Upcoming I-751 Found Out Spouse Is Pregnant By Another Man!

Now this. She finally told me today that she has been seeing this other guy whom she met at an office party. They've been seeing each other the past couple of months and now she suspects that she is pregnant with his child. I can't stand this. I know for a fact that I am not the father, since at least on my part, I have been taking preventive measures because I wanted for us to have our children when I am fully able to support them but not as of now. I am planning on pursuing further education to be able to build a good life for when we do have kids but MY KIDS. I don't know what to do.

I don't have time to even drag my feet to take all of this in, because we have an I-751 soon that needs to be filed. I'm not sure if delaying divorce proceedings would cause me to end up paying child support for a child that isn't mine. I have no hatred against the child if she is indeed pregnant, but I also can't jeopardize the future life of me with my own kids. And I don't think I can longer stand to be hurt repeatedly with all the lies and betrayal.

 

How should I proceed with our I-751?

Will I end up paying child support for a child who isn't mine even if I do a DNA test and if divorce is finalized before she gives birth? (given that we do decide to get divorced. this is too much for me.)

Can anyone shed some light in this matter? I would greatly appreciate it.

sorry to hear that about your situation.you should consult with immigration lawyer as well cos you are the beneficiary MR CABLE.Divorce may be effect on your case severely as well.Think twice before taking any step as other vj member said baby could be yours if you having sexual relation ship with your wife which is obvious.

No, you will not have to pay child support for a kid that is not yours. Also, and this is important, if your sure that the baby is not your DO NOT UNDER ANY CIRCUMSTANCE SIGN THE BIRTH CERTIFICATE. Because if you do yet claim that the child is not yours, then the court will still view the child as LEGALLY yours.

Assets acquired AFTER the marriage.  There are some assets tat belong to one partner or the other as long as they were not commingled.  For example, the prewedding assets of a retirement account belong to the owner. The increase in value after the marriage are split.

A child born during the marriage is assumed to be the husband's offspring.  Not following proper legal procedures in a timely manner can result in obligations for a child that is not the husband's.

Well thats why under a court request a DNA can be requested to prove paternity and avoid having the guy paying child support for a kid that is not his.

Unfortunately, it HAS happened before that DNA proved the husband was not the father and he still had to pay child support. Marriage automatically makes him the legal father of his wife's child until that's disproven in court via DNA testing.

get a lawyer, in some states the children born in wedlock are considered legally the children of the married couple, not the blood parents. get professional answers not emotional responses from unqualified individuals on a self-help board, it could cost you 18 years of child support payments, let the father of the kid foot the bill, best of luck to you, I hope it turns out as you hope

Thank you everyone for your responses regarding this matter. I will have a sit down and thorough talk with my wife about this whole thing once I'm cooled down. I just had a brief discussion with her this morning. She told me that she just had her monthly period so she isn't pregnant. It's unbelievable how she thinks that that should suddenly fix everything else. The cat is out of the bag. She's apologizing but that still doesn't justify what she's done. I will wait to cool my composure and tackle this in the most sensible way. A close friend of mine has already referred me to a good family immigration lawyer. I will be taking everyone's advice to get legal help should we proceed to take legal actions. It's so complicated dealing with legalities on top of personal and emotional hurdles. We're like at the mercy of the government and your partner when all you've been doing is trying to build a better self and future.

I am so very sorry for you having to go thru this!!

 I am kind of happy for you that you don‘t have to go thru the legal issues of that whole father,not father,DNA and what not stuff

especially because everything else will be exhausting enough

1)  At least you don't have to worry any longer about possible child support/DNA testing.

 

2)  If you and your wife remain married, I'd suggest both of you get testing for STDs, etc. since she's been with someone else.

 

3)  If you and your wife divorce, I'd suggest you still get tested to play it safe.

 

4)  Encourage her to take a pregnancy test to make sure.  Some women "spot" early into a pregnancy, so it may not be a menstruation period.

 

5)  Playing the Devil's Advocate...if you've already brought up the idea of divorcing her, her plan may be to "all of a sudden" get pregnant the next time you do have sex, trying to pass off an already existing baby as yours.    Stranger things have happened with people.

 

Lots for you to think about.  Lots of trust to rebuild, if you can.

File for divorce as soon as possible. This is terrible. You have my sympathy. 

There's nothing wrong with keeping the baby or giving it up for adoption. The wrong part was the cheating!

 

I would file for divorce with an unfaithful spouse. Yikes, sounds tough!
