down, changing, or upping denials of legal spousal visas. I am now on month 9 just about (Nebraska center) for my Filipina wife's spousal petition. With one NOA so far. I am now second guessing myself as if I should have filed in 2015 or 2016. Is anyone else nervous about the news articles, proposals, etc? Again, this is not a discussion to inflame politics. And yes, I am aware that USCIS states the Nebraska center is 9.5 to 13 months, but is that for both NOA? I am confused.

Simply do not worry about anything. If anything like this were to even go into affect it wouldn't be anytime soon.

Timeline

I haven't seen any definitive notice of policy change that will be taking effect. However, my attorney said that since the current administration began, he has noticed that cases for his clients are taking 1-3 months longer on average (at all processing centers he has filed at). This could be for a number of reasons, including the government shutdown and furloughed employees in customs. USCIS and processing offices issued notices that they would be proceeding as normal during the shutdown... It may be more of a circumstantial case at this point in time. Nonetheless, it is a reasonable concern for the future as laws and policies are not set in stone.

actually, times had a story on this, but people shouldn't be worried, if you're going through consular process since, the petition must be approved,

 

Also, it's a greater risk by adjusting your status, because you're at the discretion of the USCIS officer and they don't have to give a reason for a denial. 

 

Consular processing, the risk isnt there, and they must give the applicant time to correct the issues.

That sounds backwards. Refusals of AOS must be substantiated, and a refusal can go through the court system. IOs absolutely do have discretion, but in no way moreso than a CO does in issuing a visa.

CO decisions are protected by the doctrine of consular nonreviewability. Not only do COs have discretion, but their decisions are not bound by judicial review.

Ok, so where is the link? Also I am not worried about this at all nor is my wife since she is already here. 

 

I just find it funny that as soon as something is spoken Immigration wise there are sites and "news stations/channels" that like to spread fear in hopes that they can get more viewers and clicks. It is infuriating to say the least. Why would it mess up anything to do with AOS or ROC at all unless they are adjusting from VWP or a tourist visa?

I'm not worried. I've had family members AOS last year with no issues, in less than 6 mos.. and I am filing for my spouse, with an I130 submitted in Jan, and completed NVC processing in May. I also know persons who have been denied at their AOS interview, and we're given removal orders. Immigration court here in NYC is flooded and that process can take years. 

 

My mom filed her N400 last year and still no word yet she came on the DV lottery in 1999. So it's not just one part of immigration.

 

The entire process can be difficult. 

 

I agree the media enjoys instilling fear.
