No NOA1 yet, Getting worried

Timeline

The best way we were able to prove having met each other within the last 2 years was a trip we took about 2 years ago. The trip was from the 23rd of December 2018 and lasted until Jan. 3rd 2019. 

I have sent the application on Dec. 5th but so far have received no NOA1. I see that many people get a NOA1 around 10 days after sending their application and some get it after just a few day, should we be getting worried? The shipping was priority express and I sent everything correctly. The tracking said it was signed for and picked up on the 8th, so 7 business days ago.

Any tips?

Since I have submitted my application before the 2 years (just before), then do I not have to worry about the 2-year requirement if it takes them another 3-4 weeks to "file" my petition in their way? Our best evidence is on January 3rd, 2019

I don’t think you have to worry. I’d say it counts from the day you signed the form and sent it.

You must have met within 2 years of the day they receive the petition..  They received your petition on Dec 8th.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If you're waiting for your NOA1, USCIS is running way behind on the issuance of said document. Don't be concerned, alarmed, anxious, disappointed or any other adverb as they will be there shortly. A delay in the NOA1 is not going to affect you in anyway except it will take longer to adjudicate your case to a NOA2. 


Current processing of the issuance for a NOA1 is about 4-6 weeks. You are earlier in your expectations. A couple of key factors to look for is 1) has your tracking indicated the package was received? 2) Has your form of payment been executed? Having those two completed then you are close to receiving your NOA1.

Green Card Approved July 11, 2014 Approved, no interview. Went to card production.

Green Card received July 17, 2014 GC received without interview

Removal of Conditions

Mailed I-751 Dec 16, 2015 Submitted ROC (removal of conditions)

Received Dec 18, 2015 USPS notification of successful delivery

Check Cashed Dec 21, 2015 Check was cashed

NOA-1 Issued Dec 21, 2015 NOA-1 for ROC issued

NOA-1 Issued Dec 26, 2015 NOA-1 Received

Biometrics Appt. Jan 29, 2016 Biometrics Appointment Scheduled [Completed]

It took them 39 days to cash our check, and 1 day for NO1 email-notification to pop up.  So total of 40 days since they have received our application. It's only been 13 days since you sent application, don't worry!! :) 
It's normal that NO1 takes 1 month + now days..

it has barely been 2 weeks since you filed. It is taking 60-90 days for certain lockboxes to send receipts. I say take a seat

See 8 CFR § 103.2(a)(7)(i): "USCIS will consider a benefit request received and will record the receipt date as of the actual date of receipt at the location designated for filing such benefit request whether electronically or in paper format."

It's the day it arrived at the Lockbox that counts, not the day it was mailed/sent out. https://www.uscis.gov/sites/default/files/document/forms/i-129finstr.pdf "Indicate whether you and your fiancé(e) have seen each other in person during the two year period immediately before to filing your petition."

I sent mine on October 27th and have received no NOA1!

It can take awhile due to the current situation. I know someone who sent their petition the end of October and received their NOA1 last week. As long as you tracked your package and it says delivered you don't have anything to worry about.
