My Boyfriend is in danger of being deported. He committed a felony crime which could cost his permanent residency to be revoked. 

I can’t afford a lawyer to fight it in court.

I really don’t know what to do & Aaba American girl I’m reserved about moving to Africa but i Love him

Well IF he gets deported the you either move with him to his country or forget avout him. I assume it won't be possible for him to come back to the USA.

what was the crime? and is he already found guilty?

 

a lawyer definitely would help!!

but if he really is getting deported you can‘t do much besides moving with him or let him go and seperate but I‘m pretty sure it won‘t be possible for him to move back to the US

What are the exact charges?

Has he already been to court----if so what was the final disposition?

Has he been given a notice to appear before an immigration judge? (separate from the criminal court case)

 

Without knowing more details, hard to give adequate advice...

You say:  "He committed a felony crime". He confessed or were you with him? If you are not sure, chose your words carefully. Allegations are not always true. If convicted, either move with or try to forget him. If found innocent, he stands a good chance to remain in the States with you. Good Luck!

and what African country

i would move to Morocco or Tunisia or South America  if i needed to

others may not be so safe

and if he committed a felony crime here,  maybe he is the one you should be afraid of especially if he needed to do crime back home to support himself

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

He’s from Guinea Africa.

When he was 19 him & his friends got in a rather serious fight with another group of guys and unfortunately someone died during the fight. Everyone involved went to jail for the fight  but  4 men were charged with involuntary manslaughter. My Boyfriend was one of the 4 who went to Jail he was sentenced to 8yr serving 6yr 11months of the sentence in prison & 5yr of parole when he’s released.

Hes due to get out in December.

He hasn’t been contacted by immigration but I’m aware of the law and I Know that every immigrant has to see immigration board before being released from jail.

In all honesty, I think you should prepare to move to Africa.   That sounds like an aggravated felony, making him subject to removal.......I would be surprised if they don't immediately deport him the very day he is released.. On what grounds do you think you can fight this?  He was convicted.......

What's wrong with Africa? Seems like you only have two options: move to Africa or let him go.

He took a ple-Deal but wasn’t informed that by pledging guilty would subject him to being deported. 

When filling out court paperwork a question asks ‘“Are you a illegal immigration” which he answered no.

Therefore the courts didn’t notice him if the immigration issues he could face.

He currently has a PCR court date which is a post conviction court hearing.

Are you kidding? That sounds like you're looking for some legal technicality. I don't think that will fly .  He didn't realize that a conviction (yes, he admitted guilt) to an aggravated felony would subject him to deportation? Yea, right!!  He should have realized that when he read HIS responsibilities as a Green Card Holder.  I could say a lot more, but I will restrain my urge........Good luck in your life.
