How to get my fiancé across from mx to us without visa [merged threads]

to care for her aunt she needs Eb3 unskilled worker

she can not care for her aunt under a K1 visa/ she will not be able to work at all till EAD is received

Eb3 needs an employer to file I 140 for her and prove there is not a USC (or other) here in the US to take the job pus pay the prevailing wage and employee benefits  

  • You must demonstrate the ability to perform unskilled labor (requiring less than 2 years training or experience), that is not of a temporary or seasonal nature.
  • You must be performing work for which qualified workers are not available in the United States.
  • You must meet any other requirements specified on the labor certification.

TN worker is a professional

  • Your profession qualifies under the regulations;
  • The position in the United States requires a NAFTA professional;
  • You have a prearranged full-time or part-time job with a U.S. employer (but not self-employment - see documentation required below); and
  • You have the qualifications to practice in the profession in question.

Why not go to Mexico and marry and go thru the process as its the best

there are too many limitations on K1 and working here (legally)

I would be very, very careful.  Below is a guide for a LEGAL process.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Properly file an immigrant spousal petition for her like everybody else. Marrying a US citizen does not mean she can just enter the US with no proper visa.

If you get married to her in Mexico, you’ll file for the CR1 (spousal visa) after that. It will not be quick though. 
 

You might want to take a breath, take a step back and research the process to fully understand what it all entails. Don’t let yourself get pressured into marriage and sponsoring an immigrant. Both come with serious responsibilities.

Your post is completely full of assumptions and inaccuracies.  Strongly recommend you do some research.  NOTHING about this process is cheap, fast or easy, and at this point it sounds like you're headed for a permanent ban from entering the US.

What?!  OMG, NO! So much NO.  You do not just marry and then arrive at the border to ask them to admit your spouse.  Wow.

 

She needs a visa to legally live and work in the US, and there is no shortcut or clever way around that.  It will take TWO YEARS.

If she wants to marry you then you file the I-129F for a fiancé visa and you wait.  She won't be able to work for some time in the US, probably over a year.  So you might consider getting married and fling a spousal visa

That is for a B2 visa.  But if she has had one before is a few weeks.   She can't enter the US with the intent to adjust nor can she work in the US.

Glad you are here doing your research.  Unless you are also a resident in Mexico and needing to return to the US for a job, there aren't any options do get this done quickly.

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

So I talked to the immigration lawyer about all this but it was a free consoltation could not tell me a whole lot sadly but I was told the spousal visa is the best way to go due to us living together already but my main question is do we need to get married here in mexico? than file? or file than get married or just do the k1 visa. Or another thing is one person asked me how old she is on here and about a work visa cause her aunt needs a care giver and wants her to take care of her is it possible for her to get a work visa ??

See the K-1 / CR-1 comparison, as compiled by our fine member Crazy Cat:
K-1        
    More expensive than CR-1    
    Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
    Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months)    
    Spouse can not work until she/he receives EAD (approx 6-8 months)    
    Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
    Spouse will not receive Green Card for many months after Adjustment of Status is filed.
    A K-1 might be a better choice when 18-21 year old children are immigrating also
    In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice   
    A denied K-1 is sent back to USCIS to expire
 CR-1
    Less expensive than K-1    
    No Adjustment of Status (I-485, I-131, I-765) required.    
    Spouse can immediately travel outside the US    
    Spouse is authorized to work immediately upon arrival.    
    Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
    Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
    Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

No option (NONE) will be fast.  There are no shortcuts.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

To sponsor a Spouse you need to marry. Anywhere it is legal.

You can get married anywhere that it is legal to do so.  Do not file for a spousal visa until you have a certified, translated marriage certificate.   You can file for a K-1 anytime as long as you’re unmarried.

 

Both processes will take AT LEAST two years before she has a visa to immigrate to the United States.
