Expedite Rejected Without Reason

Hey everyone! I've been checking the site a lot over the last few months, and it's been a great resource to get a better understanding of the immigration process. This is my first time posting though, as our application is getting held up and we haven't been able to find answers anywhere else online.

 

I'm a US citizen petitioning for a CR1 on behalf of my wife, who will be coming from South Africa. Our case is being handled by the VSC, and despite our NOA1 date being nearly seven months ago (Feb 12th), there have been no updates from USCIS. I know that this is still within their estimated processing timelines, but with the processing times on this site indicating that VSC cases with NOA1 dates as recent as June moving ahead to NOA2, we've been getting antsy and decided to call USCIS to enter an expedite request. 

The representative I spoke to confirmed that we should have grounds to expedite for two reasons: 1) financial hardship, because I've become unemployed due to the pandemic; and 2) national interest, because my wife is highly qualified in the public health sector. He told us that we should be receiving an email from VSC within a week requesting evidence to support our case, but two weeks later, we instead received a rejection email. 

Is there any reason why they would deny our request without evidence? And regardless, is it possible for us to appeal their decision or simply send another expedite request? We appreciate any help or advice you guys can offer!

I am not exactly sure what question you are asking?  If they deny an expedite request, I would think the reason is obvious, the request and relevant evidence did not meeting their requirements.  Now you said you received a rejection email, even before submitting the expedite evidence, was that just for the expedite request or the entire submission?  Have you received a paper copy yet?  Did the email state anything?  If not, you may be able to contact them by phone and learn of a more concrete reason, or see if the email was an error.

There is no appeal. You can request another expedite.

Those broad categories apply in your case, but every expedite decision is considered on a case by case basis. There is nothing that guarantees success, as it is always discretionary.

My expedite was denied as well, I was advised to request an expedite again after 5 days (which sounds very odd to me because my situation will not change in 5 days). So maybe you can request expedite again? 

I have very similar experience. According to USCIS I had good grounds for expedite but received denial email without any explanation for the denial. I called USCIS to find out the reason and they could not provide me with the reason for the denial. Also was not asked for any additional info, very frustrating because in my case it is a USCIS error that got me in a tricky situation in the first place..

Thanks for the responses everyone!

 

To clarify, our entire application wasn't rejected, just the expedite request. But they had never requested evidence from us in the first place, so I feel like Boiler is right that they're just trying to limit the number of expedites they accept. 

 

As many of you suggested, we'll open another expedite request to see if we have better luck on our second attempt. Ideally our Congressman can do it on our behalf, so I'll try to reach out to him this week.

Pretty selfish mate.... All of us are in the same position waiting for our Interview date and under similar circumstances . Unless there is an an exceptional circumstance why are you more special than the rest of us?

I’m sorry to hear this :( do you think it’s possible financial hardship on the petitioner could actually work against the case though? Since you have to prove you can support the two of you? 

Found love, thought I wanted this path, two years later realized my partner was not worth all the stress 😁

Certain;y not an obvious one, usually we see that used in connection with EAD.

 

As always these cases are very individual so generalities may not apply.

Very few expedites are approved without any evidence. Typically for ¨financial hardship"to be successful, the couple needs to have lived together for sometime and then the USC returns to the US.  It sounds like you each self supported prior to and after getting married.   Your loss of a job in the US is not uncommon.   For her to be expedited to support you or ¨in national¨ interest, she needs to have a job lined up.  That can be very hard since she is not here.

 

As for sponsorship without a job - do you already have a joint sponsor lined up.

You, and literally everyone else.  Clearly only those who are qualified for an expedite will get one.

Like everyone said the reason about your job is the reason of thousands.

About your wife job, are you sure that she can practice here?

Because is not like, per example,  you are a doctor in your home country and then you can practice here without a revalidation. Does she did something like that?

If you didn't send evidence to back up the reason for the request that is why it was denied 

they also require proof ,  proof and more proof

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

@Jared C. you have to state how this is a financial hardship. Not just losing a job. The  government is looking at it so you are unemployed and you want us to rush another unemployed person to the US?

Your wife is in the Public Health sector. Is she a Nurse or Doctor? Those are jobs that are greatly asked for now.

And honestly 7 months waiting is very short time when there are cases at Nebraska waiting over a year.

 

Your Congressman or Senator an not expedite your case all they can do is inquire about it. Do make your case better you need to show the financial hardship and why having your wife here is needed and required at this time. Like you can't support two households, etc.
