To those with non-changeable / non-refundable flights but who are willing to look into flying earlier: most airlines companies are currently waiving change / cancellation fees.
Even if your flight doesn't fit the criteria - I think it's still worth it calling the airline & speaking directly to their representative. The airlines are bending over backwards to accommodate travelers right now.

Hey, some of us have been advised by lawyers and CBP agents (yes, plural) to do it.

That wasn't possible because I couldn't stop working, plus many other factors.

I don't care one bit if others did, or are adjusting status. It's currently a perfectly legal pathway offered to those who entered with a non immigrant intent.  My personal opinion is that immediate family reunification should be as easy as possible, and I wish more people could be together in a fast and efficient manner - if that means expanding AOS eligibility, or other inland process, I am all for it.

If you really want to move to Germany and do not have any intention to move to the US, for her to become a US citizen is not the solution to your travel "problem".

For her to become a US Citizen, you would have to petition for her, she would have to move to the US and live there for 3 years until she could naturalize (apply for US Citizenship). Then you'd have to wait until the naturalization process is over. To sum it up:

    Once you're married in September:
You have to move to the US (without your wife) Go through the Spousal visa process which takes approx. 1-1.5 years Wait 3 years to start the naturalization process which takes probably another year (they're currently working on July 19 forms if I saw correctly).  So you'd basically be looking at last at 5 year process from today for her to become a US Citizen going the CR1/IR1 route.

Before you're married (if you were to start the process now):
You have to move to the US (without your fiancée) Petition for her --> K1 process (approx. 8-10 months), she awaits the approval in Germany. Get married in the US within 90 days  Adjust status --> AOS process (approx. 1 year, don'^t know the exact timeline) but she can't work, study, or leave the US for approx. 6 months until she recieves AP/EAD  Wait 3 years to start the naturalization process which takes probably another year (they're currently working on July 19 forms if I saw correctly).  So you'd basically be looking at a process with at least a 5 year duration for her to become a US Citizen on the K1 fiancée route as well.

Please note that either way, she can't leave the US (when having a greencard) for more than 6 months per year or it is considered that she abandoned her LPR status and she looses her greencard.

If you really just want to travel, stick with the ESTA  and don't overstay the 90 days limit. Moving to Germany doesn't require you guys to be able to spend more than 30 days there to prep the move - especially if she is German and knows how things work there.

Applying for a visitor visa as a spouse of a US Citizen would mean she'd have to show strong ties to Germany.
Considering y'all wanting to travel up to 6 months at the time: I assume she probably doesn't have the required strong ties such as a job and appartment (assuming since people usually can't leave their job for 6 months at the time over and over again and not many people would actually pay for a house/appartment and not live in it for this long)? So that could raise red flags (immigrant intent) to the consular officer and the visitor visa would most likely be denied.

If the travel visa would be denied, she'd have to update her ESTA question "Were you ever refused a US visa?" to "yes", which would then probably result in a refusal of the ESTA as well (as mentioned by others), which would make it impossible for her to travel to the US.

So in regards to travel to the US, basically you guys need to figure out where you want to establish your life together in the future:

    Live together in the US:
    - Since you're not married yet, you'd have to go one of the above described processes (K1 or CR1/IR1). She has to be in Germany for the duration of processing of either of these visas, but can travel to the US on her ESTA (90 days limit) during this time.

    Live together in Germany:
Travel back on forth on the ESTA within the 90 days limit.

Good luck on whatever route you choose 🙂

You can just go ahead and file for AOS. Other than that you can disregard what the lawyer said together with the shaming of some members here for that matter.

Only thing you need to keep in mind is that they won’t be able to work and leave the country for about 4-5 months until they receive their EAD and AP.

Additionally familiarise yourself with the income requirements for sponsorship and the new public charge guidelines (the latter is irrelevant if in some way you manage to get a courthouse wedding and get a packet together send before the 23rs, but that’s unlikely).

Other than that welcome here. Some personal advice regarding VJ. There’s a loud part of the member base that's right leaning to say the least some of which are of the calibre that would love to pull up the ladder behind them. More often than not they’re seasoned members around here. If you’re not interested in useless debates I’d advise to just keep to yourself.

Additionally there’s a general contempt for people that adjust status inside the US that manifests amongst other ways by scaring you into thinking things are gonna go bad, scary warnings on certain pages here and shaming people to name a few ways. It typically stems out of a feeling of envy or unfairness, it’s typically not personal though.

Either way, good luck to the two of you

Your wife had GREEN CARD HOLDER STATUS.  An LPR does not need any travel documents to reenter the US.

Someone seeking to adjust is NOT A GREEN CARD HOLDER.  That person NEEDS AP to leave the US and be able to re-enter.  The ship is a vehicle.  It's not US territory.  The ship would leave US territory to enter international water and a foreign port.

Different rules depending on different status.  You don't seem to get this.

Discover = credit card account. Presumably she has no credit history? Discover, as well as most banks, will not issue a credit card to her. She needs to start building her credit history first.

Some banks have programs called 'Path tp Credit' that help individuals with no previous credit history start building up their credit. For example, Capital One opened a credit card account for me that had a $200 limit (plus I believe I had to prepay certain amount, ~$50 - can't remember exactly). The key is to use it as much as possible and pay it off right away. In a few months she should be able to open an account with a smaller credit line elsewhere.

As per bank account/debit card - you should have no issues opening one for her in person an adding her to your existing one.

I think what OP means is that her relatives provided sufficient funds for her to present to the school to enroll as a full time student.

Back in a day I changed my J-1 status to F-1 by applying from within the country, and my friend “sponsored” me for the school as the school asked to provide proof that I have at least $15k in my bank account. Which I didn’t, so my friend had to fill out a sponsorship form for me.

My AOS took 1 year (almost to the day). I was one of the August 2016 filers, and about the only one who didn’t get an interview within the first five months, so I can totally relate to your frustration.

I made an infopass appointment after waiting for 7 months. They couldn’t tell me much. I contacted my senator after 9 months of waiting, they responded few weeks later and gave me few reasons why my case could be taking a while.

I received an interview notice few days after I heard from the senator’s office. Overall, I think it was definitely beneficial to reach out to them and ask for assistance though I can’t tell you whether it was a natural course of action or the senator’s office phone call that triggered the interview appointment.

And as as far as your travel plans go - sometimes airlines allow you to exchange the plane tickets for airline credit that you can use in the future. It is not something they mention online but depending who you call in customer support - they are able to extend this courtesy to you. And if the first person strictly denies this to you - sometimes calling again and talking to someone else helps as things like that often depend on the person’s mood.

Good luck to you! I hope you get good news soon.
