    K1 is not eligible for SSN, all it does for you is to allow you to legally enter the U.S.A, after you are married and submit your AOS package and received an EAD then you go back and ask for SSN.

    Anyway this news is just a smokescreen. No one with any serious knowledge about healthcare costs in America thinks that access by immigrants is a major cost driver. But because this administration won't go after excess profiteering by health insurers, drug & device makers, and other providers in health care, they want you to focus your ire instead on poor migrants "taking your health care away from you." From the discussion on this forum, that strategy appears to be working.

    That is so sweet of you to say. Sarah  is a friend worthy of helping believe me when I tell you that. It’s recovery time for her and as I said, better to know now than later.

    I have heard many stories where GENIUS attempts to trick spouses or defraud the system in getting to the US  but never anything like this. I though these type of stories can only be heard from Africa but I guess I was wrong and This is definitely in the top 10 of my all time stories.
     
    So sad to see this lovely woman going through this ordeal but at the same time happy to see she has a strong friend that are helping her along.

    The employees that release these data from USCIS are not politician, they are career employees dedicated for public services that are just like any others employee that work for a private organization and don't believe any of them would be asked or release data that are known to be inaccurate otherwise you would have already heard that breaking news from the NYTIME or WP.

    I'm sure they will definitely have some questions about why she did not adjust status and wants to try the k-1 again. I can't remember if it was on the ds160 or what but there is a question about previous visa sponsorship (i know there is one on the i-864 for AOS). As long as she didn't overstay (past the 90 days) on the K-1 you should be okay. I would suggest though getting married and going the CR1 route instead this time. The processing time is not much longer than the k-1 and it will definitely be a stronger case than doing a K-1 again. She will also be able to work once she arrives and you won't have to deal with AOS. It will also be much cheaper than the K-1/AOS process (which is probably better for you since you've already paid for a K-1).

    I'm the USC in our marriage, currently waiting for my husband's CR-1 so we can be together here in the US, and I worry about this situation in the future for him---he's soon going to be leaving his family, friends, job, country he loves, culture, food, tropical climate, all behind to be with me here in California.  We have already talked about this many times, and he reassures me that he will be okay, but he's never left Brazil so I worry about what will happen when reality sets in after he's here for a year or more and the novelty of being in the US wears off.  Sure the love we have for each other is amazing and that's what really matters, being together, but you're so right, marriage is about giving and receiving, lots of compromising and finding middle ground so that both partners feel respected, valued, and loved.  One of the things we have talked about is after a few years of living here in the US, if he wants to go back, we could do that after he has his US citizenship.  Brazil is a beautiful country, I have visited seven times, and yes it has problems as any country does, but I could be very happy there, and the cost of living is much lower.  He is sacrificing so much to be here in the US for a few years, so I would be very open to sacrificing for him if that is what he wants, to move back to Brazil to live after he gets his US citizenship.  We have already looked at the process to get a spousal visa for Brazil, and it only takes 2 or 3 months, right here at the Brazilian consulate in San Francisco.  It is actually our "plan B" if for some reason the US visa is denied or delayed too long.
     
    OP, do you have your US citizenship yet?  If not, apply and get it, and then in your long heart-to-heart talks with your husband, bring up the future, and float the idea of moving to Australia to live for a few years, after you get your US citizenship.  If he really loves you and wants you to be happy, he should be willing to compromise.  That is what makes a marriage strong--give and take.  Sacrifice on both sides.  And if he's not willing to compromise that much, enough to move to Australia for a few years, it may put things into perspective for him and he might at least be willing to move closer to your job, to a larger city in the US where you would be happier, and it isn't asking too much really.
     
    I wish you well and hope that you can figure out a solution together.  You deserve to be happy, just as much as your husband does.

    You need to have a heart to heart with him on this. Don't let anything undermine your marriage, and resentment can be the start of really bad things if you don't get it in check. Tell him how you feel, in a kind respectful manner. That will go a very long way.
     
    I can only imagine you are a little homesick, so keeping your mind occupied with things to do will help, and so I could see your reasoning about moving to a bigger town, where there are things to do. Be willing to bend a little, not that you haven't, I'm sure you have, since you immigrated here to be with him. Surely he will consider seriously what you have to say, especially since you have to drive such a long distance to your job. I would kindly make mention of that as well. This is a hard process to go through, and I can't imagine that he doesn't highly value you, enough to do things to help you be a little safer, like doing something to help cut down on that drive!

    During adjustment of status process, USCIS looks for all grounds of inadmissibility. From an immigration attorney:
     
    "An I-485 application for permanent residency is considered an application for admission to the U.S. This is a counter-intuitive concept that many struggle with. Even though the applicant is already in the country, U.S. Citizenship and Immigration Services (USCIS) treats the person as though they are outside the U.S. and seeking entry. Why does that matter? Because the person is screened for all grounds of inadmissibility."

    I think either you're legally married or you aren't. CPB is not going to give you a visa interview. They aren't going to ask to see photos to prove you relationship(though its plausible they will look through your devices, but unlikely). The thought that USCIS will find out about your ceremony in the future is laughable. People give USCIS all the credit and no credit at the same time. Why and how would they investigate if you had a religious ceremony in your home country, and if for some reason they did and you weren't legally married why would they care? Here's a clue, they won't. Now if you are legally married that is a whole other call game. POE questioning and visa interviews are entirely different things, has anyone ever seen someone denied entry at the border for being "too married"? Everyone is just speculating with the normal death and disaster tone you get around here.

    Could your friend squeak by on a technicality? Possibly. Could they also be rejected because of it? Also possible. People have been denied a K1 visa for as much (having a religious ceremony and not feeling it's a "legal wedding" or marriage), so I would think it'd be just as plausible to be denied entry ON a K1 visa for the same reason. I agree with others - it could all come down to the judgement of the CO approached, and what's said.

    A friend of mine Fiance was approved and issued a K1 Visa, but within weeks of the visa being issue, they married before her fiance enter the U.S. She still oversea and after receiving information through another friend, he is now concerned that her visa is no longer valid as they are now husband and wife and may not be allowed to enter the U.S with the K1 Visa. Can she use this visa to enter the U.S or they are screwed-up? If so, what options do they have?

    Was this in Guinea? Kinda important info, since every country has different marital laws. For instance, if it were Indonesia, the couple would be ok if they were not Muslim since they weren't legally married yet, but if they were Muslim, they'd be considered legally married since Muslim religious ceremony=legally married*... 
     
    *At least according to my wife. I concede I have not looked closely at Indonesian marriage laws...
