Is this enough reason for I-130 expedite?

I am currently waiting for approval of my step-daughters I-130 which was submitted in March.   In the last month some things have happened where she lived which has made her feel her life is in danger.   The financial situation in Mozambique has been on a steady decline after years of growth.   This is causing more and more people to leave business and enter crime.  In her neighborhood signs started appearing with the names of young women from the town stating they were going to be targeted.   Everyone passed it off as neighborhood boys being boys and didnt think much of it.   One of the girls whos names had been posted, who lives across the street from my step daughter, had her house broken into during the night a few weeks back and was raped by multiple men till the point she expired.   The signs kept appearing and last week a young girl who lives further down the street had her house broken into at night and she was also raped by multiple men.  

 

The police are doing nothing and the town is itching to lynch / give a tire necklace to whoever they decide is responsible. 

 

She is staying with my sister in law on the weekends but it is too far for her to go to school from there during the week.   We have video from the local news station discussing the attacks and locating them in the neighborhood.  

 

My question is would these events warrant an expedite request on the I-130?

I see no expedite justification for living in a high crime area.......I think it would be wasted effort, but nothing prevents you from trying.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Like above, doesn't hurt to try asking for it and see if they approve it or not; but also wouldn't get your hopes up as also noted, a lot of places are "high crime" or even have violence going on, if they expedited strictly on those things half of petitions would get expedited; but again doesn't hurt to at least give it a shot, you might just get it.

12/06/2017 - I-485 Approved

You are free to apply. It won't hurt your case.

 

That said, unless you can indicate a specific threat to the beneficiary I'm skeptical if it would be approved. What may happen is a difficult justification.

Probably best if she moves in full time with you sister in law, expedites just quicken the process but she has an immediate issue.

The successful cases I have seen for expedite on VJ had their paperwork done at the Senator's or Representative's office. You can contact the office of the ones that are for your state/district and talk to the immigration liaison. They will give you advice. The case I know of was different. This man had a disability and needed his wife to move to the US as soon as possible and the liaison wrote up the application and forward everything. 

 

You need to look for the reasons for expedite and write it up in a way that fits. I think it'd fit the humanitarian reason, but you need plenty of evidence. It is a long shot but you should try.Try to get a police report or news article of what is going on, along with a map with the targeted houses and where your step daughter lives. Simply writing it up will not work.

 

"USCIS may expedite a petition or application if it meets one or more of the following criteria:

•Severe financial loss to company or person;

•Emergency situation; [2]  (the applicant is gravely ill.)

•Humanitarian reasons; [3] " (For example, outbreak of war in the home country.)

I agree with her moving as far away as possible from the trouble. School isn't worth dying for. She can come to the US and I'm sure take a placement test to see where or what grade she should start in. Missing out on even a year of school is better than missing out on the rest of your life. And if the scum doing this get some tires dropped over them, doused in gasoline and set on fire I sure wouldn't lose any sleep over it.

I agree with the other posters.  I think her safety is a bigger issue than schooling, even if she may disagree.  But lets be honest, being raped to DEATH, kills any chance of being in school, or immigrating to the USA.  She should stay safe!!!!

OP - I agree with the other posters too. If your step-daughter is in physical danger and is moving to the US soon anyway, why not have her stay with your sister-in-law and maybe pay for some tutoring to help her catch up when she gets to the US?

thank you all for the feedback.  I will see how much we can gather in terms of evidence and maybe try.  I apologize if I offended with the term expire, it was not the intent.  I agree it is horrible what happened.  This is a girl I knew from when I was living over there, she was friends with my step daughter.  

 

we have discussed her stopping school but for now she is continuing.
