If she doesn't have a job in the USA before she files her I-130, then this is all moot.

Indeed, and my advice is that she "waste money" signing up for ARAG, Hyatt Legal, or whatever her employer offers since as a new employer she can enroll in such benefits. 😂

Depending where your wife lives the process to citizenship can be 12 to 24 months. She should file for you now so your petition gets in line file for her citizenship and upgrade when it happens.

I’m with WeGuyGal on this one. “Not likely” means probably not, but it might happen. “No” means it can’t /won’t happen. Not the same meaning, and therefore one is not the correct answer.

I guess we ARE here for a grammar lesson so here goes:

Not likely - to say NO in an empathetic way instead of being blunt or harsh.

Sometimes, our comments to OPs tend to be unnecessarily harsh and lose the human touch as though we've not all been there at some point, unknowing to the process and asking the same silly questions.

So, excuse me for trying to be human when answering OP's question. 

 

However, if I was in agreement and seemed to encourage OP to commit visa fraud, then I'd say there was a need for those taking offense to my 'not likely' comment to smack my hands with the grammar ruler or scold me like a kid for aiding and abetting. 

 

As adults, maybe we can put the dead horse back ;)

Yes, let’s put it to bed. Here is a dictionary for you: https://www.merriam-webster.com/dictionary/not likely ,.. “probably not”, which is exactly what I said.

No grammar lessons from me, this is an immigration related site, and we don't sugarcoat, and US immigration doesn't have room to avoid harshness.  Intent to enter on a tourist visa with intent to get an EAD is a no-go, and there is no middle ground based on this site's ToS.

 

Thus, "no" is not equal to "not likely" in immigration parlance.

OP is a green card holder, not a USC. That falls under F2A, which takes ~2 years for the PD to become current then some time afterwards for processing and the interview. Around 2.5 years or so is a fair estimate.

Latest visa bulletin has priority date for F2A (for June) at July 2017. That’s one month short of two years. Plus, some embassies can add another few months -6 months for interview scheduling etc.
