Visa refused due to lack of income

Timeline

Hi everyone. Due to CoVid 19 my fiance only made ~$18k in 2020, and our visa petition has been "refused pending a review of the following documentation". We have been advised to provide examples of additional savings and a job offer, but were not given a dollar amount for what would be considered sufficient savings. Does anyone have experience with this? Our families are willing to gift us the required amount, but we do not have another US citizen willing to be a co-sponsor.

For a family of 2 (you and applicant), you would need to show $25k in amount. You can show the money based on US citizen income + what they have in the bank + any property owned, etc

Thanks NandV, really appreciate it. Do you know if my savings are considered, or is purely what my American fiance has in her bank account?

2020 is gone. What is your fiance's  current income? That matters. Savings or assets required to show depends on current income. For 2 people, if no income at present, the assets should be much more than $53,000. Some embassies would want to see assets of much more than $66,000. Some embassies may not approve visa on assets only.

Her current income is ~$2k a month, but she took time off from February to April to stay with my while I was having medical issues.

2k a month will not be enough, you will need a joint sponsor.

you have to make up the difference to get to the 125% of poverty, look up how many people are claimed and then make up the difference, so $18,000 minus say $22,000 for a couple is what you have to make up... OR get a job offer, for me the easiest is to show job offer and banking ... Offer letter has to be specific and list the amount of income potential.

 

I am new at this so I am not an authority but it is my opinion based on research...

hi do you know in which step of the k1 proces.s they look at the financial situation of petitioner .is it before approval the case within background check or is it when you are gonnoa prepare your documents for interview ( tax returns,w2,...

do you know in back ground check do they check only criminals or if you have debts they can see it as well?

You need to read and understand the process by learning the steps in the K1 guide at top of every page here in the blue bar.

The I-134 is submitted at the interview stage.

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Only the assets of the sponsor are considered.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
